Seriously, stop, take a deep breath, think for a while, then take a deep breath again and think again! These "scheme" is not going to work! You can't cheat the system, not anymore, not since after 9/11/01. What you are suggesting is ludacris! At least don't write about in the forum, for pete's sake! What do you think, the IO at the POE doesn't have all your information? Again check with a good lawyer about the LEGAL way to do it. |

After your idiotic post to that poor polish girl, I have no inclination to help you whatsoever, but since you are Bulgarian, what can I do...
Check and read about Consular Processing (CP). You can't simply take off from US, even if you have AP. As far as I know, you have to be physically in the US when your case is adjudicated, also think what will hapen if you are issued an RFE or you are called to an interview. Besides, what would you do, call USCIS and have them mail your GC in Bulgaria? Switching from AOS to CP is possible, but difficult, check with good immigration lawyer. Good luck! |

Your situation is interesting and it does not have a straight answer, but a lot of "if" and "but". From what you have described, it looks like you have EVL, so on one hand you should be fine, on the other IF you receive RFE and IF the RFE reqires employment history than the situation becomes murky. Fortunately I am not laid off, not yet at least, but I like to know all options. I am sorry about your situation, try to stay positive. It looks like metis answered your questions about part-time job, I agree with him. From the discussion in this thread and others it looks like there are 2 things that might happen with your case:
1. Case is reviewed and approved without RFE - this is the best case scenario, you don't have to do anything, you might stay unemployed untill you get the GC.
2. Case is reviewed and RFE is issued - here it gets tricky. Your RFE could be for something small that could be easily addresed or it could require employment verification letter (EVL). In that case you have to be able to produce this EVL. Please read lrindy, metis and others posts in this thread re: paystubs and employment history.
So, your best course of action is: don't panick, try to stay calm, look for a new job and negotiate with potential employers for EVL. It looks like newuser001 is suggesting that you can easily obtain such EVL by paying for it. Watch out! this is a dangerous game, if USCIS finds out about this "scheme" you will be in serious trouble.
Regarding AC21, look on trackitt for post by Adrian Mutu and others, you have to have the new job offer and the EVL in order to file AC21, besides there are 2 schools of thought: one says file, one says don't unless you get an RFE. I hope this helps you. Good luck. |
