Topic: Job Title in Labour App and Experience Letter of Previous Empl

I got an RFE as the title mentioned in my Labor is NOT matching with the title in my Experience letter. Only this week we responded to the RFE stating that the roles are exactly the same though the titles are different. Fingers crossed and waiting for the result.

Employment Authorization for Certain H-4 Spouses

This rule would extend the availability of employment authorization to H-4 dependent spouses of principal H-1B nonimmigrants who have begun the process of seeking lawful permanent resident status through employment.
Notice of Proposed Rulemaking (NPRM) published May 12, 2014.

• Would increase incentives of H-1B nonimmigrant workers to continue to contribute to the U.S. economy as they complete the process to adjust status to that of a lawful permanent resident by providing parallel employment incentives to the H-4 spouse.

The NPRM had a 60-day public comment period, which closed July 11, 2014.USCIS is reviewing comments and will publish a final rule as soon as possible.

Even if any body were able to recapture this COS status time period, can you please show what supporting information did you send for H1B extension.

Most of the forums or responses I saw say that the H4 status is NOT counted towards H1B. However, I could NOT find any proof / instance where COS from L1/H1 to H4 is also NOT counted towards H1. My COS from L1/H1 to H4 took almost 4 months and this period is currently NOT counted in my H1. I am short of 2 months for the 365 day rule and my attorney is saying that this 4 month period (COS period) cannot be used for recapturing.

FYI.... at the time of applying for H4 COS, I only had around 2 weeks of valid L1B. I resigned my L1 sponsoring company at the end of the L1 validity date and am no more on L1. Technically, for 3 months 2 weeks, I don't have any approved status (neither L1 nor H4).

Does any have any reliable sources which talk about whether the COS status can also be counted towards recapture period.

I also received an RFE for I140 PP questioning that the titles are NOT matching my the detailed experience letter vs the PERM position. My detailed experience letters does have the job duties same as the job duties mentioned in the PERM. I approched my previous employer whether they can provide a breakups in the job duties with dates and they denied stating it to me company policy violation. I have an Email proof which clearly tells that they cannot give the letter in the format that is requested.

I / My attorney is planning to send the original experience letter, new experience letter (which is the same the original letter except that the date this letter was created is now the most recent one), EMail from company HR (with their contact names and Emails) stating their denial in the format that I am asking for to support the RFE and a cover letter stating that though the titles do not match, the job duties still are very similar to what the PERM is saying.

Can you suggest if anything esle to be included to support the RFE.

Getting an approval seems like a mere luck. I have detailed letters from my previous employers and the job roles for my PERM JD is NOT that different from the roles mentioned in the Experience letter but the titles didn't match. Now USCIS is questioning why titles are NOT matching?

What the heck? How should I prove that the titles are just names given by each company to define the roles that they do for that company. Most ridiculous and idiotic RFE as per my attorney. My attorney is also saying that applications files in RFE can fall prey for such idiotic RFEs just so they can get some more time. I hope it is what it.

It was under Premium processing on July 3rd and received the RFE on July 14th. It was filed at Nebraska Service Center. Currently I am working on providing the required support for my RFE (well not sure what additional information to provide as we have submitted everything required during our initial filing).

Just as many of you, my journey towards GC is extremely stress full - at times moments of relief but mostly nail biting and stressful moments with each stage of paper work. An RFE on I140 was something I didn't hear until I started researching now. :( And looking at the current trend, this is NOT going to end any time in the near future. Phew....

So here is my situation. I received an RFE for my I140 (PP) questioning that my job titles are different in PERM vs what was mentioned in the detailed experience letters that I have already provided. The detailed experience letters does contain the title, dates of employer, bulleted points of various tasks, and technical skillset (tools / software etc).

My employer (thanks to them that atleast they are being very supportive so far) is planning to draft a cover letter stating that the though the titles are NOT matching, the type of the work that I have doing with my prior employers is very much on par with the PERM JD and I have also have the technical expertise of using the tools required to do the job by mapping the PERM JD with the already provided detailed experience letter? My company is an America consulting firm and they obviously do NOT have too many GC filings through them. So they are also pretty new to these type of RFEs or GC process.

From the experts in this form, can you please suggest the what relevant information/ docs should I be providing to justify my case.

I just got the info on my RFE. Basically they are questioning that the title of my PERM is different than the titles mentioned in my previous employers experience letter. They wanted to justify that I have relevant experience related to what my PERM job is requiring. :(

My current employer is willing to draft a letter to support that I have relevant experience. USCIS is already having my experience letters from my previous employers. Now what more should I prove that I have relevant experience. One of the companies that I work for is a top Indian firm and it is heck of a pain to get any sort of letter from them.....My fear is that they RFE explicitly states that

"Evidence of experience must be in the form of letter(s) from former employers giving the name, address and title of the employer and a description of the experience of the alien, including the specific dates of the employment and specific duties."

From the information that jer3227 has posted, it looks the DOL is processing many of the cases from Nov 27th till Dec 10th though they touched few cases beyond this range. Unless DOL is processing PDS(concentrated), I think one can still wait hoping that it DOES not go into audit. Good Luck to all those waiting.

Thanks for the link. Was waiting for this information as my PD is in Dec 2014, I am also following the stats closely for the last couple of months.

Looks like based on the info, it seems like we have around 36874 apps to be processed till 3/31/2014 of which 17129 belong to Q114, and 15474 belong to Q2. That leaves with around 3777 to be processed from Q413 or prior.

In the last 2 weeks DOL has processed 2890 applications that are all prior to Q41 (assuming roughly 30%of this numbers are the audits that are approved) ---> it might be roughly around 1700+ applications to be processed before they move into Oct numbers. With an avg of 1500 per week, DOL will not get into Oct PDS until 4th week of April...... :(

And atleast another 2.5 months by the time they complete Q114 PDs...... So I still have to cross of my fingers until End June to hear abt my PD which is in Dec.
