Interview Location:Miami, FLReason for Interview:
Interview Status:clearedInterview Experience:I arrived 45 minutes ahead of time, the officer took 1 hour after my time to do the interview only took 5 minutes to ask me what kind of evidence i had of experience, he told me he does not have the I-40 file and if i can give him all that i had, pay stubs, copies of I-485 file that i submited, copy of the files I-140 with corporation taxes, and letter of employment, he asked me what was my job then he told me the intention to approve it exist but i have to see all this evidence, and he wrote in the notice pre-approved just check list of evidence. Then he told me i always give a cortesy call 2 weeks before i let you know that your case is approved and that you have to bring your passport and 2 pictures to stamp your passport, wait for my call. And that was it, the only thing that i know is that he wrote PRE-APPROVED, and check list of evidence he took all the evidence i had with me. Seems like he never touched my file because he did not know how to proceed, and then i had to tell him my category was eb-3 bassed on expirience. Well that is all if you have some inputs let me know.

Topic: UN EMPLOMENT BENEFITS

***I have asked my lawyer about this few times and few different Lawyers and here is their point of view:
If you loose your Job during the process you must get re-employed in the same or similar, if you claim unemployment you are not public charge is a type of insurance that you and your employer paid for it. But in case you get rfe about Employment verification Letter, you must have one.

***The other question is What about if i am laid off after green card? In my case i got laid off after like month and the half of getting my green card, and I know few who have lost it few weeks after me, some a week after. Their answer is: It is not your fault that you have lost your job, so you can try to find one in the same or similar position (even after green card) or if not another job (it does not matter which) because in you application they qualified the intention. So your intention is not to loose your Job. So in few words they said USCIS and DHS knows about this economy and they know what are the risks, so as long as you lost your job not at your own fault, you are ok, to apply for US citizenship after 5 years.

"Unemployment is not public charge, but you must try to find a Job in same or similar as your application" once you do that you are ok. Praying for everyone to get green.

Visaindistress: Probably the question was not for me, but in my case i am not from india, but asylum can be base in race, religion, politics, even now there are some cases of domestic violence and sexual orientation. That is why is not just for one topic specific. But the person from India can answer this to you.

Topic: I had an interview today re I-485:

Your case is like mine. And thank God i had blessings and learned so much about the process. I had court and i confronted the worst judge in USA, Manson is his 2nd. name, and even when he has a bad reputation, he helped me somehow letting me stay in the country with some bars, like the only way to get my green card was through the process of labor certification

Topic: Interview at the airport for GC holder from NSEERS country

I have traveled 3 times as Green Card Holder and 2 times been delayed for verification (interview) the 1st and 3rd. time, and I know many that always got delayed or stoped, this is due to name match, and they want to make sure you are not the bad one, and the 2nd time that i have not been delayed i traveled with my Sister that is US Citizen and she was stopped to verify her identity since there was a lady with her first and last name that was criminal. And my brother in law who is US citizen born, has been stopped once and delayed for 3 hours, due to name match. So in few words there is not such thing as first or last time, you never know where you will get stopped and sometimes they will not even ask you a single question.

Topic: Why was my case transferred to local office?

***All the statements here can be true, but not immigration officer will tell you why, I been called twice in local office, first one was interview but the person never asked me anything, only did you bring the copy of the papers that i requested on the letter i said yes, he only told me, ok i have to check that every paper is ok, be ready with your passpot and 2 pictures i will call you and send you a paper, after a year and few months, i received the 2nd notice, and this time was bring your passport and 2 pictures, and this time the gentleman asked me questions like have you ever been arrested, are you still working with the company, the terms are the same? things like that. So basically I asked if he knows why i have been called, he says it is random and here does not say specification why you have been called, but they take random cases to local office to clear as many as they can in the main offices. Any ways until now i do not know any single case of been deny in local office

Topic: How long to work with GC Sponser

I asked my lawyer about this, since i was laid off 2 months after and he said that due to this economic situation there is not rule o problem i should confront at the time of citizenship, and i called 2 more lawyers and they agree on this, but one thing they said as precaution at least if you have to leave is between 30-60 days, if you really need to leave. But in this economic situation you never know, it is not your fault if you get laid off after the green card approval. The only thing you can not do during the period is take money from medicaid, medicare, food stamps or anything similar but you can claim unemployment benefit because is State law not federal and you paid taxes for it.

Topic: Strictly Interview FOLLOW UP experiences

I did not used any template and i faxed over, i called first and ask for the immigration help team, the lady gave me her name and fax, so I just put the whole story, about my infopasses, my calls, my first interview, I included in the letter saying that per infopasses i knew all my backgrounds were done, i mention that i did not qualify for 180 days rule wich was absurd and unfair for people who are in the same spot like me, i mention the officer who interviewed and each officer i had infopass with, i made a copy of each service request they have answered me, and copy of each infopass i have done, I request that if they please can talk to the Immigration officer who had my case to release it, and if they can request to supervisor to change an officer that whant to do the job, since i was waiting only for an answer approve or denny, and that i was in the posittion to receive any of those answer but no more delays. And at the end i put this. I authorize the office of Senator xx to write, talk, speak on behalf of my case with (local office name and address), and signed and faxed over. I got my senator by the zip code. on google. I got the phone from the office near me, and i called and they told me to send the letter, and i took the time to send at the same time all the papers i told you. Just treat your senator with respect and refer to immigration officer with respect but with authority on your side and i guess that will help.

Ok yes, and it was not the same officer, and every time i did infopass i request to change immigration officer that handle my case, i requested that to cisombudsman, and to my senator. In the infopass i got humiliated last time for requesting that but guess what, i got the officer changed assigned different to my case requested by my senator, 15 days later i got the call from the office of my senator telling me that a lady from the congretional unit was revising my case, i got finger print notice and then the lady promessed to the senator after she get the results she will take a decition, but I mentioned in the letter to my senator about the 180 days rule that was unfair for people like me and many other who have passed background checks, and why they do not have a rule for people like me and many others, and i mention what the rule consist, and why the officer did not want to make his job, that if i have passed all the necesary for the decition why they have not say approved or denny it. And please I request and beg for another officer that is willing to handle my case to take it, and remove officer xxx from my case. And Thank God he was removed. But i sent all the copies of request, calls i have made with date time, answer i got, and all the infopasses copies.

EbyptEB2 I am sorry about your pain, I got approved Finally and i was call again on oct 24th. The officer made me few questions only related to my file and i485 and the only thing he asked was, do you still work in the same place, and if everythng was the same, i said yes, and he got already stamped everything in my file, i only signed and he said i will stamp your passport, and that is it, i said Thanks and God bless you and he said you are free to go now. and I got my card last friday, And if i am not too ridiculous askin you when was last time you contacted your senator, keep copies of every infopass you make, date time and officer name and number of every call, and then write a letter to your senator, telling him, you have used him before, and then write to ombudsman, fire up.

Yes my date is current, and actually i renewed my ead before the bouletin visa came out, and it says that if an officer sees that there is no visa available at the time of your renewal he discrecionally will grant a 2 year ead.

God Hears you, for some reason i just ask myself why they are taking so long, it is much easier to say denied than keeping us in the limbo. But I dont hear yes i dont hear not, so i do nto know if my case is deniable, or approbable, i jjust remember the officer who interviewed me told your case is approbable. but i need to check few things but more than year ago,
