Thank you for your reply.. Let met ask with some numbers

He moved to India on Jan 1 2018, Came back on Jan 1 2019. Number of days out side the country based on Indian Pay roll = 365. But say he had 2 US Visits to meet family = 20 days, will he be eligible for EB1-C? I think he may need to stay in India till Jan 20th cut that 365 days. Is that right?

Hi Folks,

A friend of mine who work for a fortune 50 is asked to take a up a role as Manager of their newly found India captive Innovation lab. He will be based out of India for first 1 year with intermittent US business travel, he will have about 40 data scientist reporting to him as they grow the organization. He plans to come back after 1 year on his current H1B apply GC via EB-1. He does not work for WITCH, but for a very highly successful and respected organization and plays 100% by book. They made refile his GC 3 times so far as he got promoted or moved around the country. so all EB1-C haters (including me) please don't lash out :). Guy makes about 160k+ Benefits and has 12 yrs behind him, so a truly genuine case.

Questions
------------

1) Will his intermittent US business travel would count against 1 year requirement. Meaning he is Indian employee for 365 days gets his pay check there, but comes to US once every 2 months either as a visitor or on business, days he been in US will it get subtracted from 365 days and make him ineligible for EB1-C
2) he is on H1-B, does that make him ineligible for EB1-C?

Hi Folks,

I have been reading dreadful stories about H1-B extension and L1 A/B extensions. Very recently a highly successful instrumentation engineer working with one MNC I know personally have had his L1 denied. I also know a few H1B folks getting RFE and one outright denial because he being a software engineer and from non-Computer science education.

I do not have a computer science degree, but 4 year engineering, working for a fortune 50, gets about 140k + 20 % bonus + Benefits, FTE with 1-140 approved. My H1B is about to go for renewal. my SOC code 15-1132 level 4 wage.

I depend on this forum for information and experiences, what are your thoughts?

I would think that will be added, also there must be something for EB categories. In any case, this is a good method for the US as a country, but might not be so good for folks not in sought after jobs...

EAD being valid up until it's current expiry date should give sufficient time to find alternatives at least for some people. To be honest, being EAD available for L1(A/B)/J folks, I would expect to have this for H1 folks also, but if DHS decide otherwise, giving time to find alternatives is the least they could do. For sure, immigration in any form is going to be difficult in days to come, and I sincerely hope, this administration move forward with Merit based system and remove this grueling backlogs

What I dont understand is per April 485 Inventory, there are about 425 cases for 2007, if so 2800 EB2 split over by 4 quarters ,isn't enough to take the Priority date to 2008 January? or am I reading all this numbers wrong??

Agreed, you can continue to use it for travel, the trick is if you send your kid to school/ college in India if someone had to go back to India due to constraints ot visa while want to retain their kids US citizenship, the OCI will be a better choice I think

Please do some fact checks, I don't mean to offend anyone, but this is what I learned.

New Visa / PIO Announcements from Prime Minister, Narendra Modi
New Tourist Visa norms for US nationals:

With effect from 15th April 2015, the single category of Tourist Visa available to be applied by a US national will be a 10 year, multiple entries Tourist Visa, with a fee of US$ 100 (exclusive of ICWF & CKGS service charges). The actual duration of the visa will be at the discretion of the Embassy / Consulate

Important Notice for PIO Scheme:

PIO Card scheme has been withdrawn vide Gazette Notification No.25024/9/2014F.I dated 09 January 2015. Applicants may apply for an OCI card ONLY

31st March, 2016 will be the last day to apply for OCI card in lieu of PIO card.


•Apply for OCI in Lieu of PIO card - All PIO card holders are strongly encouraged to apply for OCI in Lieu of PIO card.
•Name Change / Nationality Change on PIO card - Name Change / Nationality Changes are not permitted on PIO card. PIO card holder will have to apply for OCI in Lieu of PIO card.
•Apply for OCI in Lieu of PIO card (Loss PIO card) - PIO card holder will have to apply for OCI in Lieu of PIO card.
•All the above applications must be submitted at the CKGS Application Center concerned within the Consular jurisdiction of his/her place of residence.
•As soon as additional information is received from the Embassy, it will be updated on our website.
•At this time, CKGS does not have any information on rules post 31st March, 2016.

The above rules shall apply until further notification is received from the Embassy.

Topic: EAD approval weird.

I wish it was that simple. I was told my lawyer that not to travel even though the EAD is approved. The premise of this is, EAD is based on H4 and it is pending. If you travel with H4 pending, h4 gets invalidated and subsequently USCIS can revoke EAD as well. I am not willing to take that chance.

As long as your spouse is not working with a H4-EAD while pending H4 EOS/COS, you are good to travel. Your spouse can visit a US consulate and provide your I-797 copy and necessary documentations and get H4 stamped. Your current H4 EOS will deemed abandoned.

How were you able to raise an SR? because USCIS H4 processing in VSC is backed up to December 29th 2014. CSC is backed to 4-5 months. SR can only be created of the processing is outside published processing time lines

H4 is still pending. But some good news..

We have successfully verified my Wife's eligibility to work by submitting a new I-9, and she is now 100% on EAD.

But still one outstanding question!! So far I know it is all good as long as she remain in the U.S. What happens if she leave U.S prior to COS approval? That will have H4 COS petition abandoned, will it subsequently invalidate EAD? I don’t have a concrete answer to it, tried to talk to USCIS and those customer care representatives also does not have an answer. I did not see any rules around it. If some know some (PROVEN) details, let us know, if not we will stay put until it is approved.
