Topic: how fast is infopass?


I have to have tickets to get the stamp!!! I thought it's my right to get the stamp if I wish?? well I guess I can get a ticket to canada... where in uscis.gov can I find the appts dates?



What is the rush to get the stamp if you are not going to travel? Chill, and enjoy your new status as PR. Your card will arrive in a few days so unless you really need to have it now then why go through all the trouble of Infopass. They will not stamp your passport now unless there is a compelling reason.

I just re-read your profile and you have no information in there. Your comment suggests you are not yet even approved for I-485. What is your real status, have you been approved or not? If not, it could take a long time still before the approval arrives and you should apply for AP to allow you to travel. AP seems to be getting approved and issued quickly now so that may be your best option to travel.

Topic: I-131 Advance Parole - Date Extended by Customs Border Officer?



One thing I am not sure about - what would happen after the parolee status expires? I surely hope I would have my green card in hand by April 2009, but if not, do I need to do anything to extend the status, or would I be fine as long as I stay Stateside?




The parole status expiring is not a problem so long as you stay stateside as it really only indicates that the last time you enterred the US you did it legally. Your status is considerd AOS while you are waiting for your GC. If you want to travel then you need a valid AP document to get back in as the stamp in your passport from the last entry will not do it if the paperwork has expired.

Topic: Question to those who filed AOS based on Employment and Family?

Nov 2005: Applied for EB AOS
Sept 2006: Applied for family AOS as I was made redundant. I referenced the EB AOS in my family based application.
Jan 2007: Received a letter on my EB AOS saying the file had been transferred to Boston as that was my local office and they would be processing the case (it was originally filed in California).
Feb 2007: Family AOS interview (I-130) in Boston.
April 2007: Called into another interview in Boston that went through my EB AOS and just verified I was still working and that the details in the application had not changed materially. I say this because I had actually changed company and role but they did not seem too concerned, only that I was still working and earning a similar salary.
June 2008: Asked to go back into Boston to renew my fingerprints on my EB AOS.
July 28, 2008: Received letter welcoming the new Permanent Resident based on my family AOS

I am now waiting on my GC arriving. My approval is family based. I don't know what is happening with my EB AOS, and I don't really care anymore.

It has really gone smoothly other than the huge wait for my FBI NC which started in January 2006 and I assume is only now cleared due to the recent NC memos.

But to answer your original question, the last LUD I received on my EB AOS was in January 2007 when it was transferred to the Boston office. However, the last LUD on my family AOS was Feb 2007 and nothing at all until the welcome letter when I got a hard LUD the following day.

Finally I am Free!!! :-)

I feel slightly elated after a huge wait but still unsure due to the wording of the email I received on 7/28. It went to an email address I seldom check so only spotted it today. I still do not have the letter referred to in the email but wondered if anyone knew what ADIT was....?

W4EAl is right and all Family based applications go to the MSC. I looked at your profile and you are family based so that is where yours has gone. Any activity (interviews etc) will be doen through your local office and if you want to check at the uscis.gov site for the processing dates you need to check your local office dates (NBC does not list I-485 processing times).

You may also want to start reading the 'Family based application' forum as this will likely have more relevant information for your case.

90 days is the usual time for having to wait for anything to happen before contacting uscis again. It is likely your details are just pending further processing. If it was anything bad it is likely you would have received an RFE (Request For Evidence) and would have to get some more information for them. As that has not happened then I would feel positive. uscis is one big waiting game however so you just need to be patient.

If you do want to try to find out then call the service centre, if you get a good agent then you may be able to find something out, more than likely though you will not get anything useful so be prepared for that.

Can you Add your Case so that we can see the timing of your application and help better with advice on when things may start to happen.

As far as being in the US legally, as long as you have a receipt notice for your I-485 you are now legally in the US under AOS or Adjustment of Status. It does not matter that your visa has expired, and once you get your EAD and AP you should be able to get your drivers licence and travel in and out of the US without any problems.

Three things you can do to try to find out what is happening:
1) Go to the uscis.gov web site and add your case informaiton online (you need your receipt numbers to do this). This is teh least useful but may help but it is often a long time before the system will recognize your receipt numbers and let you set it up.
2) Call the support line number - but don't expect too much informaiton, particularly if you have not been waiting very long (typically needs to be 30 days beyond the processing date for your application, but sometimes you get a good agent who is helpful
3) Setup an Infopass for your local office and go and speak to someone about what is happening. This is usually the most useful, but again normally only works well if your case has been pending for a while.

Good luck, take it easy and enjoy being able to hang around for now - most of us don't ge tthe chance to do that until we retire, and that is too long away...... :-)

Topic: second interview notice

There are some other threads regarding second interviews. the majority of people seem to get approved during the second interview and then the GC sent out to them a few weeks after the interview. However, at least two that I am aware of have been given RFEs and are still waiting on further updates from uscis despite having sent in the requested information.

So, it would seem to be a very good thing to get a second interview, but it is no guarantee that you will be approved.

Sorry to hear about the ordeal the IO put you through, they seem to be really making it hard for anyone who has been in NC for a long time. I hope you will now respond with your birth cert and get approved quickly.

How long after your second fingerprints before being called for an interview? My NC has been pending since January 2006 and I can get no confirmation that it has cleared, even with Infopass. I was called in for second FP on June 26th and I am now wondering what next.

I went in for an Infopass last Thursday 26th June and it was a waste of time. IO gave me no information and just stated that the NC should not hold up a case being adjudicated now (NC now pending 2yrs 5 mths). He did give me an official inquiry form to complete and I may here something from that, but I am not holding my breath.

NBC is where all family based applications are sent, even though your local office does the interviews etc. To check the processing times for an I-485 at NBC you should reference the processing time for your local office. For example, my case was also sent to NBC but I have been told to check the Boston local office for the processing time. That gives you some indication on progress unless you get hung up in NC or something similar.

Your lawyer is just trying to avoid doing excessive work on your case and trying to spread the workload out for the different cases your lawyer is probably handling. There is no law which says you can't call the uscis everyday and ask to get a SR opened. However, USCIS logs each call on your case and if an SR was opened then they will tell you to wait for at least 60 days before calling again. If your first call did not generate an SR then you can call anytime and ask for an SR to be opened.

Topic: Green Card before EAD card

Hi Superhero,

On the EAD, I don't have any real detail but have seen a few postings mentioning applying for EAD and then getting GC. It seems that they will continue processing the EAD right up to the point that the GC is approved and production of the card ordered. What this means is that the check for the EAD will be cashed and you will not get the money back as they have had to do the initial processing. Obviously, if you do get your GC either before or after you get the new EAD then the EAD becomes invalid and your status becomes tied to your GC.

I go in for additional fingerprints on Thursday 26th and will get Infopass at the same time, but don't expect to find out anything new. Similar to you my last fingerprinting appointment was back in December (6 months ago) so they are obviously disconnected in what they believe (my appointment letter states 15 months since my last fingerprints).

If you have not received your new EAD after 90 days from application you can request an expedited EAD and they should issue one immediately. Call uscis, but you may need to make an Infopass to ensure things are pushed through for you. Read the instructions for the EAD form and it outlines this process there.

Thanks for info Goblin. Nothing surprises me too much these days with uscis. I still get really stressed at times but mostly I can just go with the flow now. I'll set up an Infopass for just after my FP appointment and see if there is anything new they can tell me - although I doubt it.

I have had everything approved and was waiting for NC to complete. When I got home tonight there was an appointment notice to get my fingerprints taken again next week as those on file had expired. This is the first sign of any activity since my last soft LUD on 2/19/2007. Does anyone have an outline of what typically happens next for someone in my situation?

NC started: January 2006
I-140 Approved: Feb 2006
I-485 transfer to local office 16 Jan 2007
3rd EAD: 19 Jan 2008
3rd AP: 22 Nov 2007

Last time I called uscis (May 19th) I was told to call again in 30 days and they would (as usual) give no information on my case status. As far as I know my NC is still pending, but based on the recent memos that should not matter or it should be completed.
