An alien cannot apply for H1 status, only an employer may petition on your behalf. If you have an employer willing to sponsor you, then there is no problem with that as far as I know.

In your second post above, you expressed amazement that nobody had responded to you about an RFE which you (and by extension, the rest of us) don't yet know the contents of. Thus you invited the flurry of pointless speculation that Trackitt is known for - I say pointless because, again, nobody knows the contents of your RFE. You finally express frustration with the speculation process, even though there is nothing anybody can do on a thread like this other than 1- ignore it (which amazed you) or 2- spill out random guesses (which annoyed you).


This is just another example of why it's better for people to first receive their RFEs before asking for help on them. I hope you'll agree.

Please discuss with your attorney, If you depart without AP or valid H1/L/F visas, your AOS will be consider abandoned.

You need your AP approved before leaving the country.




Correct - your wife's AP *MUST* be in hand before her departure. If she leaves before it is approved, her I-485 will be considered abandoned. Mailing it to her after she leaves will not help.

Furthermore, she cannot use her F visa to return since the F status is *strictly* a non-immigrant status; a holder cannot be allowed to have immigrant intent. If somebody who has a I-485 pending shows up at the airport with an F visa wanted to enter the US, they will promptly be denied entry since the person is clearly an intending immigrant, which is not allowed under F visa rules.

Your only course of action is to wait to get the AP in hand before she leaves. Another course is if you are now in H1B status (your most recent I-94 is H-1B and you are still working for the same employer with valid H-1B documents), then your wife can leave without an AP and apply for an H-4 visa to enable her to return. The H visa is a special "dual intent" visa that allows somebody to apply for a green card while still maintaining non-immigrant status. But if you are not in H-1B status (i.e. you are working using an EAD), her only choice is to wait for the AP before she leaves.

It is unpredictable what your LUD means - since a senator's inquiry might or might not cause LUD and a name-check completion usually does not cause an LUD... All one can do is guess or speculate...

Topic: Expiring passport with valid visa

Make sure the embassy/consulate people make a note in the new passport that there are unexpired visas in the old one.

I don't believe any passport-issuing authority makes such notes (about visas) on newly-issued passports - as the others above said, one would need to carry both passports and there should be no problems. It's not that complicated!

Given that my EB1-EA was in fact employer sponsored, does that change anything regarding my ability to take another job during the GC process.



No, EB-1A is not employer-sponsored. Your employer may be the *petitioner* and perhaps the *payer* of the application, but not a sponsor in terms of labor certification because there is no such thing for EB-1A. Therefore, you are not bound by your employer or AC-21 as far as USCIS is concerned. However, if your employer paid for your filing fees and/or attorney's fees, be sure they will let you leave without having to pay the fees back. And also make sure any other job you take is in the same area as your petition is based on. Other than that, you don't have to worry about USCIS.

Topic: Can i travel to london

No, the GC will absolutely not serve as a visa. You must separately obtain a UK visa from the British consulate.

However, if you have a GC, you may not be required to obtain a transit (airport) visa for the UK as some nationalities (like India) are required to. But if you actually want to enter the UK, you must obtain a separate visa.

Only Canada, Mexico, and Switzerland allow GC bearers to enter their countries without a visa for nationals who would otherwise need a visa.

Topic: NSEERS - confused - got RFE


I have received RFE on my EAD renewal. A letter mentioned following "You failed to submit evidence with Form I-765 to indicate that you have filled Form I-485. USCIS records also fail to establish that you have filed Form-I485. Please submit evidence, such as a photocopy of a receipt notice, to indicate that you have previously filed Form I-485, and that it remains pending."

Which document should I submit in response to this RFE?

I will really appreciate your any response on this.

Please note that this is unrelated to the topic of this thread. The answer to your question is in the RFE itself: a photocopy of the receipt notice !! Did you not mail it the first time? If you did, they might have lost it or something, but it is required that you include it with your application, so just send it again.
