Notes: No LUD since Feb 27, 2011 until Sept. 23, 2011 when I also got an email about the approval and the online update. I did not get an SMS, although I enabled both!. No news yet about the I485. Never raised SR about it.

If this was academic cap-exempt H1 visa then it is only transferable to academic/non-profit institutes.

Topic: With I485 pending: What is the right time to Renew AP?

Please help with this situation.

While I485 is pending, if someone is on AP status and is expiring in Feb. 15 2012. When would he apply for renewal?

1. Any time before Feb. 15 2012? The person will stay in US out of status from Feb.15 2012 until I485 approved?
2. 3 months before Feb. 14 2012? so that the new card must come before Fe. 15 2012 ?

That is right but if the GC officer looked at the documents for I485 after the expiration date of the old H1 visa it will show expired H1 status and the officer will send you an RFE to demonstrate unexpired H1 status. Is that correct? or is USCIS is smart enough to know that the GC applicant already has an H1 extension?

What if you apply for I1485 then apply for H1 extension. Will that later trigger RFE for a proof of legal residence? since your I485 does not include your new I94 and I797 of the extended H1 and the GC officer will not know about them. Any thoughts here?

Sorry, I thought she has AP in hand. Otherwise, if the husband has an active H1 status, he does not need to go with her to the consulate. In theory, she can go by her self, show her hsuband proof of H1 status, and show proof of mariage.

But one question, what if she came on H4 visa then he changed his status to AP or even got his GC. What happen to her? Will she then be out of status?

Why your friend need to go out of US? He can keep working using his H1 visa "status".
His wife can go to a consulate and apply for H4 "visa".

If they both or his wife only apply for H1/H4 visa from the consulate, the applicant cannot use the AP to enter until a decision on H1/H4 visa is received.

So, if applied for H4 and that is pending, she has to wait in india until get a decision. Can not use AP while her H4 is pending at the consulate.
If her H4 is rejected, she can come on AP.
If her H4 is approved and her passport is stamped, she can come and enter on H4 status or the AP, whatever she shoose.

That is my understanding but I am not a lawyer.

Good idea. I think it will be useful if the response was also mentioned.

I once suggested to report all SR responses but did not work. I think will be best if on trackitt they create a separate fixed link for USCIS RFEs and SRs for each form.

This is a great idea.
I just looked at the Ombudsman page and after filling the details there is a space for "Description of your case problem"

Unless there is another way to respond as a group, I suggest we formulate our problem in a strong well-written paragraph or two and fill in that space, each of us individually but speaking about the same problem.

Hi everyone,

Please repost the conference call information.

I hope another thread is created or this one is renamed to reflect the larger EB1|EB2-ROW communities who equally suffer from the current processing scheme.

I have another observation from the latest trackitt approvals. For EB1 and EB2-ROW as a one pool, their I485 approvals depend more on the date of I140 approval rather than the date of I485 submission.

In another way, USCIS apparently prioritize our I485 cases based on the I140 approval dates. So, if you consider that while looking on the database, you will get more accurate estimate on when your I485 will be "desicioned"

It might be noteworthy to think about the bigger picture. It is not only about EB1A, EB1B. The hold also include all your EB2-ROW fellows.
Including them in your discussion might increase the pool and solidify the case. The USCIS decision affected all.

Guys, the processing times have been updated.

Regardless to legal or not, from the trend line charts over the last 5 month, USCIS plan has been to process and complete the pre-adjucated EB cases (EB2IC, EB3) as fast as possible while keeping the other cases (EB1, EB2-ROW) on a flat plateau (in=out).

God know for how long that will continue !

I got the following response to a SR

"This application has been placed on hold pending review and adjudication. You should receive some type of a response from USCIS within 30 to 90 days."

Does anyone can help me clarifying what that message tell? At least does it mean background/name check is completed?

To answer your question, you need someone inside USCIS.
However, as I said before, I checked Sept.'11 and Oct.'10 and clearly clearly there is a UCSIC decision to focus more on EB2-I and EB3-I.I do not know how, why, or for how long, but from the trackitt database, the current pattern is not normal, not at all close to that of Sept.'11 or Oct.'10.

The question now will that pattern continue like that in Nov.'11? and till when? What the actual USCIS plan really is? Again no one knows for sure what is in the black box except those inside the box. If anyone knows, please update.

Yup, very frustrating and stressful indeed!

Use them if they are recent enough and follow the dimension and pose requirement.

Make two checks. Why?
1. The officer expects and will blindly look for the check of each application. Do not be too smart here.
2. If one application has something wrong or missing and you send one check, both applications will be returned back to you.
