According to Law, Employers cannot collect H1B Petition Fees and Perm Fees. You shouldn't be paying the H1B fees and Perm Fees by law. Its just some shady talk between you and your employer. You can pay the I140 fee though.

Forget about Lawsuit, Your Employer couldn'nt even say to anybody that he asked you to pay for H1B and Perm fees.
But if he has your money, He will give you Pain.. (He will not pay you).

And Your friends lawsuit that you are taking about must be for something else..
