Topic: What are EB3 India guys up to ?
My PD is Dec-2002 EB3, I already moved to different employer(AC21) and Working on EAD, i am feeling like i have green card except i have to renew it for yearly once or once in couple of years instead of once in 10 years(for green card holders) other than that I do not see much difference, because even if my green card is approved tomorrow i am not going to change the my current job and I know I am not going to get more money than i am getting today. So, i really do not care when my green card is going to be approved, hopefully it will not be rejected. I am staying with EB3 and do not want to take risks of changing to EB2, already took chances of using AC21. That’s enough. Good luck to every body. |

If you are an EB3 ROW, China, India ... and ROW India, China then this is not a good site to ask people to do something. Most people come to this site for entertainment. This is the reason why I have myself reduced my time on this site and spend more on Immigrationvoice.org or do my own efforts. The quality of posts on this site is decreasing every day.

one of the worst decisions anyone can make is what u did. you kissed your h1 good bye like goblin said.
why would you switch to EAD ? it is a fall back and everyone should have it. i had no history and i maintained it, i dont know your reason for switching.. but bad decision
I could not resist to ask you why it is bad decision, why it is one of the worst descisions anyone can make?
I changed my employer and instead of filing H1 with the new employer i opted to Use EAD.
Since I have EAD now I can work for any employer (ofcourse same or similar position) . H1 will restrict me to work for only that employer. how come this is a bad decision.? |

My experience.
I did invoke AC21 in dec'07 and I also changed my lawyer (form G-28 i guess) and I did not see any LUDs for almost 5 months and I saw Soft LUDs on 140,485,131,765 on April/14/2007. Not sure what happened there and There are no soft LUDs on My wife's Case. My 140 was approved in Ju7ly'06, and 131,765- are approved in Sept 07.
And I spoke to an IO in may first week. she told me that my lawyer information is updated to the new attorney. and I asked her is my 140 ported to my new employer. She has no clue about portability and she told me that my 140 is approved in 06 and the employer is OLD employer's name . and she gave a suggestion that i need to file 140 with the new company if i need to change the employer. (Which is bulls .. hit) and I understood she does not know waht she is talking about and I assumed there will be no changes to my application if AC21 is invoked. |

Topic: Can I transfer my H1 to New Employer ?
Invoked AC21 and changed companies from A to B.
H1B is still valid from the company A. but did not transfer to Company B instead working in company B using the EAD.
Used AP to re-enter in to USA couple of months ago.
It has been almost 6 months I have been working on EAD. But my H1 with Company A is Still Valid and it is valid until 2010.
So, My question is Can I transfer that H1 to my new employer company B now?
Gurus , anybody did transfer the H1 after Using the EAD to work for another employer? |
