Yesterday, my status changed to:

New Card Is Being Produced

and the following email:

On September 19, 2015, we ordered your new card for Receipt Number SRC..., and will mail it to the address you gave us...

I didn't get the Welcome message yet, but I guess I have been approved.

Hi Legich,

I am just curious, did you received the message "Fingerprint fee received" or "Case Received" when you filled the application?

I have been following the October 2014's forum and it seems that DOL sends the audit letters when most of the cases of that month has been certified.

It is important to notice that if DOL continues like this, the delay for audits and clean cases will increase significantly. Nowadays, an audit means to wait almost 2 years, 6 months for a clean clase, and this is unacceptable. Image 3 or 4 years of wait time in order to have a response from DOL. They have to do something ASAP, either to stop doing audits for a while or to increase the number of officers.

According to icert website, on 4/20/15 there were 186 approvals:

- 2014: 113
- 2013: 72
- 2012: 1

At this pace, people are going to retire before they get their PERMS...

An audit final resolution needs the time to be reviewed but a random audit just need the time to be notified. That means that the remaining October cases would be...
7,700 - (30%) = 5,390
We have around 3,000 cases cleared, so there are 2,390 cases remaining. 300 cases per day makes around 8 days to clear the October 2014 inventory.
I may be wrong, but I think this is a realistic number.

I think you should take out the number of perms that will be audited (30-50%).

Can someone explain us this May 2015 Visa Bulletin for EB3 ROW?
EB3 ROW cutoff date is January 2015, but PERM is October 2014. Do DOS and DOL talk with each other? Why January and not Current? This is kind of silly...

And this is one of the stupidities of our beloved immigration system.

First, what is the reason to need medicals of people who have been living in the USA for years most of them?

Second, what is the reason to request a new medical exam after 1 year? Why does this exam expire? Are they scare that you get sick after 365 days?
It is nonsense.

Dear ColdFusion
I think a little of humor is good for everybody!!
By the way, I was right (between 6-12 m)!!!
It is fine to do maths with the data we have but you guys can not ignore human behavior in this process of advancing the cut off dates.
Congrats to all currents!!

Actually, according to various sources from DOS working together with NASA, EB3ROW will progress 200 years ahead. If you want to be current, you will need a time machine.

Seriously, I think it will progress from 6 to 12 months.

Topic: Best education evaluation service providers

The term "professional" is defined in Section 656.3 of the PERM rule,

"Professional Occupation means an occupation for which the attainment of a bachelor's or higher degree is a usual education requirement. A beneficiary of an application for permanent alien employment certification involving a professional occupation need not have a bachelor's or higher degree to qualify for the professional occupation. However, if the employer is willing to accept work experience in lieu of a baccalautreate or higher degree, such work experience must be attainable in the U.S. labor market and must be stated on the application form. If the employer is willing to accept an equivalent foreign degree, it must be clearly stated on the Application for Permanent Employment Certification form."

I am sorry that the things didn't work out. I think the rule is that the job position is a professional job if it is listed in the Appendix A of the law. It doesn't matter if the alien doesn't have the degree because the company can state in the form that accept experience instead of a degree, but everything has to be done as a professional position with the 3 additional recruitment steps. It seems that this is what happened to you.
Good luck.
