Thank you!! Sorry for the delay in the response. There is no problem with your case. Since you have a masters degree in US plus 4 years of experience you are qualified for the EB2 petition. The nature of the future employment job should very well match your current profile and the job you do. If a employer is willing to hire you after processing your GC, you should definitely go for it and start the process being with the current employer.
Regarding the timeline, the process would definitely take an year if everything goes well as planned. It might be sooner if you are lucky. Also your priority date should be current to file your I485. My case was future employment and EB3 to EB2 porting.
I had a earlier EB3 priority date and I retained it for my new EB2.

Each case is different and you also need to hire a good attorney who understand the future employment and guide you through it. As I mentioned earlier, you need to have lot of support from your future employer through out the process.

Yes you can..If you are eligilble for EB2 and for the job requirements..you can request any employer to start your GC process on future employment..It's a process and you need to have lot of patience and support from your employer. Once you get your green card in hand you can immediately join them. Good luck!

Based on my own experience and seeing the misery of other EB3 folks , I can assure that porting from EB3 to EB2 is the only solution for EB3I if you are interested in green card. I have enclosed the latest demand data for EB3I and it is very obvious that who ever can port from Eb3 to EB2 should do that ASAP without delay.

"On February 20, 2013, your I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was approved. You will be notified of the decision by mail. Please check our website at www.uscis.gov for further updates on your case, including when the approval notice is mailed. If you do not receive the approval notice within 30 days, please call customer service at 1-800-375-5283 for further assistance.

During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision."

Couldn't believe this happened..Thanks to trackitt which I open and follow almost everyday.

Case status :

EB3 to EB2I porting : Perm was initiated through future employment May 2011 and went in to audit for almost an year.

Priority Date : July 2004
EB3I to EB2I : I140 date ported and approved on Oct 28th 2012.
I485 filed : Dec 14th 2012
EAD Approved : Jan 24th 2013
I485 approved : Feb 20th 2013

My case is similar to yours except that the old EB3 priority date is July 2004. I140 approved in October 2012 and date got ported. Applied I485(TSC) on Dec 14th 2012 and did the finger printing on Jan 9th 2013. Today morning received emails for both primary and derivative that I765 and I131 got approved. So i think you will be getting it pretty soon :)

The same in our case too..The Derivative receipt notice doesn't have the priority date and the preference classification but the receipt numbers are in sequence. I think it should be normal..Also got the biometric appointment letter for Jan 9th..Btw filed our case on Dec14th

I agree with nitG..same case with me too..upgraded to premium and the status changed back to acceptance from initial review..after 4 days it was approved and moved to decision without changing to Initial review. Don't worry and good luck!!

I have been with Company A for the past 8.5 years and has a EB3 approved 140(priority date 2004) with them. I have been extending my H1B since then. Last year I applied for EB2 perm with a future employer Company B and recently got my I140 approved and the date has been ported. My date is current now. The question is when would be the best time to join my future employer. Is it after applying I485 and getting my EAD or transfer my H1B with the future employer at this stage and then apply for I485? I have heard about RFE at I485 stage questioning the intention to join the future employer.

Any update on your 140 case? I'm in a similar situation. Applied in future employment premium on 9/21 and USCIS notice date on 9/24. There is no status change yet and online still shows "Initial review". It's really frustrating to wait :(
