To enter the US: one must have a Valid H1 Visa Stamped or if have a pending AOS application can use AP.

it calls for what is the basic need/requirement for the position.... even you have masters but the postition can be filled up by a bachelors degree holder then the position will be in EB3 not EB2...

I don't think so, since I-94 is a record of arrival/departure of individual.. so your child must have his/her own i-94... but since you applied already for I-485... you're safe to travel... even you did not renew your H4... since you're in the process of AOS.. just bring with you the notice of I-485 when you travel.. you can ask a copy of I-485 notice to your lawyer... if applied thru a lawyer.

Applying for H1/H4 renewal is only to play safe in case there is a problem in the AOS (I-485) application.

You will be fine since you will be travelling only with the US.. and even you travel to Philippines if you have applied a seperate I-131 for your child...

Thanks guys for the quick replies! On the receipt we received for our I-539 application, my name and my child's name appears at the bottom stating that we were both approved. But my child never got an 1-94 while I got mine.



Yes, okay your fine..... since the name of your child is in your application.. don't worry with the I-94 of your child when you travel you have to bring this I-539 Notice of Receipt to show them if ever will be ask...

My eldest son receipt notice includes also the name my other son.. but they received their own I-94..

your child as co-applicant of H4 using I-539 must be listed in the Supplement-1 for I-539 if your lawyer din not include Supplement-1 your child is not included in your extension.. so your have to ask this to your lawyer

so your child must recieve his/her own I-94... you use I-539 and if you add your child name on it he/she must have recieved i-94.. your child is your co-applicant.. as a direct dependent of an H1 visa holder

I hope I'm posting this in the correct forum...I have a question regarding 1-94. When we applied for H4 extension my lawyer informed me that my child's application for H4 extension was filed under my name. Thus, I was given an 1-94 and my child who is a minor wasn't issued an 1-94. Is this normal procedure or do they issue separate 1-94's to minors? I ask because we are planning to travel within U.S. with our child. Thank you.

when I applied for my H1-Extension (I-129) I submitted I-539 (Extension) application for my 2 kids in just one application. They are my dependent since my wife is in H1-Visa also. My 2 kids received their I-94 for H4 seperately with the approval of my H1 Extension. The I-539 is a separte application from I-129.... you have to submit this application for your kid to recieve approval of H4 extension and I-94...

The SS Office check our record by the A#.

This is my experience with SS Applications for my 2 kids:

When my 2 kids applied for ITIN... they gave their complete name as follows.... Given Name (2 names) Middle Name (Last Name of my Wife) and Last Name... this is how it should be from their passport and how it was given on their H4 Visas. But when they applied for SSCard using EAD, they don't want to put the Last Name of my wife as their middle name as it is not recorded in INS record. When I show them the Notice of Approval of their H4 and the Visa Stamped, they put it in to one my kid but they did not allow to put to the other for the reason that they cannot see it in INS record.

And even when we applied of a New SSCard to removed the restrictions same thing happen they don't want to put the middle name taken from the last name of my wife even we present again the H4 Visa Stamped in their passport.

SS office advice me if I want to have that middle name for my kids, I need to report it or ask the INS for change of name.

Anyway the DMV just follow the SSCard and GC name given for my son when he applied for his driver's license.

So, the middle name of my kids now are their 2nd name....

Topic: Received "Card Production Ordered" E-mail

I with 3 dependents recieved emails of Card Production Ordered late afternoon of May 6 with LUD in my USCIS account, then another 4 emails of the same Card Production Ordered at around 9:30am yesterday (May 7) with LUD again in my USCIS account.
