obviously this is total BS and some screw up along the way. What does that even mean background check didn't clear. Are they saying there is something in your past that's a red flag? More likely they simply didn't pass on your info to the FBI and it was never done.
The question is, since Eb3 became U, you are stuck until October 1st anyway. Do you have a secure job at this point? Can you hang in there until Fiscal Year 2010 starts? That would give you plenty of time to resolve the crap they've been slinging at you.

well, IMHO, this is just window dressing for the upcoming US-Mexico Summit. It will be forgotten just a few months down the road. There is no way he can tackle this rotten issue without spending loh-ots of political capital. CIR is not happening unfortunately. The best we can hope for is increased visa numbers, temporary or permanent, to flush out the backlog. The May bulletin isn't totally surprising. My opn labor certification got backlogged from 2002 to 2006 because of the April 30th 2001 fiasco that benefitted illegals. Of course these people were still in the system.

you say you want to become illegal but you don't want negative posts, how about reality check posts. Look I completely understand the mental pressure as I've been there, but if you can't sleep right now because of maintaining your EAD/AP status, how do you think you'll be lulled to sleep being illegal running the risk of being picked up by ICE and deported. You say you don't see a chance of getting your card in the next 3-5 years? if you become illegal you'll turn that timeframe of not getting your card into indefinite. Also, if you count on amnesty, in the past it was granted mostly to those illegals who had a track record of paying their taxes, just fyi. that is why their is no coordination between USCIS and IRS.

It depends what your definition of backlog is. If your AOS has been pending for half an eternity yet you aren't current, (retrogressed that is) wily USCIS doesn't count your application as part of the backlog. So you can rot forever and they can still achieve their rosy processing goals.

trick? I am just doing a translation and if I go to the dictionary and plug in the German word neuronal, it spits out the english word neuronal. But when I google neuronal network, it asks me, do you mean neural network? And when I go with that to wikipedia it talks about biology and nerve systems, but I need the IT context. So I got confused.

hi Lrindy - I am aware. My question was more related on the pending 180 day rule of the AOS petition. It seems nonsensical to allow peole to change jobs before getting the green card but not after. It would make much more sense to issue a green card really fast after starting to work for some employer that becomes conditional. Meaning you get the status quickly but then have to work for that employer 3 or 4 years.

Also, I read on a Gotcher forum at some point, that one is also safe if one remains in the same /similar category of the labor certification. Just immediately changing careers after GC is an issue.

On a different note. I never quite understood why they let you invoke AC21 to a new employer when your 485 has been pending for over 180 days, but once you get the card, you should wait several months as that change can cause future trouble during a potential citizenship petition?

well you haven't filled out your profile so I don't know. But I can guess you have initiated your Green card proceedings. Without them H1B is 3 years, another 3 possible , 6 maximum, not enough to achieve credits. That's why I said "purely" on H1B
