Topic: H1-B Visa Cancelled - Next steps

One of my relatives H1B-Visa was granted initially and upon collection of passport, found that VISA was cancelled. No reasons given. Can anyone advise what to do next? The company lawyers are already involved in contacting the US Consulate HYD. Is there a possibility the case be considered again?

My RFE is just medicals. My attorney suggested on the same lines, respond with incomplete RFE. But if the dates are never going to get to Oct 09, then don't you think I should properly respond to RFE?

The main reason I am delaying my RFE is I am planning to get married in October. I want to file my fiancé's I-485 when the dates are current. I don't want my case approved before that. Any way to delay RFE response without jeopardizing my case?

I am going to respond to my RFE by Sep 8th. Hopefully delaying my response would delay my GC approval and by then dates retrogress. So guys tell me what are the chances the dates will move to Oct 09?

On what basis you are saying 99.99%. I have not yet responded to my RFE. I want to delay this as much as possible. I got to respond by Sep 8th. I hope the dates retrogress next month.

Probably I did not get NIW based RFE since I am with the same company for the last 5 years and continue to be on H1B(Did not use my EAD/AP yet). Not sure if they check all these before sending such RFEs.

I did not get any NIW evidence. What does it mean by NIW evidence? Are they asking if you are still working in the same domain? Did you change your job?
Did you not get the RFE earlier when you filed I-140 in EB2-NIW category?

My PD is 10/01/2009. My lawyer got the physical copy of the RFE today.
From my lawyer ...

"Our office has received the RFE notices from USCIS regarding your pending I-485 application.
USCIS has indicated that your previously-submitted medical exam is no longer valid or are about to exceed its validity period. Accordingly, USCIS has requested a new, updated medical exam. "

Well I suppose it depends on the place where you work. At least so far in my career in engineering and managerial roles I did not see any regional politics. I have worked with some of the best companies and almost in all the cases getting quality work done was utmost priority along by respect for your team mates. We Indians having raised in brutally competitive and resource starved environments will definitely have the urge to move ahead of others at any cost. We need to change this mentality and strive to make opportunities for everyone to succeed. I suppose H4 EAD is just one correct in this direction.

I agree US laws should always guard their policies against any untoward impact on locals. Most of the locals I know cannot even make $50k an year and need to support whole family with such spartan incomes. But what made me do the volte-face(as said by goadude :)) was that US in general is not interested to get the brightest and the best into this country. They allow entire populations to migrate here only vast majority of them end up working in walmarts, cab drivers etc. Well may be no strings attached H4 EAD might not be very right thing to do. Not sure.

Well I agree that you have valid points. Already immigration policy is flawed in so many places. At least H4 EAD holders will not be on food stamps and unemployment benefits as the other GC groups can benefit from. Looking at the overall damage I do not see any big damage to the locals jobs. Only 35000 H4 EAD will be given every year. Of which not everyone will be seeking out for a job once they obtain EAD. This number is tiny to have any dent on the jobs which locals seek, but a great benefit to the families who need that additional household income.

Well coming to the Permanent Residents not able to bring their spouses easily to US, its another battle to be fought separately. I guess number of folks in this situation are far less than folks on H4 visas. So in a way maybe the case can be made easily though people fighting for this cause will be far less.

Nice reasoning. Last couple of days I was taking opposing stand as much as possible to elicit best defenses. Thanks for all the folks who have really put your mind in replying. I am convinced with certain thoughtful arguments like yours now and favor the proposal to grant EADs for H4 in certain cases. Mind you I have not posted any comments on the regulations.gov yet. I thought first I should try this forum first. All the best guys. Hoping to see this proposed rule to pass soon.

Don't rattle off without any data to prove your point. You don't need dad's money to do masters in USA. Almost all hardworking and smart students eventually end up in getting some form of assistantships in US universities. In most companies I suppose they would be more happy to take EAD employees rather than H1Bs due to more stringent requirements to qualify and less visa numbers. This is big injustice to the students who now have to compete with H4s who have EADs. Basically the common ground to compete is lost.

Coming to education, well looks at this, even average school in USA(say ranked 100) have professors who have done PhDs and research in some of the countries finest schools. Contrast this with the so called top schools in India apart from IITs, where most of the faculty have just completed their BTech or MTech without any exposure to industry or research. Do you still expect quality of education same both in India and US? So don't just rattle without any data.

I am sure some H4 EAD might perform better than H1Bs, but that does not represent whole of the sample.

Well this guy 'R K Sharma' seems to be nuts in having false regional impressions. In my company we have folks with reasonable distribution from all over India. Just guess which state sends most candidates to IITs and AIIMS disproportionate to the states population? It's from Andhra. Then why don't you expect folks from Andhra to be in more numbers in IT field and medical fields. Does he have any brains? He is blindly concluding that most of them use fake resumes. One can easily filter out if the candidate has stuff or not during phone screening itself. Hope this idiot R K Sharma does not imprint in the minds of gullible false regional stereotypes.

I completely agree with goadude. If you think you are qualified why don't you apply for H1B jobs. Why take this shortcut route? Work experience and education in India still cannot be compared to that here. On average US education is far better than 'theoretical' studies in India. If you got to wait you got to wait for your turn to get GC.
