3. and she wants to file un-employment benefits for herself to fund her LLC :)

3) Is there a way, we get citizenship by next year and run for senator / president post? :)

Before reading further, let me tell you that I was also a H1 guy working with desi consultant company for past 6 years. I have received my GC 1 year back and still with this desi company. I have no bias for employee or employer... these are just my thoughts ..
Please note that there are enough bad desi employers but same time there are enough bad employees also here.
Before trying to sue your employer ask yourself few questions about your honesty and integrity ..
Are you aware of the way desi consultancy companies revenue model work? You didn't get single dollar to employer in 5 months. Then how can you expect salary. You wanted company to pay from its pocket. You would have resigned and left this country. Or employer would have fired you. You stayed back here for your own personal interest.
Can you do same stuff by joining American companies? They kick you out on the day you loose project. They don't care for your GC.
Be happy that this company kept you even you are on bench for 5 months. Why are you on bench if you are so skillful.? Why did you stick to this company without leaving that time.
How much revenue you generated for your company? How long you stayed with this company and what is your contribution to company's growth, so that company can sponsor you employment based GC?
Most of desis think that they can just land in USA on H1 and apply for GC in the airport itself and do frog jump for personal gains without caring for employers who sponsor and expect to work for them.
How can you think of leaving this company on day one of getting employment based GC? Employment based GC suppose to be for company to keep you in permanent position after getting GC.
INS can revoke your GC if they know that your intention is to leave company after getting GC. By staying on bench for 5 months without pay, you became out of status. You lied about it while filing 485. So your GC will be revoked if INS digs deep into this. Of course your desi company will also get black listed and your fellow desis will suffer.
First be honest and thankful to your sponsors. If you are not perfect don't expect others to be. |

Oracleboy ............ Your stay in USA on H1 without 5 months pay was illegal. If INS comes to know, you employment based GC will be revoked and will be deported. Your employer will be put in black list. |

Come on, man. You did a good job by telling the truth to your boss. I agree that it is not your business to do background check on your colleague. Still, once you know that other guy has bad background, you can't keep quite. What ever you did is good for your company. It shows your honesty and integrity. You need not feel bad. But make sure you are also honest and sincere towards your organization. |

So I understand that - Welcome notice will be I797 with type as - Welcome notice . Approval notice will be I797 with type as - Approval notice. So I missed "Approval notice". I don't know if I missed it in post. It is already 20 days. It was mailed on 29th November.
Some one asked my details ( it is there at the beginning of thread) , i am copy/pasing it -

I have received Physical card and welcome notices in 1st week of Dec. My Lawyer received I797(It says welcome notice) and sent it to me on 12th Dec.
Is welcome notice different from Approval notice.? I thought lawyer would receive approval notice. Now I am confused.
Is any one received Approval notice that looks different from Welcome notice.?? |
