AC-21 applies only when I-485 is applied & pending more than 180 days, and AC-21 shows the path for I-140 Portability.
In ur case, u r concerned about Priority date portability, which is possible if the approved I-140 is not revoked due to fraud or willful representation.

I can understand the validity of client letter in case of new H1B visa stamping! Can the US visa officer ask for such a stupid letter, during H1B renewal visa??

It was a foolish move to withdraw the 2002 EB3 pending I-140! If that got approved, u cuda interfiled (Pearson memo) /w ur 2005 EB2 I-140, and hence got a 2002 EB2!!!
Luks like ur company wants you to be with them for another 4-5 years! It wud take a while for EB2 India to gallop to PD of 05! |

Keep trying for visa appt in nvars website, atleast twice an hour!!! Ask a friend or relative to watch out for the same.
And I think the US visa officers in Canada are awesome!!! I still cant believe that they call applicants who stand the chance of getting their visa issuance delayed!!! Its completely Beyond the Call of Duty! Kudos to the US consular officers in Canadian Posts. |
