H4 EAD is safe until May. It is probably safe until 2016. It may be safe forever. It has a lot of support and the lobby against it ("the no 2-for-1 visa" lobby) is not well organized compared to the tech companies and other firms with hiring shortages. But nothing is certain and the safest stance is an early filing.

USCIS explicitly says this is not how EAD is going to be for H4s. Having been granted the H4 visa a new set of biometrics should not be required. Just documentation. Current processing times at all the centers (we use the lock box in Nebraska) is about 3 months. USCIS processing times are available on their website. The 90 days waiting period was established to allow for additional processing capacity to come online. If we see wait times start to drop in April and early May that would be a good sign. More likely they will climb after May 26th with early applicants getting more timely results than later applicants. We are advising all clients to apply early.

Since she is allowed to travel on her h4, she should be allowed to travel during EAD consideration. You can always get permission in advance. USCIS will likely make a statement on this and it will likely be a case by case analysis like most departures during visa application.

I am so happy to see people really talking hopefully about H4 EAD. The backlogs are supposed to be managed by the 90 day notice period, but there is a BIG backlog so we shall see. We are encouraging clients to get applications in as close to May 26th as possible. The whole point of EAD is to unlock the working opportunities for spouses. If you are upset about visa slavery then this is a move in the direction of freedom.

This all sounds good and I stand behind the advocates who are finally able to make improvements to the system. But the practical effects are extremely limited for some groups. Take the H4s, who we know are going to be allowed EAD. I asked for test cases here recently and was overwhelmed with responses of people who want to be first in line to file. That's because DHS has waited so long to act that they are unlikely to be able to resolve the 250,000 case backlog that they expect in the first year before the administration's tenure ends and the order is subject to review. In fact, early applicants may get H4 EAD by February, but candidates who have not filed by Christmas will likely wait 6 months or more. We have started to pre-file cases at H4EAD.net and have some filings going in Friday. Our goal is to have the majority of our clients in by Thanksgiving because the two holidays will likely be the only safe time before the congress comes back and begins to act on the executive order, potentially ending the progress of all applications. Time is of the essence.

It seems like there is a lot of interest in H4ead. I am an immigration lawyer in Los Angeles, but obviously clients can be virtual for this since there are no appearances. When the EO hits there will be a million people in line to qualify and since this is new none of us know exactly how it will work. I am looking for ONE client who wants to preprep their filing so that we can file first and see how it works. There will be no attorney fees, but you must be willing to pay the filing fee (which could be $285). You'd pay that directly to INS. Contact me through my email and I will have you call my office. You obviously must be a qualified H4 visa holder. Since we don't know the rules I may prescreen two possible candidates.
