Topic: H1b expiring Sept 2013- PERM still in process waiting approval

Posted by another tracker.. Helped me figure my case was denied (employer portal still shows case pending)... hope it helps you as well!

1. Go to the following link to see if your A number shows up. Just enter the A number and Search. No need to select/enter any other information. If you get your case then congrats, you are lucky!
http://icert.doleta.gov/index.cfm?event=ehLCJRE...

2. If step 1 fails, go to the following link and click on the "Disclosure Data" tab. Download "PERM_FY2013_Q2.csv" and "PERM_Case_Data_FY2012.csv". Search for your A number in those files. If you find your case here, then check the status and act accordingly.

3. If step 2 fails, go to the following link and enter your employer's name in "Employer/Respondent" field and click "Go". If you find your case here, you have a tough luck as your case is in BALCA and it will take couple of years to clear. You can get your H1 extended without any problem but you have to be patient with your PERM process. So check for alternatives.

4. If step 3 fails, put a FOIA request with DOL as I did. Check the following link for more details.

I really really hope this will help you find more details than you currently have about your PERM labor... Good luck!

Is it possible for the new lawyer to file tomorrow? What about the steps involved prior to filing PERM? Working on PERM 2 sounds like a good option as mentioned above.

Thanks for the Info. Where can I check if my case is in BALCA link? My employer is also starting an alternate PERM( still not filed). Hopefully, if I can get the extn. based on either PERM pending or PERM appeal, It will help me stay in H1 status. My 6 yr ends Sep 30th, 126 days recapture time (which is now filed under premium) along with this my employer filed PERM pending 1 yr also. Fingers crossed and waiting to hear something on that.. once I get H1 extn for 1 year, the new PERM can help for another extn. if required.

Can't really do much without knowing your case #. Ask your employer to provide the same!

At this point the links only help understand your PERM status better. Spread sheet is pretty simple, if you can do CTRL+F (find) and enter your A#. Hope this helps

I hope something miraculous like this happens in my case as well. Data from the links below shows DENIED. But my employer portal still shows pending.

Hmm... I saw the data from the same spreadsheet where I saw my A# denial. Looks like only my application was denied in around 7/8 applications filed that week. Saw a couple DENIALS from last year. But, at this point since his portal is not yet updated. If we can take advantage of that and get extn. I'm good! All I need is Jan - Sep 2014 of H1 time, doesn't matter if it comes from PERM pending or PERM appeal. May be I'm being very optimistic about H1.

I will make it a point to update the status of application regardless. Need some luck!

I did send him the spreadsheet details.. He said either ways DOL should send out some notification or update the portal with DENIAL. As of now it is in PROCESS. We plan to appeal and buy sometime if the H1 RFE gives us the details of PERM denial. Also, the plan is to start another PERM in the meantime.

He sent me the screenshot.. I would trust that! Based on the pending status they just filed for H1 extn 126 days of recapture time + Pending PERM. I'm hoping that we get to hear something on H1 (applied Premium ).

Hopefully 16 months.
