There is another possibility... if your company has offices/plants in other country go work there for a year and come back on an L1 visa refile as EB2 International Manager and basically no wait time for ROW. Sorry I&C

Krustycat,

You can get a 3 year extension on your H1-B if your I-140 is approved. That is what they did with mine when it went into its 7th year extension... for the record I am inow n my 8th year of my 7th year extension

Really...this isn't what my law firm told us when we asked about the possibility of moving to a different job within the same company or even being promoted more than one level. Perhaps the job you are moving to has to meet the 50% description of the job your Labour Certification was filed as originally. Mine does not

I think still months away from actually being able to change employers. This is part that no one seems able to answer. My paralegal last year said it might be a couple of months from the time the NVC sent my case to the consulate to get an appt. Again, my understanding is that after the consulate appt and the stamp, you can move without refiling. If you can file the AC21 and move employers I would since they are so unpredictable who knows how long it could take.
I myself was offered a different position at my company but couldn't take it because it didn't meet the 50% criteria of how my original job description was filed. Instead, we had the luxury to split the job and now I split both my original job and the new one hoping that when my card comes through I can move on to the other job. Read between the lines and interpret that I basically do two jobs now instead of one.

I was told I couldn't refile because my H1-B is in its 7th year extension.
I don't know obviously ask your lawyer, but has anyone noticed that we all seem to have different answers. I am told all the time by my law firm that each case is different, but shouldn't the basic processing be the same?
Perhaps this is why it takes so long....

Yes, if you are ROW your PD is still not current. For your date to be current it needs EB3 needs to be Jan 15 05 or later than that. My I-140 was approved last year as well.

Jen26 you are good to go! Congrats and I hope for a speedy process.

Don't feel bad Krustycat... I told you I was Susan Lucci of the Visas. My PD is Jan 24/05 so it isn't current either. This means that NVC will tease me by reviewing my file for the 4th time only to discover that my police clearance is now more than 1 year old since they asked for it the first time my date became current before the debauchle of July 07. Then daudled along with it in March and April this year.

Maybe next month....

Yes, an if you look at the CP Tracker we all have old PD's as well. I think the idea that CP is faster is a myth.

Hi Jen26,

I have no idea if they filed an I-824. I work for a large professional services firm who uses a national immigration firm that makes it hard to gather exact information on what they are doing and why. I know that NVC has reviewed my documents a couple of times that was filed in packet 3. Those docs of police clearance, marriage certificate, long form birth certificate. This is the file they had recieved copies of originals as I thought I only had to bring originals to my CP, but apparently, this is not the case anymore and you have to send originals or certified copies.
I had assumed the NVC would send my file to the consulate and I would get notification for an appointment.

I hope you are all right that there won't be a major retrogression for EB3 ROW when it opens again Oct 1. I have a priority date of Jan 05 and keep having this nightmare I am Susan Lucci of the Visas. You know, my date will become current mid year for 13 years and each July they shut the numbers down and I am shut out again! No Emmy!! ...er, I mean no visa...

I feel like I will be ready to retire before this thing becomes a reality. I have been in process since mid 2004. I am using CP as well. NVC asked for my packet of docs last June when I was current and I was told by my lawyer, my file would be reviewed by them and sent to the consulate. If my date wasn't current, it would rot at the consulate. My packet of docs was officially filed on 3/11/08. NVC took a long time to review it. They asked for orginal docs and my lawyer hd sent in copies. The requested docs two different times which they have now had since April 08 and then I heard nothing until my PD is no longer current.
Its killing me...
