Topic: Aug 2016 Perm Audit

PD: Jan 20, 2017
Audit received: April 13, 2017
Audit reply : working on that

My I-140 is approved by ex-employer with PD Feb 14, 2013 but not sure, why i'm seeing new PD ? My firm is US based with less than 15% H-1B. Is recent change impacting ?

Do we know how much is USCIS Response time after we respond ?

Another question, do you think our H-1B extension may have an impact due to PERM Audit received ?

Quoting my attorney words "When you file EAD you do not have the option of requesting the time period you want, they just automatically issue it for one year increments and you would have to renew every year. "

The EAD will likely only be approved in one year increments, regardless of the H4 status ? Thats what my Attorney says. Anyone heard this before ?

I-140 is approved with employer A. Switched job from employer A to employer B. H1-B transfer applied and got approved until April 19, 2018.

H4 is valid until Sep 30, 2017. When we will apply for H4-EAD then will it be approved until I-797 approval date which is April 19, 2018 or will it be granted until H4 validity which is Sep 30, 2017 ?

Any idea ?

Does an I-140 approved applicant need to re-start the entire GC process on changing jobs ?The below doesn't explain for I-140 applicants but for I-485 applicants? Can someone share link which states this provision ?

"Provide clarity on adjustment portability to remove unnecessary restrictions on natural career progression and general job mobility to provide relief to workers facing lengthy adjustment delays. "

Isn't this meant for legals ?

http://www.whitehouse.gov/issues/immigration/st...

Cut red tape for employers.

The proposal also eliminates the backlog for employment-sponsored immigration by eliminating annual country caps and adding additional visas to the system. Outdated legal immigration programs are reformed to meet current and future demands by exempting certain categories from annual visa limitations.

"Half million immigrants a path to citizenship" - Will this change make priority date to be current ? Any thoughts ?

Expand high-tech visas

The plan calls for working with the State Department to expand visas for foreign-born workers with high-tech skills, to support U.S. businesses. This is projected to offer another half-million immigrants a path to citizenship. Groups like the Chamber of Commerce have been calling for more of these visas – but Sen. Sessions has argued that the priority should be getting U.S. citizens back to work.

Topic: H1B Extension Denied- What are my options

My 6 years after recapturing time spent outside is getting over by August 30, 2014. My I140 has been approved and 3 years of H1-B extension has already been filed on May 16th, 2014. Though my I94 expiration date is 30 Sep and in case if i get my H1-B denial after August 30th then do i need to leave USA immediately ? Any grace period ?
