THANK YOU SO MUCH FOR THIS FORUM, this has been so helpful to me. I also checked the AC21 rule and verified that what you guys are saying is legal. Thank you very much, good luck to all of us, maybe we can help the economy by putting our managerial, entrepreneurial and consultancy expertise to work.

LIN-06-190-50XXX PHILIPPINES EB3 not yet approved, awaiting assignment to Immigration officer

Topic: Folks who are waiting after RFE response, gather here...

Have been waiting for sometime since November 2007 when they received my response to RFE which was medical exam, TB test, they changed the requirements, TB skin test was required, history of positive skin test was no longer acceptable, so had the TB test done which of course would be positive as it has been several years back since 1995 when I was a J-1. Chest Xrays have always been negative, and of course, it is job-related, I am a registered nurse. Several service requests made, I actually had alerts in my computer and my calendar on when to call USCIS without missing a beat then got update in May 2008 that my case was awaiting assignment to an immigration officer. I called in August 2008 and asked for expedite and they said they do not do expedite for I-485.
The cruel thing is that I have friends who are in the same boat as I am and we filed earlier in 2006 than another friend of ours who filed late 2006 and got her green card in 2007. She did not even get an RFE. And come to think of it, she was the one who didn't really want the green card, it was her husband who forced her to come here so he could have a green card. All of us are EB-3 and from the Philippines, all registered nurses. She was the lucky one.
Someone told me that the reason the first in and first out rule is not being followed is that there are some corrupt immigration officers out there. Corruption is everywhere, not just in third world countries, he told me.
I hope that the Ombudsman does proficiency audits or I must have been watching too much CSI shows lately, especially the one where CSI was being audited for profiiciency and "sloppy detective work".
If indeed they do get a chance to require medical attention, I hope and pray that these immigration officers will be taken cared of by Filipino green card holder nurses who have come here to share their skills, talents and most of all, their caring and nurturing. Then they will experience that they do not have to wait, their needs will be attended to immediately.
