Topic: How to check if previous Empl has revoked/cancel approved I140

Hi,

I am in this tricky situation. I left my previous employer in June 2013, who had filed my GC and I had I140.

I used this approved I140 to change my job and unfortunately I got just 1 year of H1B extension on basis of I140. My new employer has not yet started new GC processing and its unlikely that I will get another I140 within 1 year time. So I have to use I-140 from my previous employer.
My previous employer is not responding to my emails about whether he has applied for cancellation of I-140,so I am not sure whether I-140 is still valid or not. Since my previous employer in unresponsive is there any way that I can check if I-140 is still valid?

I don't have much hopes from CIR, because my priority date is Dec-2011 and category is EB3, so any case I am looking for 10+ years.

My new employer is willing to sponsor my GC, so at this point my preference is to get H1B transfer based on I-140, but due to this merger I am not sure how smooth H1B transfer will be.

Has anybody gone through similar situation?

My I-140 got approved in Sept-2012 under company name A, in Nov-2012 there was merger between my company and company B (merger of equals) and company has new name as C.

Do I have to refile my I-140 for this change?

Recently I got a very good offer and now wanted to change the job, I wanted to get H1B extension based on approved I-140, so would there be problem in transferring my H1B Visa based on I-140?

Topic: Does LCA need client letter (PO) ?

Hi,

I cleared technical interviews with client and my visa sponsor is willing to transfer my H1B visa. However client has not yet given purchase order (PO) to my visa sponsor so my visa transfer is getting delayed. As LCA needs to be applied before H1B Petition for Change of Employer, my question was knowing that we are going to get PO from client, can my sponsor go ahead apply for LCA online, so that when PO is ready he can quickly apply for H1B transfer?

I wanted to save this time that I am loosing in between getting PO and then applying for LCA.

Unfortunately and unexpectedly my current employer has terminated my employment with immediate effect.
I am have approved I140 and currently having Visa Extension till Sept-2013.

Can I safely transfer visa to other employer? What are other options available to stay back in USA.

Hi,

I am in exactly same situation. My H1B 6th Year getting expired on 09/25/2012, and I am going to file I140 on or before 09/07 under premium processing, considering 15 days of time i am expecting approval (if everything goes well !!) on or before 09/22, that give me just one day time for H1B filing. My attorney suggested me to file for H1B extension before I get I140 approval notice and then once I get I140, send I140 approval document under RFE.
Has anybody done this before, and what was their experience like?

So apparently there is different opinion among Attorneys !!! Whom to trust ???

My query is whether I can consume entire H1B visa or I have to keep some H1B visa and go back to India? Would there be any problem if I use entire H1B and then apply for H1B extension from India?

Thanks all for your valuable inputs

Here is summary of all inputs

==> you can file for 1 yr H1 extension after 6 months of PERM filing i.e. your PD date 12/30/2011. You can travel back to US on 12/30/2012 even if your PERM is not approved on this 1 yr H1 visa

==>even after fully utilizing the H1B period also there is no need of waiting for 1 year, incase my I-140 cleares immediately i can come back

==>Though we file PERM in < 365 days of H1b 6th year expiry date, If visa status change to B2(before h1 expiry date) and stay in USA, as soon as you get PERM and I-140 , we are eligible of H1b extension

==>If Perm is Pending and Perm Filling date is 365 days old, then you will get 1 Year H1B Extn.
It Perm is denied then you have to wait 365 days from your Exit date and Apply new H1B Visa using H1B Quota. (No way to use previous H1B, If perm denied)

Hi 14dec2011,

Thanks for input, in that case do I have to go through US Consulate in India and go though interview process?

I have around 1.75 months of unused visa, with which I can stay in US till mid-September-2012, which is closed to Dec-2012.
If I can get extension just of PERM filing, I can think of staying back in USA on B2 rather than going though US Consulate in India, because US Consulate might denied my extension for reasons which I haven't anticipated.
