Then what do you think i should do.. Should i just Ignore to their emails and phone calls as i am currently not in India Or USA ?
I am really not in position to return back the money. It was their fault and i am having sleepless nights.... the reason i am terrified is because this might ruin my career.... |

I moved to India as my H1b was going to get expired. Do you think I can file complaint with DOL USA as i am currently not in USA and I don't have VISA to reside in USA. |

I have not signed back-dated offer letter. They have not yet paid my one and half months salary. I think the best bet is to file a complaint with DOL USA. |

I will be flying to Canada next month. I am really worried if this incident will hurt my career.. The reason i am worried is because when my new employer does my back ground check they will definitely call to my previous employer to verify my employment history. When they come to know all these incidents they will be reluctant to hire me ... Do you have any suggestions on this ? You suggestion will be highly appreciated.. thank you... |

I am a foreign citizen and i was working in India and getting paid in US Dollars. I recently resigned as i wanted to move back to my country. Before coming to India i was working for the same company in USA. While coming to India i did not receive any deputation letter or a new offer letter.
Once i resigned, they issued me a back-dated offer latter (April 2011) that offers salary in Indian currency that is way less than what i was currently getting.
Now they are asking me to pay the difference of amount of Indian Salary and salary that i was in US dollars. What should i do ??? Should I file a suite or should I just ignore as I am not in India or USA. |

Thank you.. i am thinking of resigning and going back to Canada. Can my company have me arrested for this ??? I really don't want to involve in any kind of stuffs that would ruin my Canadian PR and eventually citizenship.... thank you... i will resign as soon as i land to my home country next week.
Also, if they sue me, wil they sue me in india or in USA ? |

Finally after many days, someone from HR called me and told that they have determined my Indian salary and I need to return back the difference. The salary they are offering is way less than what I was expecting.
They agree that it was mistake on their part and they also blamed me for not telling them about getting US salary when I was in India.
As I won’t be able to pay back all the money, I am planning on resigning. Need your advice! What should I do?? |

"You do not have to answer this, but if you do not have a bank account in India till now, I wonder how you have been covering your expenses (it is not like you can pay everything using credit cards in India)." :
I using ATM to withdraw money. US bank lets me withdraw money free of cost for multiple times in a month.
It means i need not worry about giving money back to the company. The only thing that i need to worry is about tax implications. |

They are saying that since i am in India they can not pay in USD so they are going to stop US payroll immediately. They are not going to fire me, however; they will start paying me in local currency from now onward. I am still not sure how much they will be paying. If the salary i am going to get will be less than what i am currently getting then i will quit and go back to Canada as i have Canadian residency. Please note than i don't own a bank account in India and salary gets directly deposited to my US bank account.
Also, Company is not a US company. It is an Indian company headquartered in India and i was hired on-site.
My question is can they ask me to return back salary that was paid in USD while working in India? Can they sue me over this ? What are the possibilities ? |

They never gave me any deputation letter while coming back from USA to India. All I have is an offer letter that was given to me when I joined this company in US. Company provided me airline ticket while coming to India. |

I am a Nepali citizen currently working in India (I don’t require visa to work in India). I came to India when my 6 Years H1B (US Work visa) was exhausted last year. While working in India I was still getting paid in USD and paying tax to US government.
All of sudden, I got a call from local HR and he told me that they cannot pay me in USD and my US payroll will be stopped immediately.
My questions are;1.Can they ask me to return back all the $$ that they paid me while I was in India? (Is it even legal to ask?). I came to India because they assigned me to a project in India. They never gave me any deputation letter while coming back from USA to India. All I have is an offer letter that was given to me when I joined this company in US. Company provided me airline ticket while coming to India.
2. Do I need to pay Tax to Indian government as my salary was directly getting deposited to my US bank account and I don’t have bank account in India? |

When are you planning to permanently return back to Canada ? I was told that new immigrants must have to furnish their permanent Canadian address with in 6 months of initial landing otherwise their PR status will be voided . Is that true ? |
