Yes, I agree with you. Guys, Please be patient for few more weeks/ month and control the emails and tweets now because yesterday during the teleconference, the first thing he spoke about our H4 EAD rule and said they are trying to publish it asap. That means they are aware that many people on H4 visa are waiting and that it is important. He said they are working on it and that the rule will come out soon. What else do you want them to do? Please at least wait another few more weeks/ month and see what happens. I have a feeling they will publish it soon. Now, If we continue emailing and tweeting too much, it might turn them off and that could do more harm than good now or in the future for the legal immigration Exec actions etc.

I read online that they will start accepting EAD application from H4 from Jan 2015. Is this true? If so, how much time will it take to process the application and give us EAD card? Any idea about this? Sorry if my question seems a repeated one but i tried to get the answer from previous posts here but i couldnt find the specific answer. I may have missed it. I would appreciate if someone could tell me when we will get EAD for H4s in hand.

If you guys remember last year when Immigration Reform measures were being discussed amongst the US District representatives on the floor, Representative Judy Chu, a Democrat representing a Californian district, was the only representative who brought up the issue of the difficulties faced by people on H4 visa and the need to give H4 EAD. Mr. Vivek Wadhwa had also supported H4 EAD during that meeting. Do you guys remember that meeting? I think there is also a video clip online somewhere when she spoke for H4 EAD (may be its there on FB H4 group page somewhere)

I think I agree with you. I think we should give them more time and then follow up with them if we dont hear anything positive in next few months. May be 60 days is too less to review 13000 comments.

08/17/2014: One Positive Sign for H-4 Employment Authorization Rule-Making Process

As we explained it for a number of times, OMB rule making takes from 30 days to 90 days for each step of the way, including proposed rule step and interim final rule or final rule step after the proposed rule is cleared. We have no clear information as to how long it will take for the USCIS to complete review of 12,835 comments (albeit some comments could be one or two sentences in length) and how long it will take to draft a final rule which will be binding. For each step, OMB reviews at three different priorities: Rules which are designated as "eonomically" significant are handled at top priority, less than 30 days to complete the review. Some of the economically significant rules are completed in less a few days or even from one to three days. The next level is "Other Significant" priority designation. Review of these rules are usually completed in less than 60 days. The lowest priority level is "no significant" designation. Review of such rules can take 90 days in most cases. Readers must have noticed that this rule-making is designated as "Other Significant" in priority of review for the OMB. Therefore, once the draft of final rule is submitted to the OMB by the USCIS, it is likely to take from 30 days to 60 days to complete the OMB review and the USCIS will thus be authorized to publish it in the federal register as a legally binding rule.

To Kamakazee18 and all other active members here,

Just a suggestion, let me know what you guys think: I agree that the rule is lying with USCIS as of now and not with OMB BUT given the fact that H4 EAD rule has been kept in limbo for past 4 years AND that it received nearly 13000 comments (with almost 80% of them suggesting to finalize this rule), could meeting or calling/emailing OMB and REQUESTING OMB to communicate with USCIS for a quick update since its almost been 60 days post-comments? They might have some route/reason of inter-departmental communication system. Since you guys had met with OMB staff in the past, there may be the some people at OMB who are aware of the difficulties faced by many H4 visa families and hence they could ask for a quick status update of the H4 EAD rule from USCIS. And this inter-departmental communication might expedite the process. Nothing is guaranteed though!

Also Kamakazee, I read on 1 of your previous post that USCIS and OMB may go back and forth a couple of times for rule clarifications etc. I am wondering if they are doing that part right now without making it visible to the public.

I saw proposed rules by USCIS since 2006, public comments for these proposed rules have been in the range of 60-150 comments per rule, a couple of them have got like 250-280 comments and 1 of them has got like 3500 comments. 12900 comments for H4 EAD is very very high compared to any of the past USCIS-proposed rules. Having like 12900 comments for H4 EAD rule can be a very time-consuming unless they take some special measures to expedite the process of reviewing public comments for this specific H4 EAD rule!!!

There was a month long public comment period for all the existing rule of DHS which ended on 28th March. I am hoping this is the only public comment phase for the H4 EAD rule. Why will they need to have another public comment phase when they have already got so many comments?

I am hoping they print the rule now directly (either interim or final).... What do you think are the chances of this happening?

One more thing,

I have seen a couple of immigration lawyers supporting H4 EAD rule like in FB, one from the documentary film made on H4 (I think its called 'Lives suspended').

May be if we can have a letter of support for the H4 EAD rule from these immigration attorneys, it will help. Since, they are experienced in dealing with the misery of many H4s, they can pitch in some useful info from their end. What say?

No, have not got any reply yet. There are like 4000+ people in FB H4 group. If you post this info, i think there will be more people willing to attend the meeting, in case if you dont get 20 people. There may also be people from other countries besides India in the FB H4 group.

To kirand, some more points which could be added are :

1) There are several areas in USA which have shortage of doctors, nurses, physical therapist and other healthcare staff and patients have to wait very long period to get even basic healthcare, especially in rural areas of USA (I know this because I am a foreign medical doctor myself on H4 visa). Giving EAD could help address this matter as there are many doctors, nurses and other healthcare trained staff who are trained in foreign countries on H4 visa living in rural areas of USA who could fill in the staff shortage. (I can provide a website-link to all doctor-shortage areas if needed for evidence), Kirand, let me know if you need this link.

2) Highly educated PhD, post docs and Masters degree researchers who can help in the progress of US conducted not-for-profit research activities such as in universities and other research organizations.

I am mentioning about researchers here because if you guys have noticed along with the H4 EAD rule, the WH recently have also mentioned about a new rule proposal which will ease the way and help researchers come to USA from across the globe to come here and foster US research. There are many H4s who are well trained researchers (PhDs, post docs) who can easily contribute to their research if H4s are given EAD.

I have been on H4 for many years and am quiet experienced. It got delayed for more than 3 years because it got mixed up with CIR Bill. I have been following the H4 EAD rule since day1 and the AC21 was the sole basis for making the H4 EAD rule. It has been mentioned on several official websites. Thanks kirand for making the powerpoint presentations. They are very well written. Highlight the 'enterpeneurship/ start-up companies and job creation for US citizens by H4s' point as much as you can because its one very IMPORTANT reason why the US goverment wants to provide EAD to H4s.

Also at this point, its best to be assertive with the rule text as it is and get it passed rather than making our own changes to the existing rule-proposal. As they say, "something is always better than nothing".
