If I do masters from University of Phoenix online, will I be eligible for EB2?

I think they should apply spillover in the last quarter. At this point I dont think they can afford to loose any visa numbers.

It doesnt really matter wether you sign it or your attorney signs it, as long as it reaches USCIS on time. Dont get worried over it. You might have submitted G-28 form during 485 filing which states that you appointed lawfirm as your representative to handle all the work with USCIS. So, any one of you can sign.

She can stay out of country as long as she wants to but to reenter she needs to bhave AP. She needs to be present in United States while her AP renewal. She can not use AP to reenter if you apply/approved in her absense. hope this answers your question.

Check your YTD amount and compare with your H1B prevailing wage, if your YTD is more than your Prevailing Wage then your employer may argue that he already paid you what he was suppose to. Just my openion.

I back LRIndy on this, you still have two months payroll left so if you can make it to your LCA wage, then you are fine i believe but again this is just my openion. I suggest you to talk to an attorney.

people who got LCA using new system needs to provide work location information to USCIS and thats the data USCIS is using to visit sites. It became normal practice now a days.

There shouldnt be a problem. Did you happen to Renew or transfer your H1B recently?? (may be after the new labor system started)

The sooner the better. I contacted couple of attorneys, they feel that it would be difficult right now to get pass through advertisements. Due to economy we may get lot of response for the PERM ads, in that case PERM may get dienied.I am waiting till end of this year and will start working in January.

How long it took for you to get PERM in EB2? and also how long it took for 140 approval.

6-9 months if you are lucky otherwise may take 18+ months (With Audit etc).

Your PD is not current, is there any specific reason for SR / Infopass? just curious... BTW thats the response to your SR.

did you notice any updates on your case (i.e.LUDS) after replying query?? if not I would wait for another week and will call them.

Thats the estimated date and it doesnt mean that every application before oct 17 is pre adjudicated. The applications which are not adjudicated/pre adjudicated and are filed on or before OCT 17th are under process now. As we know not all applications are looked by one person. One IO may finish his/her job and may look for more applications and another IO may be sitting on his first file for months. So depends on the case load and also availability of the IO personel dates are moved. This is to balance and sequence their load of work.

Even for pre adjudication all applications are picked based on the RD.
