Hello, Here is my situation :

I had a valid H1b from 2013 - 2016 June with employer A.

Transferred visa to employer B in May 2016 and received approval till End of 2018.

Aug 2016, I received an automated email from USCIS saying the 2013-2016 H1B application is in initial review.

Today(05/02/2017), I received an automated email from USCIS revoking the 2013-2016 H1B with employer A.

1. Is this routine? Wonder why employer will submit a revoke application a couple months after I resigned?
2. Does this have any impact on my H1b with employer B? I checked the status of this application and it shows approved.

Here is the contact info for consulate in India. Lets all try to call them Sunday IST to know if dropbox is suspended. I am also planning to travel next week and am eligible for dropbox----

Callers from the United States can reach the contact centers 24-hours a day between Monday at 8:00 a.m. and Friday at midnight, Eastern Standard Time (EST).

The call centers are only closed on Saturdays, Christmas Day, New Year’s Day, Diwali, and Holi

Thanks lampbreaker. I will join the new employer only after transfer is approved (not just applied). The thing I am confused about is will the new employer get 3 years when he transfers or will it be only till the end of the current visa(June 2016)? The latter will be an issue since there is no way the new employer can get I140 approved in 6 months.

question for folks who have been in the forever H1B extension zone( or as they are called on trackitt: 'experts' :-) ):

I am in my 9th year of H1B that expires in June 2016(I140 approved through desi consulting company). I am being offered a full time position with a leading IT company that is ready to take over my visa and GC processing. I am interested in the offer but am not sure if I should get my 3 year extension done through the current employer before joining or join now( both options are okay for the new employer). If I understand correctly, the new company could seek an extension when they do the visa transfer meaning I could get a new visa till 2018/19? Is this correct? I think the desi employer will withdraw I140 once I resign so if I get a visa transfer that is valid only till june 2016 and then getting another extension might be tricky because I140 might be withdrawn by then.

Could you guys suggest what is a better/safer option : join now(& hope my new visa would be through 2018/19) or get extension done and then transfer?

Topic: PIO Card discontinued and replaced with OCI

Hello Trackitters,

I undestand that as of Jan 2015, Indian Govt has discontinued the PIO card and is issuing OCIs. The embassy website states that new applications will have to be for OCI but it does not clearly state what about folks that already have a PIO card. Do they have to get it converted to OCI or can they continue to use it until expiry? My daughter has a PIO card so want to make sure we get the conversion to OCI done if that is what is needed. Anyone knows?

I declined the offer but based on all the research I did(asking friends, friends-friend, door ke rishtedaar :-) ), they do EB3 for folks below Manager level and I was being offered Sr. Consultant so gave up. I can safely say I am not regretting my decision so far since I am getting to enjoy work + family life as I dont have to fly!

Hi, I work on h1b in C-V-employer model and had a question. Last week, I fell down and fractured my elbow. This accident happened at the client location and I had to take a couple of days off. A colleague of mine says there is something called workplace injury compensation thing that I am eligible for where in I get paid for expenses and days I was off. Who pays in this case? Client, preff vendor or my employer? I am not looking to make money, just want to know my rights.

Hello varam491, what did you finally decide? I am in the same situation: Approved I140 from a desi employer and have a great FTE offer from CTS. I also have a family and a long term project lined up with CTS. It looks like CTS PERMS are delayed than regular ones but one thing I am not clear on is at the end of the day, are the PERMS approved or denied? I am in my 8th year of H1 and the way I understand, they should get a 3 year Visa when they file for H1 transfer? I am trying to understand if I140 will come within the 3 years atleast??

Hello,
A few details before the question -

Priority Date : 02 May 2012
Category : EB2
Current H1 valid till June 2016 (based on approved I140 - in my 7th year right now)

I got a pretty good offer from a different company and they will be filing a new PERM/I140 next year however when they do the H1 transfer, will they be given a 3 year validity(till 2019) or just the remainder of the current visa (till June 2016)? I am wanting to know this so that I can decide if the amount of time the new company will have to get I140 approved is enough to get the next H1 extension filed. The answer will also help me decide if I should simply wait till mid next year before joining this company to see if the executive action will allow I140 porting without a new PERM.

The things that are driving this move for me are primarily better exposure, growth, brand name and safety in terms of stamping and GC. As mentioned earlier, I already have an EB2 - I140 approved so GC is not the thing I am going to join them for. They however will need to sponsor it for me to join :-)

Thank you everyone for all the feedback/thoughts.
The HR has stated that GC filing will happen in 6 months(after first review) however she wont give any commitment on category. I think she said that the category is dependent on the role and manager so guess I will have to suck it up to management to get EB2. Further, she mentioned that there is a big policy change coming in this September which will 'upgrade' the way they handle GCs.(She would not confirm that this means a flip to EB2 as a policy but just gave an hint). In the end she said 'you need to take a leap of faith' so guess that means they are moving towards EB2? Anyone has insights on this upcoming change?

I am currently with a desi consulting company so I thought switching to Deloitte will be safer/stability enables option for me( no issues with stamping, GC audits etc) but going by comments about delays, GC category, layoffs it might not be worth it :-)

As of right now, I am inclined to turn down the offer.
