Topic: USCIS Memo regarding retaining the priority date even after employer revokes approved I-140


PD2000/Permie ..I have a situation . can you please provide your thoughts...

H1 - Currently working is with company A and Company B is GC sponsor for future employment and no H1 on Company B. 140 approved and 485 Pending for more than 180 days. Company B went on a merger/sold out recently and I have the following questions.

1. If I invoke AC21 will I automatically be swapped to EAD and lose H1 status?

2. If I dont invoke AC21 and leave everything as it is what will be the effect?

3. Does Company B have any control over approved 140??? ( as they were already sold/merged)

4. Now company A also started proceesing Perm etc..Can these two run simultaneously??

Please advice the best option.

From now on, don't hijack someone else's thread. Start a new thread if the topic is new....
1. "Invoking" AC21 is just letting USCIS know by a letter that you intend to work for someone else when the GC is approved. The process continues. You don't have to use EAD or lose H1 since GC still is for future job.

There are tons of threads on AC21 itself so you can read about general stuff... There are also threads about mergers - use the google search option up top. They still have "control" over I-140 but you are safe since you are past 180 days.

Do you have a copy of the approved 140?

Is the new Perm from Company A retaining the priority date of approved I-140? You can do that and to me that is the best option.

Did your lawyer reimburse her fees? Isn't this the kind of stuff for which she is being paid for? You are doing her job and paying her for it.

H1? what H1? Who wants an H1? :)
Use your EAD for a week. Or ask your wife's new employer to extend the join date by a week.
If you got emails on the 7th, you should have the green card in hand no later than next Monday.
I got an notice welcoming email on the 2nd, approval notice emails on 7th and the actual cards arrived in mail on 7th. So Nebraska seems to be pretty fast once it's approved.

How did the employer agree to file for GC then? Ask them to at least give a letter showing the actual hours that you intent to work.
Consult with an attorney. Find a job in a similar field and see if you can use AC21.

I can almost guarantee that you need an empty page in a passport with atleast 6 months validity to get any stamp. You can take an infopass and confirm.

I will update it for sure when it is approved. You're right, my only option it seems like is to wait. I've seen people waiting a month and some 6 months. What's more accurate?



OK. Am I the only one missing something here. You cannot get a I-551 stamp unless your application is approved. Once it is approved you may get your card in hand in as little as a week. So why are you talking about I-551 stamp now???????

The law is the same for H1 as well. You may not have carried the papers nor might have anyone asked for it, but you are required to carry your I-94 with you at all times. I carry a photocopy.
