please read again.. "My friend did his M Com from India and got his Eb2 140 approved(doing software testing). All they care is Masters degree,no matter what is the course contents. I have done my BE from REC in comp sc and I dont qualify for Eb2..."

Topic: Friend send out from JFK
Amazing. With all the news flying around, I consider it highly irresponsible of your friend - who has a GC pending - to try and enter on a H-1b and that too in JFK.
So you think it is irresponsible to travel on a valid H visa, which clearly permits travel? It travel back and forth on H1 at least 2 times a week (land crossing in Washigton State) and have never heard a peep from the bordwer officers. I don't understand why this issue seems to be limited to NY.
Any thoughts?

I belive the CBP is running a trial in NY and NJ airports first. Either they would extend the same procedures across the country or just stop this non-sense once they have been sued. What a nightmare for the Consultants! | | | |

today i got a call from USCIS officer and asked me to send photos for my AP filed online. She was saying that she din't want to send me RFE which will take longer time to respond instead she wants me to send the photo to her address directly. that seems to be nice and simple.
this is first time i got the call so i just want to share with you all.
I have red a few similar incidents of getting phone calls from customer-focused IOs. Kudos to the IO! | | | |

Topic: Rejection notice
What really happened was, i filed during the july 2007 rush. I filed I140, I485 and I765. They split the package and processed the I 140 and sent the other 2 to Chicago. Why i dont know. Chicago cashed my check and then returned the file to me. They are not consistent, for 2 years i have not been able to work. I have asked my congressman for help.
If I understand correctly, you applied I-140, I-485 and I-765, but USCIS rejected your I-485 and I-765 in 2008. Right? Can you tell us the reason for rejection? Did you appeal or reapply? Also, can you please update your profile? | | | |

Topic: February 2010 Visa Bulletin has been posted
Still darkness looms the corridor waiting for a door to shed some light, the corridor seems to be taking a long toll and I don't know if we will ever see the light. Priority dates are still not advancing so much and talk about Immigration reform. I guess they have shelved immigration reform till another time. I still hope that someone will be able to get things right and have things moving forward.

Topic: Developing iPhone App ...
If I were to develop an iPhone paid app, will I be able to do that just using my EAD without making any changes/mods to my immigration status/docs?
Here is my profile:
- I-485 filed on Aug 2007 EB3
- I-140 approved
- Have EAD until 2012
- Currently on H1-B with my employer.
Anybody have any experience like this? I am not really starting a company per se ...

Topic: RFE on 245i (physical presence) & employer change of address
I-485 RFE Physical Presence Evidence
I just got an I-485 RFE asking for more evidence that I was physically present in the U.S. on Dec 21, 2000.
The letter says the documentation submitted wasnt sufficient to warrant a favorable consideration of my application.
I arrived in the states in May 2000, with a visa that expired in June 2000 (came as a tourist). I never left the states. I found an employer in Feb 2001 and petitioned me so we were able to file before the deadline on April 30, 2001.
Are my I-94 and Visa not enough? or should I resubmit them? I dont have any other documentations such as bank, credit card statements, US govt IDs, utility bills as I didnt have any SS number at that time, I was out of status after June 2000. Its been almost nine years, I really dont have anything except letters sent to me which are postmarked before Dec, 21, 2000.
My I-140 has been approved on employment based petiton.
Sorry to see your situation! Can't you use the notarized copies of your Passport as a proof of your physical presence? The passport will have all your departure and arrival details and immigration stamps with dates. Just throwing an idea to see if that would resolve the issue. All the best! | | | |
