Here is the catch. As much as doctors or for that matter any professionals are "allowed" on H1B. The reason why H1B is used widely by IT is because of absence of government licensing requirements. Any other profession including doctors or even a barber (cosmetology license )needs a license. This is to keep the accountability. When it comes to "IT" , there is no such regulation. That is a golden loop hole for consulting firms or anybody comes on H1B. Which means a , if a doctor or a nurse has to work in USA they cannot just step out of the boat ,fake resume with 10 years experience and get a consulting job. They have to go through government licensing examination and other compliance requirements.
In other words, if government implement same for IT that will end all these fraud consulting business. Companies will only bring people if they really required to be here. But government will not do so since BillGates ,Zukerburg and other big guys want to keep thsi industry unregulated.

I agree with you. I am an Indian and I know exactly how my people think. I am one of those guys who, patiently waiting in GC line for past couple of years even though I get frustrated at times. Yes,I agree that country cap should stay and its there for a reason. One of the reasons is diversity. Most of us in our hearts know the actual reason for the GC backlog is more and more people from India are trying to get here, but we kinda don't want to admit it in public. We keep saying its discrimination. How is it discrimination when all of us have 7% cap. Its not like Indians have 7% and Pakistanis have 14%!!!
So how is it discrimination? We cannot expect US to solve all our problems.

System here is VERY FAIR. It gives GCs to all countries equally and if anything is remaining it goes back to oversubscribed countries as spillover. That way India is the country who is receiving more than 50% of GCs every year.
Following is an example of 2012. Its the story every year. We receive most of the GCs and we still complain..

We as INDIVIDUALS don't see this effecting us , because our numbers here is so much so that it is like putting a pinch of salt in the ocean. Sorry guys US system is not a POPULATION SHARING program with India..

One more thing I have seen in this forum is , whenever Indians talk about backlog they will always start with countries like INDIA AND CHINA... Guys I understand we want Chinese to support our propaganda. But they are no more backlogged like us. So be careful ...

UNFAIR to whom? Indians? Can you imagine they open the flood gate and admitting millions of us every year.. If that happens can system be FAIR to Citizens here? Just because it does not work for us , it is UNFAIR? Look even-though we don't have balls to admit in public, we all know the reason for our backlog. Are we in a self denial mode? System is FAIR to the MAJORITY including Chinese. Only Indians are affected currently and we are crying system is unfair.. is it a joke? I think if we are stuck in queue we are UNFAIR to ourselves, since no one has forced us to wait in the queue.

If administration is extending their courtesy that does not mean that it is because of system is UNFAIR. They are just doing it on a humanitarian basis and lot of other corporate and political agenda. If we think otherwise we are living in a fools paradise!

Wow really? Some country is grating you CITIZENSHIP and you think its JUST A TOOL to make our life smoother? I think if US declares war with India tomorrow , we will stand with US.. I guess.. That is the meaning of Citizenship.. its not JUST A TOOL to boost our career and bank account!!

I am also like you. I have approved I-140 and waiting in the queue. I sometimes get frustrated. This does not mean that we should spread lie and claim victimized status by saying that the system is DISCRIMINATING. It would have been a discrimination if India has 7% ,China has 10% , France has 20% etc.. and so on.. But here everyone has EQUAL 7% quota. So there is no discrimination. The problem we have is due to the overwhelming number of application from our country. Thanks to our system back home that UNIVERSITIES make IT GRADUATES like rat breeding and they don't create equal number of jobs in par with number of graduates the universities make. Can't help unless we start creating jobs.

Irrespective is who he is and his intentions, he made some valid points. Citizenship/GC is a privilege not a right. Just because EVERYONE WHO WANTS to migrate are not getting GC does not mean that the system is broken. Infact system is efficient to prevent oversubscribed countries from using GC numbers. If you look at the Greencard issues in 2012 and 2013 ,INDIA AS A COUNTRY has received more than 40% of green cards. Individuals on this forum including me do not see the benefit ON AN INDIVIDUAL BASIS because of large number of applications from our country. There is no point in bashing the system or crying the system is unfair to us. We have to fix the problem in our country. India should create more jobs so that there should not be a need to migrate. Indian companies should switch from SERVICE BASED model to PRODUCT BASED model so that there can be self dependency. Currently India's Billion dollar Service Industry so called "IT INDUSTRY" in India is receiving more than 60% of its revenue from North America. So technically they have designed their business model based on some other country's immigration system (H1 and L1 visas), on which they don't have any control over. And the moment US government introduces any kind of immigration bill , it is a BIG news in India, because of this reason.
Look at China. They used to have back log like India 2 years back. Look at the situation now. They developed their country and created jobs and there are is not much immigration and they are almost in par with ROW ,in terms of visa bulletin.

This point won't sell since everyone knows that there are plenty of Americans available to work. Most corporation keep advertising that "We cannot find resource"..But the missing keyword is "We cannot find resource AT THE SALARY WHAT WE ARE ADVERTISING". They intentionally hide it and it is well documented.Congress is aware of it.

--we can say that person from NorthKorea, Iran, and pakistan can get GC in two years where person from India has to wait 5-15 years.
Again , this is because there are less people coming from these countries. Problems is all of us want to migrate to USA. American immigration law makers were smart that they have foreseen they scenario of over subscription and added the per-country numeric limit clause.Very smart move. There is pretty much nothing we can say from a logical standpoint to defend ourselves, than humanitarian consideration.

Well, you cannot blame them. After all human is selfish and there is nothing wrong to be selfish. Everybody including you and me and old generation Indians have migrated here for "Betterment" meaning, better life style, less competition,more wages etc.. When all our country people migrate here it beats their whole purpose of migrating here. In other words, if they wanted to see all Indians around them , they would have stayed back in India. So its their personal interest to think for the betterment for their family. Can't blame.. Perhaps you will also think on these lines ,once you become PR/Citizen.

Mr. O executive order is good for whoever is stuck in the backlog. Since backlog will be cleared employers specially desi consulting employers will lose hold on their employees. But once the rule is passed Desi employers for that matter no employers will initiate GC process as quickly as before, since they know that anybody can reach upto I-140 within 1 year and be free based on EAD. There is no incentive for the employers to file GC anymore , so they may add condition like "if you work for us for 5 years , we will initiate your GC process.. some thing like this..
Before "We will initiate GC Process" was like an advertisement golden biscuit desi employers used to put infront of employees , so that they can be benefited from backlog.. now from 2015 it may not be the case..

Yes Desi companies are not happy with this. If EAD after I140 rule is implemented GC filings from Indian companies (both Indian and US based) will be significantly reduced.
So far GC processing was a "golden biscuit" thrown in front of employees (specially IT consultants) to make them stick to their company. Desi companies were doing it because there is a significant backlog for countries like India and they know employees will stick with them. Now since they know that they can change job on approved I140 + EAD , they will not file GC. Because PERM + I140 (premium processing) will take 1yr to 1.5 yr max. So they don't want you to be free after 1 year. So there is no incentive for them to do so. So they will come up with some agreement like "you have to be with us for 5 years before we initiate your GC process" some thing like that... I guess...

Yes correct. So you think immigration law was made only to "serve businesses"? Nope, while they serve business with EB GCs, they have to take care of other stuff like American society, culture, diversity and more and very important.. American citizens well fare ,like they are employed etc..

First of all I am not sure if you have read the posts and news I posted, since your reply was instantaneous.
It is not a controversial topic. I would say law makers were so good that they have foreseen these kind of scenarios and closed the loop hole when they made the law.

Your this line assumes that some SKILL (I think IT Skill) is the ONLY criteria to get GC. No it is just one of them. You should be a contribution to the diversity of America is one of the criteria , with other criteria like a clear background check etc..
So having some "skill" alone will make you deserve to be in America.

I was going through this forum and the discussion of country cap caught my attention. In my view country cap is in place to serve the diversity . There is no discrimination as you were saying. If it was 7% for India and 10% for some other country , that is discrimination. But here everybody is getting equal share. So the GC is distributed equally between all countries FIRST and if there is LEFTOVER goes back and used by oversubscribed countries like India. If you look the statistical data from 2012 and 2013 INDIA got more GCs than any other country after spill over. So as a country India is the one getting most GCs , but as individuals we don't see the benefit immediately since we have a hell lot of people in the queue.
