We got EAD card yesterday (UPS Priority mail). Here are timeline of application status changes for people who are waiting eagerly.


Application sent on - May 26th
Application received by USCIS on (via FedEx - Dallas office) - May 27th
First status change - Card/ Document Production - June 19th
Second status change - Application approved - June 19th
Third status change - We mailed your new card to the address you gave us. - June 23rd
Final status change - Card Was Delivered - June 25th.




Thanks for a detailed info on the process. I wonder what is the "Date of Approval" on your card? June 19th? Then technically that is the date when you can start working.

My application was received on May 26th.
Status shows: Application Received.
I am very anxious and check my status every hour. Does anyone know what time do they work until? 5 pm PST or 6 pm PST? That way I can check the status only once a day!!
I am sure that I am not alone!!

Hello, I wonder I was reading you all that card under process, Card Approved etc... My file accepted 27 May. Got receipt # etc. But do you all guys also received Bio-metric too. I have to appear on 23 june to local immigration office. Can you please advise.



Biometric started a few years ago. My guess is that if you did not go to India in last few years then you never had to go thru bio-metrics before. Hence, this is a chance they have to get your bio-metrics (fingerprints).

Staying apart from family, kills everyone.. even for me, cant live alone for many years...

Now let me tell you first BIG thing that I would do after getting the EAD.

I am a scientist with over 12 years of experience in Pharmaceuticals industry in the US. My H1 got screwed-up because my GC was not applied on time. So I had to go on H4. I used to lead the analytical department of my company. My company is suffering and waiting even more eagerly then me to get this H4 EAD rule implemented. As soon as I get my H4 EAD I will go back to my company and try to make-up for the lost Time and Projects.

We should not ask about economic hardship instead just ask for the final format it will be published and that will clear all our doubts. Asking something specific might add to the rule since we all know it is not published. This is my thought . May be Kamakazee can through more light on this.



In my opinion it is stupid to ask questions like "Economic Hardship" because:
1. You don't want the rule to go back into re-analysis.
2. If it does not say anything about Economic Hardship then it is open for everyone including those who have any Economic Hardship.
3. We got our H4 visa based on our statement in front of Visa Counselor that H1 holder makes enough money to comfortably take care of the H4 and will not become any burden on US Economy when in the US.

Nothing will change the situation , local representative will give letter for any reason , that doesn't have any value .
we have to think about other way of survival not through h4 EAD.


May be you are right but:
I have seen big things happening when ELECTED representatives call Government Agencies. Government Agencies are funded thru congress and that makes congressmen so influential. I will definitely talk to local / state representative. I pay taxes just like any other US citizen which goes into paying congressman's salary!!

I think so too. Obama, in order to gain politically, intervened in this rule-making and tried to delay it until immigration reform was passed and implemented. Trying to club us together with illegals.

Dear BeLoyal
This is land of immigrants. This country provides opportunities to immigrants and in return immigrants help this country prosper.
Any political issue of this country whether "Gun Violence", "Immigration", or "Environment Protection" is my issue.
I came to this country legally 14 years ago on F1- visa after completing my graduation in India.
I have not committed any crime and neither do I intend to.
I have been paying in excess of $100K in taxes every year to this country for past few years that helps in paying Obama's salary.
I have led the R&D department of a company that helped retain jobs for US workers, otherwise the project would have been outsourced to India.
I have anchor kids so sooner or later I will become US citizen.
I donate money to NGOs in India to fix problems that India is facing. (lacs of rupees just as a pay-back to the nation where I learnt the VALUES of life).
I am not trying to brag, just reminding you.... What have you done so far for India or US????
Whether we live in India or US we need to follow politics very closely because all our power is vested in our politicians.
They will try to steer us in their way and we need to steer them in our way.
For them placing 'illegal immigrants' in front of 'legal immigrants' is a way to win votes. We need to remind them that we are watching and assessing. Sooner or later we will be voting as well!!!

I have lost all hope in Obama.
In the name of 'fixing broken immigration system' he deliberately delayed publishing of this rule for years. His policy is 'the more people suffer the more they will appreciate his rule making'. But he has crossed the limit now.
Republicans are no good either but I am sure they would have not taken "forever" to publish this "common-sense" rule.
I liked Obama but now I am a 'convert'.

Here is a list of documents that we need to apply for EAD as per proposed rule:

1. Evidence that the principal H-1B nonimmigrant is the beneficiary of an approved Form I-140; or
2. Evidence that the principal H-1B nonimmigrant's Labor Certification Application or I-140 petition has been pending for more than 365 days, or evidence that the H-1B principal is the beneficiary of an unexpired Labor Certification Application that was filed more than 365 days ago, along with copies of documentation showing that the principal H-1B nonimmigrant has been in H-1B nonimmigrant status beyond 6 years (e.g., passport, prior Forms I-94, current and prior Forms I-797, copies of pay stubs); and
3. Copy of the H-4 dependent spouse's current approval notice of stay or Form I-94 evidencing admission as an H-4 nonimmigrant pursuant to the H-1B nonimmigrant's approved extension of stay based on sections 106(a) and (b) of AC21.
4. Secondary evidence may be considered in lieu of the evidence listed above, such as, but not limited to: an attestation by the H-1B nonimmigrant regarding his or her AC21 sections 106(a) and (b)-based extension of stay or I-140 petition approval, petition receipt numbers, or copies of any relevant petitions or receipt notices.

Even I think that this rule will publish by end of next week and be effective by January.
By Mid-February they are expecting to publish rules for DACA and by Mid-May they are expecting to publish rules for illegal parents of US citizens.
There is no reason not to publish this rule before DACA and illegals. This rule-making started way before DACA and illegal-EADs.
If they publish this rule after DACA and illegal-EADs then EAD approval will take very long time.
The only reason that I can think why this rule was not published before today is "USCIS was preparing for big work-load by hiring more people".

Hi Guys,
Need your thoughts. All posts are referring to employer sponsoring for 140. My spouse is a physician, with an approved 140-NIW, which is self sponsored. There was no Perm involved. She is in her 8th year right now, based on her approved 140-NIW. Does 140-NIW qualify for H4-EAD ? Any thoughts ?


I am in same shoes as you are. Do you have a reason why H4-EAD does not apply to us? I don't.

correct your fact. The Plan is to include all TECH workers.


Some people interpret "TECH" in the EO as IT professionals only. I think it is wrong. TECH means technical and Scientists, Engineers, Doctors are all technical.

Long time watcher here and this is my first post.

My employer (large tech company in the bay area) had short one-on-one "meet and greet" sessions with our immigration attorneys and I asked about EO and H4 EAD during that time. The attorney is from Arlington, Virginia and he said that he's hearing through the grapevine that H4 EAD is dead because it provides work authorization to too many people.
Then again, he also said that he didn't think any EO would pass (either for legal or illegal) because there is just too much opposition. Even if I buy into the premise that H4 EAD is dead (and I don't), it's hard to believe that Pres.Obama will get away with not passing anything for the illegals. Therefore, I am taking his entire input with more than just a pinch of salt. It was certainly disappointing to hear him say that H4 EAD is dead though.



Remember, Attorneys have political affiliations as well. If this attorney has a Republican affiliation he will try to fool everyone and convince that "Obama is doing nothing and will do nothing, so you are better off voting republican in the upcoming election"

EAD for H4 is a done deal. It seems like something bigger than EAD (maybe GC) is on the plate for us soon.
Even Republicans have pledged to double the number of H1s if they win this election.

people from countries with loooong backlogs should know the consequences of bringing their families on h4--that with the current immigration system, the dependents won't be eligible for work until the primary applicants get their GCs, or at least be on adjustment status. then you claim your right to get EADs for those on h4? if the dependents were really qualified, then they could have applied with companies on their own when they got here (via h1 or whatever, but not just dependent EADs), or came in on work visas themselves. if the primary applicants themselves had to really prove their qualifications to get here and get work visas/GCs, what gives dependents the right that they'e also qualified to get EADs? just the fact that they're dependents?

i can understand with applicants that are already on adjustment status--at least a bit--but this h4 petition can also apply to applicants who are primarily here on h1 yet.



Until 2003 there were no backlogs for any country and in 2007 everyone in line (along with their spouses) were issued EADs. In light of all these events, how can one prepare for "backlog-consequences" and for how long?
From your comments it is evident that you are here just to spread negativity and not to understand the cause. May God Bless you with a Positive Mind.
