I am on L2 visa and I applied for EAD long back - but it was getting delayed ..
Meanwhile I applied for SSN and got it within 10 days.It mentioned "Valid with DHS authorisation" on it.

But what I got to know through various sites was that L2 visa holder can work in US without EAD. The I 94 stamp(on passport) acts as a DHS authorisation proof for us.

It means that you are allowed to work if you have ur SSN,marraige certificate and valid I 94 .
Still some employers insist on getting a EAD , so you can ask the SSN office to write a letter stating that you are allowed to work on this visa, and it should be sufficient to show as a proof to employer.

"Valid with DHS Authorization" means Valid with Department of Homeland Security Authorization. The EAD (Employment Authorization Document) is expediting by the Department of Homeland Security Department. The form known as I-94 is given to everybody that comes to the US including as a tourist and it is not an authorization at all!

You are not allowed to work with SSN, marriage certificate and valid-94. Go ahead and try to get a job like this. The employer will laugh of you. The employer does not insist for you to get an EAD, it's Law!!!
Do you really think that the US would make you a document which cost $ 340.00 that you are obligate to use? There are rules and law in here, especially for immigrants.

Be careful with "your writting in here", because people can get in jeopardy if they believe what you are saying. Working without the EAD is illegal.

Ask a lawyer!!!!!! This website has a service that you can ask a question and pay for it.

I am an L2 Visa holder as well. I got my SSN without any problems, however it states 'valid for work only with DHS Authorization'.
The SSA Website states that I may choose to apply for an EAD but that it is not necessary if I present a marriage certificate stating that I am married to the L1 visa holder, what we actually did. The USCIS Website however states that I need the EAD.

I even have an US Inc. and and employer Tax Nr. My lawyer told me that I'm allowed to work in the US on this visa but he never mentioned the EAD.
Now my question: Do I need this EAD or not? How come that I can actually own a company and employ people without having an EAD, but if I want to work for somebody else I've been told that I have to have it.
Pretty confusing I think.




My advice for you is: Hire a better lawyer!!! You are not allowed to work or hire people without the EAD. You can have a serious problem in the future when you try to apply for your Green Card. They can deny your green card because of this.
I just went through the green card process and they asked for copies of both my work authorization (EAD) to compare with their records and, see if I did not work without their authorization.

You are saying that you read at the USCIS website that you need an EAD. This is the official font for all immigration process, you are an immigrant and you don't believe it. Remember that social security office take care of AMERICANS not immigrants. The rules that you have to follow are the ones posted on this web site: www.uscis.gov.
Change your lawyer for an immigrant lawyer that will not put you in trouble…it happens every day.

Guys,

Social Security is one thing; a lot of people could get a social security with the L2 visa without the EAD. Remember that the social security number is needed for a lot of reasons like opening a bank account, get a credit card, get utility and things like that.
But, work is a whole different story. The L2 visa does not allow you to work buy itself, they say that is a privilege of this visa. In order to get the "privilege" you have to apply for an EAD.
You can look in different forums and on the web. To give you an example, I almost had to quit because my EAD renewal was delayed, even tough I applied on time.
I am not saying that by myself I had my husband’s company lawyer and my company’s lawyer taking care of this for me.
Their plan was lay me off and re-hire me when the card arrives. I appeal for the ombudsman and my card arrived the day before I was supposed to be laid off.
We are not allowed to work without this document! It is the same that hiring an illegal to work from a company perspective.
Just ask a lawyer or go to the USCIS website and you will get your answer....

This isnt true...Im on L2 and waiting to receive my EAD. I did get my SSN in the intrim period and my SSN says "Valid for work only with DHS authorization". This is pretty much the same status that my hubby has with his L1...so pl go ahead n get ur SSN. All you would need is only your passport(I94) and marriage certificate.

I think it depends on each Social Security office. In 2006, I went to the office in Dallas and they did not allow me to apply. I had all the docs that you are referring to, including the receipt for the EAD. They told me I had to return when I had the physical card. So, yes it is true. It happened to me. You can try at your local office, it doesn't hurt.

That's USCIS number in Washington. My suggestion is give them a call as they are quite helpful for approved cases like ours.
You already got mailed your new card email on July 29th? I think you should get your card sometime this week, just my guess but as timing is important in your Hubby's case I think you should call them.



Hey texandude, thanks for the tip. I called them and a lady told me that my card was shipped on August 1st, 2008 and it should be on the mail. She told me to put our names on the mail box.
I have been living at the same apartment complex for the last 2 years, and we never ever had any problems with our mail but, it's better be safe than sorry.
I will do that today!

Guys, I need some advice.

My husband and I were approved on July 1, 2008 and of course, we haven’t received the card.
We got the stamp (I-551) valid for one month. We both already traveled abroad. My husband actually traveled twice. Well, the stamp is going to expire on August 10th and my husband has a meeting in Europe next week. The infopass system is not working for the last 2 days and a half, so we haven’t been able to get an appointment.
I called the 1-800 number and as always did not help at all. Besides that, the system (over the phone) is saying that we were approved on august 1st instead of July 1st. The lady also said that the card was not mailed even though I got an e-mail on July 29th, saying “we mailed your new card”.
What should I do now?
What is this number 202-xxx-xxxx that people are talking about?

I appreciate your help.

When do I receive the card? in a Week?

My wife is here with L2 visa type. is she elligible to apply SSN with out applying EAD. is that madatory to get SSN for L2 should have EAD? Please advice.

I believe she can get an SSN but, it will say not valid for work. The same thing happens with student visa holders. They can have the number to open a bank account or credit card but, she won’t be to work with this card.
Eventually, when she gets her EAD if she wants to, she will have to go back to the SSN for them to change it. Then it will say Valid for work with DHS document (or something like that). I don’t remembered the exactly words in my card.

Yes, you need a passport until you become a US Citizen.

Imagine that the Green card is a permanent visa. They will stamp your passport with date and local of entrance every time you get in.
