Thats exactly what happened to my wife. First they asked us to call a week or two weeks later. And you know what? Until now she did not get her's yet (more than four months since mine was approved). We called about 5 times, sent two letters to TSC, and went for two infopass appointments. In each time they ask us to wait for 30 more days and she should receive her approval!!
I think its all going wrong and nothing is predictable when it comes to dealing with USCIS. We just hope that we will not be stuck for ever. |

Your PD is not current so they can not approve your case. Most likely your case is pre-adjudicated and once your PD become current they will send you they approval. |

Their statistics are based on users using their LUD tracking system through igoogle which means nothing as they do not say how many I-140, I-485, I-130, I-129..etc applications are in their system. |

No one can tell you for sure how USCIS works and who goes first. But my recommendation that you contact the embassy yourself and make them aware that your PD is current as of March 1st and they can obtain a visa for you.

Actually the law [section 245(i) of INA] give amnesty all the time by filing I-485 supplement A and pay $1000 beside the $1010 application and biometric fees.
Section 245(i) of the Act allows certain aliens to file for adjustment of status upon payment of a penalty fee of $1,000, even though some of the conditions required by section 245(a) and (c) of the Act are not met. Aliens in the United States who have an immigrant visa immediately available, but who entered the United States without inspection, remained in the United States past the period of admission, worked unlawfully, or are otherwise ineligible for adjustment of status under section 245(c) of the Act must submit this form along with Form I-485, Application to Register Permanent Residence or Adjust Status.

Topic: 02/10 LUD on approved 140.
Lately there are many threads talking about LUDs that happen during weekend on already approved I-140 and I-129 and their significance. Many think that this is just a system generated LUDs and nothing actually happening. But in your case I can see on your profile that you got two LUDs on your approved I-140 and that fact that the second LUD triggered an e-mail from CRIS (which does not happen on weekend LUD) make me think that something is happening on your case for real. |

I been living in Boston suburb for almost a year now and I have noticed that in the New England area (MA, VT, NH, CT, ME and RI) there is a rising anti-immigration voice by some business owners and even some of them is anti-out-of-the-area hiring. They want local everything (agriculture, industry, healthcare ...etc). On the other hand at the level of mega biotech companies (which are abundant in the area) they fight to increase the quota of H-1B as their demand for employees exceeds what they can find among USA citizens. And believe me good luck for that company if they can fill all their vacant jobs with USA citizens only specially in that type of business. |
Topic: Name Check and approvals
As most of us here on Trackitt I was surprised with the recent news that I-485 will be approved if name check is pending for more than 180 days and all other security checks is cleared. When I came to my sense I realized that this will have for sure a huge impact on rate of approval over the next few months and subsequently the availability of visas for the rest of the year and probably next year as well. Per USCIS there are about 350,000 applications pending NC clearance. If ones assume that 1/3 of them are EB I-485 this will translate into more than 100,000 visas are required to adjudicate all of them. This will for sure make DOS to push back the cutoff date for the categories with higher demand. I would not be surprised if the cutoff dates retrogress for EB3 for all chargeability and probably EB2 for RoW (probably Jan 2007 as they did after July fiasco). This might not happen for the upcoming month as we are less than 10 days away from March VB and USCIS will not be able to request so many visas but for sure it will happen in April VB. I by no means want to put anyone down but the problem for most of us is not name check but rather the availability of a visa number!
