For the record, the decision by the federal judge has no direct impact on the H-4 EAD rules. I expect that the final rules will be published in the Federal Register within the next couple of months. (I can't guarantee that, obviously; but, I'm definitely keeping my fingers crossed!)

Hi Joel,

Isn't that the judge stalled entire executive action. There are 5 sections in executive action. First two sections are for DACA and DAPA. Section 3 is where H4 EAD, L1 changes etc came into the picture. I was under the impression that he stalled the entire executive action not limiting to DACA/DAPA. If not so, can you please specifically state the source where he has blocked only section 1,2 and section 3 is safely excluded. I believe we all are assuming section 3 is excluded since media projects only section 1,2. Different minds have different inferences. Only USCIS can confirm we are safe.

Actually it should not effect, if we see the whole news one of judge point was about DACA not being published in federal register for comments. Ours gone through all that process. Dems should not take hostage of h4 ead rule for DACA. DHS funding is one more problem. For DhS funding mr o administration does not want piece meal legislation.
Guys let's get back to twitter, we need to campaign seriously. Let's pray this week brings good luck to us.
My life sucks, I am trying to do shivarathri jagaran by worrying h4EAD. The kind of torture we r going through hope Mr O s administration understands.



Only concern is that the judge stalled the entire executive action. DACA/DAPA is one among that which has huge visibility, hence media focus is more on this topic. H4EAD, L1"specialty occupation details" does not have that much visibility overall, but still fall under executive action. Not sure though, how this judgement is going to impact us

It has no impact on H4EAD because it is rulemaking process which is totally independent of EO.

Please refer the fourth section of President executive action under - Modernize, improve and clarify immigrant and nonimmigrant visa programs to grow our economy and create jobs. It says "Finalize a rule to provide work authorization to the spouses of certain H-1B visa holders who are on the path to lawful permanent resident status"

Seems to be H4 EAD comes under the purview of executive action/order.

Though it comes under rule making process, no one can 100% surely tell that the judgement may not impact H4 EAD becoz the judgement stalls the entire executive action and does not clearly point out H4EAD is excluded from this action.

This was the first time I had decided to sign up for the event. By the time I had decided, the registration had closed. I do know someone in IV so I asked him and they opened up the registration for 30 minutes so that I could register. To all who think they only ask for money, they never asked anything from me. I attended the event on my own free will and it was a great experience. I do intend to continue this effort and this is an on going process and policy changes simply do not happen overnight.

Just wanted to let it out there about my experience. I know people have had varied experiences of IV. Please know that it is a grass roots organization made up of 1000s of volunteers. One person's attitude should not be a reflection on the whole organization. We should remember that they are the only advocacy organization that represents high skilled immigrants. No one else represents us.



Could you please specifically explain what were discussed on H4 EAD. From a person of your repute, we would expect to get more specific details and the discussion thereof. Please let everyone in the forum knows about it.

Can someone answer this question?

When OMB reviews the rule and is ready to publish it, does this rule has to be submitted to congress by the agency (in this case USCIS)?

Looking at Step 9 (in http://www.reginfo.gov/public/reginfo/Regmap/...) I am kind of worried :( ...

Under Congressional Review Act (5 U.S.C. 801-808)

It says "An agency must submit most final rules, interim final rules, and direct final rules, along with supporting information, to both houses of Congress and the General Accounting Office before they can take effect" ... and further adds "Action by 'CONGRESS' and the President could have an impact on the rule"...

I am worried if congress may play a role in delaying this further more .. .. Thoughts??

DACA rule went to congress. House rejected it last month because of republicans, but in senate, it is yet to be passed. Even if it is failed in senate, president can veto it. If president veto'ed, both houses together has the provision of veto'ing president's veto to make the rule nullified. Sorry for being too negative. But these are the real facts in rule making in US so as to make everyone understand.

DAPA will also follow the same route. If DACA/DAPA is going to congress, I guess H4 EAD may also go to the same route as this is economically significant since this will cost american jobs. This is my own opinion and opinion differs for each individuals. I welcome others thought as well.

As per gov. sources browsed through Google, around 4 lac I140's are currently issued in US waiting for their GC's and their spouses are eligible for EAD, if this rule is passed.

Fingers crossed. Cloud 9 now. lets hope for the best.

I have been on this site since 2012, not necessary active. But after going through this post everyday and sort of efforts you guys are putting. Do anyone of you really believe that this sort of pressure through tweets and postcard would make them act any faster. I don't want to be a pessimist or have any negative comments here, but would appreciate if everyone gives in a thought for themselves.

Lets be honest its not about legals and illegals, if they start passing bills left and right, only God knows what kind of future would be all of us having in this Country. DACA if you really go through closely help the Government with revenue and taxes that the illegals have not been paying for all this years, so in a way its fair for them to expedite its process. If just by tweeting hundreds of tweets and postcards, a law could be passed, then lets try for the H.R 3012 or whatever it is and start sending tweets and post card to all Senate and house members members.

Lets face it and be honest, with this kind of dedication and hard work, lets do something meaningful. Fact is no one invited us, promising legal status or Permanent residency in a fixed amount of time. We all came here for our own selfish needs, fully aware of all immigration laws.



Much meaningful. How much ever we say, we only get hurtful replies. Let's sit on sidelines and watch. That's all we can do.

Are you not aware of consequences of H4 . If not, then it's your fault. When I came here on H4, I am fully aware of the consequences, hence I am not crying like most people do. It's their country and they have full rights to consider their citizens rights first. At most what we can do is a request and further request, but do not think by any aggressive or forceful means, this will happen

And please don't do any personal attacks. May be from your post, I could observe that you preferred a guy who worked in US, but didn't do enough home work on other aspects

Please do not say H4 is a slavery and I do not understand what point you are making by just linking with Abraham Lincoln. Please note I am not dumb to not know about him. Slavery has a very different meaning altogether. And Am I jealous ?... Huh... Don't want to go down to a level which is not courteous. That's all.

All I am saying is let's be smooth in our approach. We have the right to request. But this request kind of wording should not change like "hey I am here for 6 years, do you think I am slave, you pass it now" kind of wording.

To All,

I've been following twitter, FB, trackitt, redbus2us, rashi's followup comments/mails and all blah blah for the past 2 months since BO made that announcement. There seems to be a kind of selfishness amongst ourselves. Beware, if this rule is passed, this will eat away middle class American citizen jobs. Approximately 40,000 I140 are approved per year, so 40K H4's are eligible for EAD which is appr. equivalent to L1's of that year (2014 stats - search this in google). Assuming 10 year wait time to get GC from the date of I140 approval, an estimated figure of around 4 Lac I140's are currently there (google search and do math). This means, 4 lac H4 spouses are eligible for H4 EAD at once, if this rule is passed. In a hypothetical situation, lets assume 3 Lac of them are applying for EAD which itself is a big number.

Their official figures of 97K EAD is statistically incorrect as per their records for I140 in various government portals. Thus, I would say that 3 lac american jobs (few H1/L1 may be) will be took over by H4 EAD's. As long as american citizens are not aware of this job loss, that was otherwise would have taken by them, we are good to go and raise our voices like how we do now. I feel we are getting too aggressive than diplomatic. Please be aware this is not our country and we may not have shown this aggressiveness for any issues in our home country.

When we board the plane with H4 visa, we are very aware of consequences of sitting idle, there is no point in showing hue and cry now. But do not take me that I am against H4 EAD. I am in favor but lets be diplomatic and avoid so aggressive wording while sending messages to govt authorities. Its their country and they've their own laws. We cannot force them to publish the rule asap just for our sake, even when there is an EO. They make take time to think about the potential job losses to their follow citizens and all if's and but's. If they give so, we'll take it, otherwise, we'll go back to our motherland. No hard feelings. Lets hope all's well that ends well. This is my personal comments after reading so many unwanted wordings in multiple forums.
