To the OP, use your best judgment. It depends on the amount of risks you are willing to take and weigh the risks - your job stability and real estate market in the area where you are planning to buy. Prices are not coming down in every area. Areas with good schools and safe neighborhoods are still fetching good prices, and there are still investors with loads of cash buying up good homes in such areas with cash down payments.

I have been a risk taker all along and used AC21, even when several say that's risky. Next, took a promotion from a senior programmer analyst to a systems development manager even though people say its not a 'similar' job. Next, I am at the verge of closing on a home, even though the economy looks bleak. But the way I look at it, like Kaisersose stated, there is a risk everyday. So you can either remain worried and stay put or take a risk and buy a home. Your call.

Yes, changing the lender is the best thing to do. With the current tightening of loan processes, some banks are going overboard in rejecting loan applications. Best of luck.

Not true. You can provide them a copy of your I-485 receipt as well as EAD. The receipt is good enough to prove that your status is AOS pending and EAD is proof that you can legally work in the US until the expiry of the EAD.

I too am working on EAD and the above proof was good enough for me to get approved for a FHA loan.

Ha !! A family who have valid EADs are not allowed to speak to their attorney for hours while a guy who almost exploded a plane on Christmas was given an attorney in 45 minutes. F%^$^ Idiots.

Topic: Feb'2010 Bulletin is out....

I think USCIS has this big slot machine with numbers instead of fruit & flower symbols and someone pulls the lever once a month and voila, cut-off dates for the next bulletin. And looks like, someone hit a jackpot this month with a lot of 22s there.

Anyways, whoever wins there, we always lose. Hmm, now what do I do until the next bulletin ?......

Yes, despite the as-usual limping dates, USCIS has scored a first by giving substantial explanation of the movements and possible future cut-off dates.

Thus with a March 2002 EB3-I PD, I should have no hopes until Oct-Dec 2010. No point in expressing frustration over something that I've no control over. Just sit back and watch....

I took a position for systems development manager recently. My earlier position was Sr programmer analyst. I had asked my attorney Ron Gotcher and he had stated that this can be considered under vertical growth. Different attorney's will tell you differently. And different forums will give you different answers.

Ease of use, easy to carry and easy to replace if lost is why I prefer state ids over carrying passports everytime. What makes my situation stupid is that I'm asking for renewal (from the same state) and not a new card itself.

A funny yet not funny incident - the lady at the DMV looked at the I-485 receipts of my kids and said, "This is good, all that you need is a letter from the authorities stating that these are approved". Oh yeah, if getting a GC were that simple.

Hello,

Another stupid fallout of not getting GCs for so long. Cannot renew State IDs.

The state ids of my kids are close to expiring. I went to the DMV (California) and was told that they need a social security card or GC. Now, for the social security cards, I'll need to apply for their EADs (as I'm working on EAD and hence their H4s are no longer valid).
That means spending over 600 dollars for the EADs. The DMV does not accept ITINs nor I-485 filing notice. Has anyone got over this ?

Topic: Any predictions when EB3 India PD will become current

EB3-India is a pendulum in terms of cut-off dates. After a long period of time, just when the cut-off almost reached the end of 2001 (i.e Nov), it was pulled back and put into the favorite month of USCIS for EB3-India - April 2001. Again it has made a slow crawl, by a week. How long this will continue, is a matter for conjecture.

Unless some significant spillover, or immigration bill does not happen, EB3-India seems to be destined for a long snail movement in cut-off dates.

My philosophy about this matter is simple - Stay happy where one is and do what it takes to adjust. I've met scores of Indians who keep dreaming about the good life that they had back in India and talk about going back but never do. Such people will never be happy in life. One must be firm about where one wishes to be and do in the future.

I'm firm that I want to stay in the US, see my kids get educated and settled here, and then I shall return to India in my old age. Till then I'll continue to strive to make this country my home (unless USCIS thinks otherwise). Hence, though I do miss many things about India, I don't harbor thoughts of returning home.

I know of some who have been equally firm about returning back to India, have done so without remorse and are happy with their decision. My own brother was in the US, but returned to India during the dot com burst and was so disheartened with the going-ons during that period (like consultants ready to work for $20 an hour just in order to stay back) that he gave it all up with a promise not to return. The immigration officer forgot to take his I-94 and my brother threw it in a trash can outside Mumbai Airport. He's made it good back home and is happy where he is.

On another spectrum, I'd worked with a consultant who had a March 2002 EB3 PD, and who went back to India (after filing during the July Fiasco) for good. However, his decision to return was more his wife's than his. Last I heard was that he was trying to return to the US as the job market wasn't good back there.

Software engineer to Director is quite a leap. It may not be falling into a 'vertical movement' situation.

I've moved from Software Engineer to Systems Development Manager and though I no longer code, my overall responsibility encompasses making certain that all aspects of development are done on time and with quality. Something that a software engineer too must take into account. Before taking this promotion, I'd asked my attorney, Ron Gotcher and he had said that mine falls under vertical movement and it should be okay. I know that attorney's vary on this, but I've taken the risk because such opportunities do not come often.
