I'll have to search for a link re. portability of non-concurrently filed I-140. May be someone who has ported their approved I-140 to another LC can share their experience . . . .

FDBL is being vague -

I-140 can be ported under 2 scenarios -

1. Non-concurrent filing - meaning use an approved I-140 for a LC filed by another employer on your behalf. To keep old PD
2. Concurrent filing of I-140 & I-485. has more flexibility - can be ported after 180 days of filing of AOS. However, there is a risk of RFE and withdrwal by employer if beneficiary leaves before I-140 is approved.

I too am planning to change jobs. My I-140 has also been pending for over 9 months at TSC. There is no consistency in processing of petitions. Some of my colleagues who concurrently filed both forms last summer have already got theit I-140 approvals. TSC has been processing many petitions filed after after August 2007 . . . .

I'm guessing that the 4th & 5th positions in receipt number represent the Month rather than Year
07 - July
08 - August, etc.

My AOS petition was filed in August & receipt number begins w/ 08 . . . .

Topic: AP on infopass


If the reason is a medical emergency, we can take an infopass and ask the local office to issue a temporary AP. Could some one tell me , is there a time limit / validity for this AP. Can we use this temporary AP to travel now and return to the US after a month ? ... Also do we have to travel in some x days time, after we get the AP.



I got the interim/emergency AP 4 weeks ago because of a death in the family. I had to schedule the Infopass appointment w/ the local office in NYC & provide required documentary evidence. I got the AP same day - was asked to wait for an hour & collect AP.

The Interim AP is valid for a year.

I have since returned to the US on this AP. did not have any problems when re-entering.

USCIS Online Status check says "On October 5, 2007, we received this I140 IMMIGRANT PETITION FOR ALIEN WORKER, and mailed you a notice . . . . "

Can someone tell me if Oct 5, 2007 is the Notice Date or Receipt Date?

FedEx receipt says my AOS + I-140 application package was delivered to USCIS on August 10, 2007.

Topic: To expedite AP on Medical Emergency

I got the emergency AP 3 weeks ago because of a medical emergency as well. You have to submit a letter from the doctor and/or hospital stating the nature of emergency. If possible you shd also provide evidence of your relationship w/ the patient. It's a very insensitive process!

You shd schedule an Infopass appointment. I went to the New York office. If you have all required docs ready, USCIS will give you the emergency AP on the same day..... hope this is helpful.

Candian PR and US GC are independent processes. I don't believe a Canadian PR can adversely affect your US GC. If USCIS cites the Canadian PR in RFE that would be illegal.

I discussed the Candian PR option w/ an immigration attorney who coincidently is Canadian (not the employers immigration attorney) and he did not think I would have any problems with the GC . . . .

Now that you've raised the question, I'll chk again.

Yes, something like that. But they don't require that you visit Canada immediately.

I toohave applied in Feb 2007 for Canadian PR and completed the medical exam last month - I believe CIC is waiving interview for me.

I doubt that USCIS will raise questions about the Canadian PR. If they do I will speak to an attorney.
The USCIS and their processes are so slow. It is stalling applicants careers, putting lives on hold for years - my GC has been in process for 6~ years already. They can't prevcent you from seeking other opportunities!

Didn't you get a "No arrest/Criminal record" from the FBI for the Canadain PR? Well, in a way they should already know that you've applied for Canadian PR . . . . . right?

Has CIC given you a timeframe/deadline within which you have to complete the landing formalities - to become a landed Canadian PR?

I thought the rule is flexible & you can visit Canada anytime within 6 months of receiving the card to become a landed Canadian PR. Their rules for maintaining the PR are also flexible - 720 days of residence in Canada that does not have to be continuous and can be accumalted over a 3-5 yr peiord. Have these rules been revised/changed?

I too worked in high level positions in two of the big 4 firms for 8+ yrs. I started the GC process with one of these firms whose policy is not to give the employee any information re. immigration. I don't believe the attorneys (FDBL) are to blame. I had an approved labor w/ 2002 PD & 140 but the big 4 firm refused to let me port it when i decided to leave last year. I had to start the process all over again w/ my new employer - a multinational fin srvs firm who also uses FDBL. Anyway, miraculously all dates became current and I was able to file the AOS this time . . . .

BTW - info given to you re. immigration fees is incorrect. Per emp fee works out to < $10,000. You shd ask to see the invoice & pymt information related to your acct.

Cholan, You shd be able to get H-1B extended based on the approved labor - I'm into 11th or 12th yr of H-1b . . . . Its been such a long time that I forgot the count!

Currenly I am in 8th Year (H1B) extn, and that will going to be expired in Jan'2008. My employer filed I140 in Aug'15 in Texas and got Receipt notice. My question is Can I get H1b extension? based on the I140 receipt number. Because based on the I140 processing dates in Texas will not be approved before Jan. Can you guys help me. Is there anything elsen I can do it to prevent that suituvation.

Or will it be any problems in geting H1B Ext?
