Topic: Recently my company has started 401K option

If your employer matches your contribution then go for it. If you draw funds out from your 401k before 60 yrs you will end up in paying tax on it what ever your tax bracket is, it depends on the income level no matter you are deporting or staying in US you cannot escape it other than runaway with all money overnight and 10% penalty for drawing b4 60yrs. other option is you can roll it over from 401k to anyother roth IRA to avoid 10% penalty but u have to pay tax at your bracket. it doent matter if you are a citizen r nonimmigrant all have to pay tax & penalty as per law.

Hi
iam a taxpreparer. you should get another $600 for your husband when you file 2008 tax return. it doesnt mean that if you efile u will get it. when u efile u will get the refund faster than paper file. because irs receive the tax return immediately. if you have kids then u should get another $ 300 for each kid.

Topic: Tax Filing this year

Hi its me again

i think you will get refund because you have kid and you worked only for 4 months, so the income will be low. provided if your wife have social security number not an ITIN#. one more think i have to tell you if you have a bank account in usa and if you could access from your country then have your bank account number and routing number in the tax return, then irs will send the refund money straignt to your account so you dont want to call your friend ofen to find out whether he received your refund check from irs. by the way where did you live in usa. if it is in IL i can help you if you dont mind.

Topic: Tax Filing this year

HI
You can file your tax return at anytime there is no limit, but if you think you will get refund you have to file asap. there is a time limit of three years starting from the due date ie for 2008 due date is 04/15/09 with extension 10/15/09. three year starts from 04/15/09. and also if you think you owe taxes to irs then you have no choice other than filing asap. because you will be penalized for balance taxed owed starting from 4/15/09 when ever you file your tax. my suggestion is ask your friend to prepare the tax return for you and email it to you so you can print it attach necessary doc with it sign it and mail it from where you are now. there will not be any problem by mailing from your place. if you have more ???? you are welcome to ask, i can reply immediately.

thanks

Topic: Loosing job on EAD while 485 pending

Hi
are you stupid to ask this question about "eligible for unemployment". if you apply for unemployment you will be dead in water. you didnt red the threat about unemployment issue previously. dont go for unemployment you are NOT ELIGIBLE to claim. We all nonimmigrants are not eligible for unemployment. once you get GC then your are fully eligible.

Topic: Questions regarding Travelling First Time to India on Advance Parole and regarding Transit Visa

Hi
1. only AP. but if u dont have visa stamped in ur passport(doesnt matter if it is expired) he will ask where is ur visa, what status ur r now in. then u have to show the H1 approvals. copies of previous H1 approvals enough. but u have to have the latest original H1 approval.

2. when u leave the country customs people will take a look at it thats it.they will return back so give one AP when they ask. but when u reenter usa at that time u have to give the two AP's to the officer and they will stamp it and they will give back one AP, and they will keep one with them.

3. no petitions needed if dont have one. but have the H1 approvals(extensions) with you even if it is copy its ok.

4. no thats not his job, thats customs peoples job thats why they keep one AP with them.

5. it depends. if u want u can. but when u reenter usa at that time they will give the I94 for only one year. so u have to renew based on ur H1 validity.if u use EAD then that will be different story.talk to ur attorney.
6. when i leave usa they just asked my AP to see whether iam in legal status because i dont have visa stamp in my passport because i renewed my passport two times. then till i reach bombay no one asked me abt the stauts or visa or AP. when i came back from bombay first they asked visa when they saw my passport but i dont have H1 visa in my Passport then i showed AP. then they didnot even ask anything other than AP. when i reached Frankfurt i stayed for two hrs so we all went to the waiting lobby and when i reentered flight at that time they want to see my visa/AP. if u have visa they dont ask AP. otherwise u have to show AP. then when i reached usa customs people saw my passport and asked where is ur visa i showed AP then he asked how did u entered usa initially. i had my old passport with me in that i had expired visa then they saw that and took me to the second interview. there another officer he also asked me how did u entered usa in 2000. then i showed all the H1 approvals starting from the begining. then he didnt even open his mounth. after 10 minutes he let me go. thats it.
thanks

Topic: Questions regarding Travelling First Time to India on Advance Parole and regarding Transit Visa

HI

i had the same situation like you. i went to India in may 2008 by AIR India Chicago-Frankfurt-Bombay roundtrip. i took all the documents which i have from the day i entered in USA. when u go out of america no one asks all these documents. when u come back starting from Bombay they will ask AP and also in Frankfurt they will ask AP. when u enter america u have to show all the papers like AP, approved H1 etc., if u have expired visa in ur passport means u will not have that muchproblem. theywill check it and let u go within 15 to 20 minutes. Dont worry take all the documents with u they will not open their mounth.
