Have received past weekend "Welcome Notice" for spouse and myself.... Now waiting for cards to arrive.

Topic: AP approved for primary applicant but not for spouse

I have applied for my wife and myself in Nov 2008. I received approval within a month, but still waiting for my wife's. Called (and so did lawyer), but according to USCIS representative we can only open SR after "6" months of filing ... although we mentioned Processing times are showing 3 months, representative said we would need to wait, as processing times are just estimates ... Again lawyer received same response.

Unbelievable how rules are changed and we cannot do anything about this situation....

Topic: AP Filed in Nov/2008 for spouse and not yet approved

I have filed renewal of AP for spouse in Nov/2008 but have not received approval yet.
(I have sent my own renewal, back in Nov too, and was approved within a month).

Contacted NSC but according to them would need to wait up to "6 months" to open a SR on AP processing as their announced processing times are just "estimates". My lawyer got the same response when calling.

Now we have a trip abroad scheduled for July/2009 ...

What are the options to expedite (if you can call this "expedite") the AP approval? Thoughts?

Topic: Spoke to IO and case is has no pending items ... sent to supervisor?

Talked to an IO a couple of weeks back and according to her my case (and my wife's) had nothing pending and she mentioned she would forward them to a supervisor ... What does it mean?

"If" she did actually send/forward cases to a supervisor, has anyone been in same situation that can provide an average time for case to be approved?

My H1B VISA expired in November 1st 2008, and Extension was mailed end of October (2008) but receipt / notice dates are as November 4th. Does USCIS count the mailed date or receipt date to determine gap in employment authorization?

BTW, I already have a valid EAD but I am still using H1B for work.

Topic: Anyone with old priority date (ROW) which was affected by BEC?

My I-140 was not premium, but regular processing. I also noticed that all who responded so far filed I-485 (on or before July 2007 Fiasco) ... I was wondering if there is anyone in similar situation as mine who, because of BEC, was forced to file after July 2007 (in my case Dec 2007) as they did not certify my case until the very end :(

I wonder if there is anyone with old priority date (ROW) which was affected by BEC... In my case, my Labor was only certified back in October 2007 (after July Fiasco)... I truly believe they lost my papers as attorney never received actual approval, but it was certified in their web site. We have filed I-485 and I-140 without issues (and I-140 was actually approved).

But due the fact that VISA numbers only opened later in 2007, my file and receipt dates were of December 2007... that is, even with priority date 2002 (ROW) I have not received the magic "email" from CRIS. Worst is now, July filers will be processed before me as "receipt date" is what matters to USCIS, not "priority date" .... Anyone in same situation?

Had my FP (code 3) taken on July 1st as my EAD has been pending for over 180 days. Went to INFOPASS and was directed to take FP again (and photo). Do not see any LUD on my application after FP, though. Is this normal? Anyone in similar situation?
