Topic: NSEERS - confused - got RFE

Hi NSEERS,
I am also a Citizen of Bangladesh and get my 485 approved in OCt, 2008. After my first entry to US( 03/2000) I renenter US three times, once from Bangladesh(01/2003) and other two time from Canada(05/2004 & 10/2005 I have Canadian PR)

When I went to the Federal office in San Diego, CA in 04/2003 for Special Registration the office strictly told me that I am not subjetc to Specail Registration as I my last entry to US was after September 2002. I think they consider this date as a cut off date. Some of other friends also need not to do the special registration.
I know at leat two cases( citizens from Bangladesh entered/rentered us after Sept ,2002) where they obtain their GC without any interview and questions about special registration.
Just keep your fingers crossed

Topic: Removing H1 petiotion after GC approval

I received my green card end of OCtober. I also have a H1 renewal petition pending in California service center . Is it necessary to withdraw the H1 petition or it will be taken care of automatically?

Topic: travelling on AP without a job...?

Hi my1234,
I have seen couple of your comments in different threads. None of them are really helpful to anyone .Most of them are negative.
We should nopt comments on anything without any real experience

Topic: After GC - todo OR to know

Thanks for your list of To Dos.
When we submitted our tax return for 2007 my wife did not have an SSN and I used the TIN. She got her SSN end of August. DO you think we can still claim the stimulus for this year?

Topic: RFE anyone?

WantGCBad,

Why don't u rename urseld as BADWANTGC. I have seen ur comments in couple of different thread .All are kine does not contribute anything to anyone.

May be you r very much frustated with ur GC process!! But that does not give you right to be rude to other peoeple. It is true that sometime people even ask very dumb question but who can always be very smart in their whole life?

Take it easy and be happy.

Topic: Can TCN come back to US with AP?

You said that VISA is checked? What does that mean? - US Embassy put an Ink mark on the US visa. If that is true I think they cancel your visa. Probably in that case you can not use I-94 as it has been cancelled.

Topic: Can TCN come back to US with AP?

For Canada I know for sure, if you go there for visiting puprpose we can reenter US using your valid I-94 within 29 days of your exit from US. They call it automatic visa revalidation. I did it for myself in 2004. I was in F1 at that time. For caution you may ask US immigration to stamp your passport with an Exit Seal.

Topic: Any benifit of doing all the work ?

Offcourse it has benefits. With EB3 you are not even current. But EB2 is current for you. Once you have the labor approved you can apply for i-140,I-485,AP and EAD altogether. There is a pretty good chance that you will be approved within 2009(depends upon your namecheck and background clearance). But that is also true for EB3. If I were you I would go for it.

Topic: Is the notice welcoming new resident mailed to your attorney or your home?

Yes. We also received the courtesy copy and attorney recevied the original. Is there any necessity to have the original in my hand for any future purpose? I already have my GC card in my hand

Topic: STARTING A NEW COMPANY

As soon as you use your EAD you are no more in H1. There is no way to use both EAD and H1 at the same time- as per my attorney.

I do agree with soonGC. As per my attorney as soon as you have used EAD you are no more in H1 (or H4) status.
