Topic: Transfer to National Benefits Center?

AOS interview went pretty well today lasted about 1 hour, IO was lady very nice but picky and she was thinking it was family based application for first 15 minutes. Reason for interview my dismissed Nolle pross expunged arrest.

she did NOT insisted or Asked about the police report:) she was happy with the presented court documents and disposition. But she asked me to explain the arrest and was very picky when it came down to explaining the arrest she wanted to be friendly and said it is nolle pross & dismissed but I want to know what happen it would not matter much (TRAP) :).

We strictly stick with the truth that it was misunderstanding and mistake in identity and we fought the case and it got Nolle Pross / Dismissed. I was clear that I never committed any offence. Then she moved on with other stuff . Half of the information from our file was missing since it got transfered two time but I had all the originals and copied of approval notices TAX marriage and AC21 documents so she was satisfied.

She said since there is arrest involve it has to go through supervisory review but as soon visa bulletin gets current we should get green card. Me my wife and our attorney all have the same impression from IO that interview went well and once supervisor signs off on it. It stay in shelf wating for visa number for AOS approval and she said the same to us.

Now waiting for Eb3 Row Aug 2003 to get current. I am so glad Iam over with this interview.

2.) One of the biggest threads here at Trackitt is the "Transfer to National Benefits Center" - This thread has a lot of comments/hits, etc... I don't know the exact procedure, but if the Service Centers transferred the case to the NBC, that means that it goes to a field office for an interview. I don't really know if, after the interview, cases get sent back to the Service Centers for further processing or if they are kept there until a number becomes available.

Given the number of people that have had interviews/have had transfers to the NBC, it is reasonable to conclude (much to my dismay) that there are many, many cases sitting at the Field Offices.





In 90% To 95% cases it stays in local office collecting dust waiting for visa numbers.

You need not (should not) write to USCIS. From the day you go out of status, your will have upto 180 days to leave the country (without affecting future entry bar). I am not suggesting you take up all of those days, but in the worst case you know how many days you can stay without getting into 3/10 bar issues.

Note that you will still be out of status for those 180 days, so if you get a new H1 (transferred or otherwise0, you will likely be asked to go outside of US to get a visa and an i94.



+1 do not write or inform USCIS. Try to find a job ASAP its difficult not impossible that would take care of everything.

One can have more then one pending 485 and eligible for EAD. Eventually you have to pick one, real quick family or EB once you do that, that would be your final AOS 485. If two EAD's bother you just return one with the letter or never use one.

NBC will process your case and send it to local USCIS close to you for an interview when your time will come. Its a standard procedure for all I-30 cases for family base immigration applications.

Thanks for the link this is new development but they have issued memos like these in past also on the same subject.

They have issued me RFE to redo the medicals on 12/07/2009 this Memo is dated 12/30/2009 so I guess people start complaining about it once they have issued enough RFEs. Anyway I hope most of immigration officers will read this memo and act on it. keeping in mind past USCIS behaviours that's unlikely to happen. If someone is asked to redo the medicals again it would be interesting choice to debate on RFE based on this memo or just redo it and get it over with but this is new development.

Yeah I use to think the same till I got hit by RFE for me and spouse to redo the medicals. There are substantial amount of cases which were asked to redo the medicals on interview stage also. Relaxation might be true in the past not from the date they have changed I-693 form it self. As for the initial evidence requirement it is true but you can send initial evidence any time after filing with decent amount of time like in couple of months, as your file most likely will be sitting in mail room within that time.

Actually you can file your 485 without medicals and send the medicals later on. It is not advisable that you do medicals before hand.

They have issued RFE in my case to redo the medicals again since they where more then two years old. These days they want medicals fresh not more then 18 months old. Lot of people here will see redo medical RFE once visa numbers get current for the cases.

As for Positive TB skin test you must get the X Ray which is clear and follow the immigration medical doctor recommendations.

If you invoked AC21 and sent it off to USCIS then you might get an RFE, BUT if you send in everything the correct way then there should not be any problems.

You could just move companies and have all the paperwork ready to send off if needs be and let sleeping dogs remain asleep. If USCIS need anything from you then an RFE is usually sent or NOID notice of intent to deny; which gives you a chance to invoke AC21. You should only consider doing this if the old employer is going to let your I-140 alone and not give you any hassle. If they seem like they might give you some hassle when you resign then invoke AC21 asap. If they are cool with it all then let it rest until needs be.
