if your labor is stating education as Bachelor or Equilant and
Experience required for the job is 2 years.
you can fight based on these two in MTR that your case should be considered in Skilled Worker Category. not Professional EB3 category. i hope it will save you. file the MTR asap. |

i changed my password today and CRIS change of password email came. Email was not working at all since last two months so that looks like they have done some thing to fix. I saw in some other thread that some people got change of status email also today. just sharing this information. nothing really helps to any one. |

in appeal mention that we filed under skilled worker because if LC job requirement does not state taht require experience for job is 2 years, then USCIS consider it EB3 professional and they do not approve 3 year degree. So in that case you must write in appeal that you filed your case for EB3- Skilled worker category. Under skilled worker category there is not a single degree requirement. |

i also got the USCIS letter copy last week from lawyer stating that they are processing cases Januray 2007 so my case is not outside of processing dates. in letter they mentioned online status is not current and has errors in it and they are working to fix online status errors etc. very strange letter response. any way i am going to call this week with my Employer to talk to some IO on the letter as it does not match with processing dates published online. i will update here about the call with USCIS IO this week. Did every one on this thread got the same letter? |

any one opened SR on 10/21/2008 has any LUD yet? Looks like NSC is not working on these SRs at all. I know we will have to wait till end of November on these SRs due to USCIS response time of 30 to 60 days after SR etc. but i want to find out if any one has got LUD from earlier SRs. we noted only some of them but most of us are without any Lud yet. |

vyerra___on this tracker, only two people got soft luds yet. One got approval yet. However you are lucky that your case is having Luds and it should be an approval in a day or two for you. stay positive. |

i has SR created for my case on 10/23 for pending I-140 and just now i got LUD on approved I-129 case which was approved in May 2008. i was wondering that why they are touching my I-129 case. does any one got such experience. |
