Well - If am not following visa recapture stream, so I may be off, but if it requires change in law, then you know it is not going to happen until after elections. I wish I am wrong. Hypothetically even if EB3 is current, then you would need to join old employer during I485 stage or get letter from them that job offer is valid. If I were you, I will just restart process in EB2 PERM right away,( could take 6 months without audit) and then once PERM is approved file concurrent I140/I485. So if all goes well and dates stay current for 2008 you might get GC with in 1.5 year ( 6 months for PERM, 15 day I140 Premium, 6 Month 485)

I would like to say thanks to each member of this community, who contributed and helped me understand GC process.

Sharing some part of my GC story, hope it will help someone. this is my way to give back to this community

2003 - Came to USA via desi consulting co, Followed their directions on GC, and started perm process and started collecting documents on birth certificate, affidavit etc after 6 month of joining . I had strong dislike for local management and kind of assignment at work so always looking to jump the ship

2006 - Abandoned GC processes for 30k jump from current salary for FTE position with large bank and bought first house

Tips#1 my professional goal in life at that time was to have job stability as FTE, compared to desi consulting. Having stability allows you to take many calculated risk, such as buying big ticket items house. However you should not join big co if getting GC faster is your goal as you will be stuck with formal GC sponsorship approval process ( Typical GC expense is 25K for Big co, so it goes thru many layers of approvals ) and you will deal with a typical big law firm hired by your employer. Big law firms are less responsive compared to small firm. So make a decision for yourself what is your priority.

2007 - Started new GC perm process

Tip#2 - Talk to as many people as you can ,who are in GC process or who have received GC, take their feedback and ideas. If you have 5 years experience and 4 year bachelors degree , go for EB2. There is no such thing as EB3 is safer or you will get RFE with EB2, Even if you get RFE and if you have clean background in terms of education and experience, you will get over RFE easily. as compared to standing deadbeat in Eb3 Q. I had 8 years’ experience and I foolishly settled for EB3 PERM and wasted my time in EB3 queue.

2008 – Eb3 PERM approved

2009 - I 140 approved so now I pocketed priority date of 2008

Tip#3 - You must know when to abandon GC process if you donot like your job and how to lock the priority date

2010 - H1B extended based on approved I140.

2011 - Realized my desire to have FTE job and settling for EB3 was a disaster. But only plus point I noticed that I never had any issues at multiple H1 stamping at Delhi consulate, as interview was breeze and same at POE . My believe is this is due to established big financial firm I was working for.

Tip#3, You can PORT priority dates from EB3 to EB2 with same company, even if you do not get promotion. Here is what I did, I opted for change of location when next internal job posting came up, since by this time i had goodwill and so I landed up in job without any interview with new team. Since it was change of location, it was seen as genuine business necessity to re-start GC process, so I got all approvals from MD to kick of new GC process in EB2. ( Firm again agreed to spend 25 K ), so if you are working big co, do not assume 25 k is big expense for them. Many co pay 25 k jus to relocate employee and new hires, you just need to make a business case and sell yourselves.

2012 Feb - Kicked of new Eb2 GC process

Tip#4 Stay on top of GC PERM process, Watch as Ad,’s are placed in news papers and internal website. In my case I noticed HR team goofed up, they had my job location as older work location, rather than new work location, I notified them of error and they re-filed paper ad. My point is if you do not pay attention, small mistake can reset you GC process by many months.

2013 Oct- Bought second house @ new location while still on h1b

Tip#5 – If you are reasonably sure about your skills and your job at work, then you can take risk of buying houses on while on H1B. I always held this view - If I loose job and have to sell house in distress , I will loose some 20-25K in the process, and if you really look 30 year span of your professional life, that $$ loss is much smaller, So you can take calculated risks in life and move on if you are on h1B.

2013 – Nov - Received random audit, and I need to give affidavit, I did not pay my employer for GC – this was cruel joke, but guess what , I cannot comment on random alogrithms.

2014 – Sep - PERM cleared from audit

2014 – Oct – filed 1140 /1485 concurrently

Tip#6 – Rely on lawyers advise for job experience. One of my job experience letter was in format that was not acceptable to lawyers, as it did not list job details, skills used etc etc . They told me to do all I can to get new experience letters with skills listed, So i asked HR of Indian co to issue letter on why they cannot get me detailed skills letter. I contacted my old manager who retired from his job to issue new letter, and he became chicken citing some non-sense reason. But I did not give up , I read trackitt postings on I140 experience letter and then I contacted my old managers boss, who is now CEO and runs his own company. I explained situation on GC and what it means to me and my family. And why I need him to issue supplemental experience letter. He readily agreed. My point is if your experience letter is not in good shape, so do not give up on getting supplemental experience letters . Do not hesitate to contact CEO/Bosses boss, you will find some kindhearted person.

2015 - Jan EAD received

2015 - 07 May - USCIS case status website shows me and dependents permanent residency has been adjusted

Finally I do not blame USCIS for delay in my GC or hold bad feeling to anyone from ROW or Eb1C folks if they received GC faster than me. I blame myself; I should have done my homework when I started my journey to US of A in 2003. Had I knew all things before hand, I would have applied GC in in Eb2.

Any ways lesson learned – Have a Plan, and Do Research, Talk to as many people as you can if you do not have good idea on GC process.

Topic: anyone applying 485, 140, 131 in NOVEMBER with PD Apr2008?

I am in similar situation.....problem is I am still waiting for my PERM approval P/D 03/27 EB2 filed this I can use my EB3 01/2008 PD. Its very bad timing, coz even if I get the approval this week, I am not sure I can convince my big company hired lawyers to work a few hours exclusively for me with the holidays next week. Do you have any suggestions.

we got in response to our email query to local congressmen. I found it hard to believe, they can have exact date, but my take from this is - may be something is going to happen sooner.

For those who have optimistic view of life -Here is news i want to share - Based on request we posted to member of congress from TX, we got a reply, this rule will take final decision on 03/04. I am not sure how there office arrived at specific date. I donot want to believe, but there is no harm in keeping hope alive. At any rate- anyone who wants to be pro-active, should write a simple email to their local congressional office, on this proposed rule and they can get info on your behalf.
