Topic: Priority Date from Labor used to apply for Green card!
I-140 should have that information.
Basically Priority Date is the first Notice Date that you received when you applied for Labor.
What was your first ever date??? when you applied for your LC...that's your PD.

Topic: I-765 EAD - Based on Adjustment status (PLS RESPOND ASAP)
We E-FILED our 765 EAD application and in the process of sending supporting documents.
Do we need to send in photo 2X2 (I dont know it says dont send photo and biometric will be scheduled) ... I think the instructinos are general....I dont remember doing biometrics for EAD
Also do we need to include cover letter.

Topic: Is processing times based on Notice Date ?
Its Notice Date. MY RD is July 2 and ND is Aug 9th but I haven't seen anything. When I called USCIS they said when your ND (Aug 9) becomes current, then your case will be touched.

You clearly have a proof of "breach of contract" i.e. paycut for GC..I'm sure there are other things, make sure you document those (day/time/incidence) etc.... Unless they come back with another story that they reduced your pay due to performance or something silly like that. Make sure you keep records of your performance..any emails etc.

An agreement that is not LEGAL is not binding in court. USCIS clearly says that employer must pay for the green card, they cannot make you pay. So if he deducted the amount from your pay check and had you sign that its not binding in court (it does not protect him).
Sue him after you get your GC. Or atleast file a complaint...with USCIS. He cant do anything about your GC once you have it.
The other thing, if he had you sign an agreement for X number of years of employment, this is legal. However the employment conditions have to be legal. It seems he's harrasing you, cutting your paycheck to get paid for filing your GC...that's not legal.. For harassment reasons you can break agreement. |

Actually if you enter as a "advance Parolee" your H1 is void. You do need work permit to work with your employer. My lawyer had told me that.
Having a pending 485 and H1 can go parallely, but once AP is secured and you enter US as a Parolee you are a parolee not H1 (non-immigrant).
