Hi Sasssk,

I don't know what will be the rules and regulations for h4EAD but I believe those will be most likely same as L2EAD. L2EAD applicants needs to go for biometric in USCIS center after that you can travel internationally.

Our I485 is denied now and just one day before denial of I485 I got may L2 based EAD. Phew! At least it saved my job.
Our current I94 is valid until end of Sept2016 and by May 2017 we will max out on L1A and L2.
Now can you guys please help to answer these questions

1. What can be done to ensure continuity in the US after L1A max out. If we decide to apply GC under EB2 on L1A at the start of 2015 and h1B in consular processing, then in this case when does my hubby need to change his status from L1 to H1 and be eligible to get H1 extension as well. Will it work out?

2. And can we still refile under EB1C also?

And also please shed some light on the questions asked in my above post as well. Looking forward to hear from you guys. Thank you.

1. How does a company sponsor H1B visas? Does a company sponsor visas for specific job titles only?
2. Is it mandatory for a company to hire a W2-hourly salaried employee as a full time employee after being worked for an year in the company due to Obamacare?

Hi,
First of all thanks for taking out your precious time to reply back to me. I really appreciate it.

1. I do know some of the information/clarifications that USCIS asked for in I-140 rfe earlier. Immigration team sent the rfe response and after that employer received I-140 denial. I know for sure that Education and Ability to pay (company's annual revenue is in 2 digits billion dollars) are not the reasons for RFE/denial. I just want to read denial notice and hopefully I will get to read reasons as well in that notice. Immigration team interpreted the reasons in their own words and shared with us. I do not want to plan future actions going by the words from immigration team. I want to understand from USCIS perceptive. I want to know what exactly went wrong in the petition and what we can add more to refile or we should not refile if we do not have certain documents to prove. I want to understand from the lawyer what documents exactly we need to add in petition. I want to hit the bulls eye this time or never look back again.

I do not have any intension to share any confidential details about company or any notice with outside attorneys. I just want to take outside help to understand what additional evidences need to be collected to prove about primarily managerial role. I want to know what USCIS look for in the petition that candidate is best suited for eb1C category.

2. Employers immigration team said that I need to immediately stop working in case of denial of I485 which they think (could happen at anytime) immediately follows with the denial of I140. But status of I-485 is still in process and on top of that our EAD and AP renewals are also approved.

3. Regarding your suggestion not to work beyond 180 days I agree to that. Keeping my fingers crossed that at least I should get L2 ead fast before I loose my job. After 6yrs of huge career gap which I took for my child's well being I started to build my career back again in USA. With my determination, hard work and struggle I manage to get settled in this industry and currently working for G*****. I do not want to loose this opportunity. My L2 EAD expired at the end of Sept and I filed for renewal in October. My GC ead is about to expire in the month of Dec but my renewed GC ead is approved. I hope I do not need to use that and my L2 ead comes fast.

Regarding FOIA, will my husband's employer come to know that he requested this information from USCIS? I do not want him to get into any kind of trouble due to this, keeping in mind that he is working for them.
My husband do not work for any of these Infy,CTS,T** etc companies. His parent company is based outside India. So I do not have any idea how these companies file their immigration cases. But yes I agree immigration team simply copy and paste of every case. I can say that because from the final draft that immigration team created my husband found out 3,4 mistakes and one of them was that in one sentence there was another person's Surname in place of our surname. Can you imagine in the final draft that they prepared to submit these many mistakes. Of course they just care about getting their salary and do they care whether employees get visa or not. And they can very well get away with it by saying that what we can do if USCIS is saying that case do not fit under their regulations.

Thank you so much for your reply. Yes as you said there are many loose ends I need to tie them together but have no idea where to start from and where to go. I am still in a learning phase understanding immigration matters of course trackitt has share in it. All posts here help to understand and reveal many unknown things. May be soon I can change my profession from IT to immigration expert, Haha just kidding! My husband has already gave up his hopes. I am the one who is trying to save the sinking ship now haha. Its not life and death matter, but my nature is like that don't give up. I do like to fight till end and try to do all possible things to overcome any problems that comes as hurdles in our life. May be we will be able to get success. Your last sentence is just like our parents. Both my parents and in-laws said try your best one day everything will fall in place, just have faith in god. I am just frustrated and upset because of the emotional roller coaster ride we went through right from first visa extension which many of us might have experienced here. I have seen lot of hatred about EB1C category in general here so initially thought not to discuss denial reasons but then thought that its possible may be I will get some helpful advice. Denial reason for I140 is that USCIS thinks the role he had performed abroad was not primarily managerial role. My husband has 15+ yrs of experience working in IT industry out of it 10+ yrs working in a managerial role. When he joined this employer 8yrs back he joined with a designation of Project Manager only. After his joining company filed for his business visa as well as L1B to keep it handy. With the previous employer he used to travel other countries Japan,Uk,Singapore etc but never visited USA. That time not even in our dreams we thought that one fine day company will ask us to go to USA and we will ever file for GC. The reason I am stating this is because employer's immigration team said that for L1B company presented documentation to the consulate describing his role in India as technical. Reality is that at that time he was performing Technical Architect as well as managerial role both but no managerial job duties were mentioned on the petition, now for the same role stating that it was managerial it is extremely difficult to explain it. We converted L1B visa to L1A later.
The company he was working in India was small sized company after we came to USA company got acquired by the big company around 70K+ employees around the world. Due to the migration of email accounts, and many more changes sitting at USA we do not know if we will ever be successful to recollect 4.5/5 yrs back data of multiple projects that my hubby worked on. I do not know what evidences we need to collect also.
Company has his own immigration team they do not hire any law firm. Immigration team is just a waste they do not spend time on individual cases, until now they filed rfe responses for all matters on last day. They never bother to check documents until last moment and then ask for more documents in the last few days before submission. I do not blame them alone we trusted them and didn't take any outside help just forwarded same L1A documents for green card application. But since all things are not transparent regarding I140 application it is difficult to understand how to put up our case strong.
Company name that my hubby worked for in India is also changed twice and the company name under which he had transferred to USA is also changed twice due to company's mergers and acquisitions. In the rfe officer asked to establish the relationships between the companies under which my hubby worked for at abroad and in USA. Immigration team didn't review the petition properly for the consistency of the information that USCIS has with them for L1B,L1A, and I140. I am sure his employer's immigration team must have made many mistakes in the petition without reverifying all the information for consistency.
He got transferred here as a senior manager. All the projects he handled/managed so far are extremely technical projects the resume that he submitted earlier also shows that. I don't know if this is another reason that uscis thinks that his position is not primarily managerial. I do not know all and exact reasons of denial. Since employer do not share any information or actual copies of rfe/denial notice etc we feel like helpless.

Do you think raising FOIA request will help me to get the denial notice? I am looking for expert lawyer to explain our case and see if there is any point in refiling the I-140 petition under eb1C and what things need to be taken of in proper filing of petition or any additional evidences that we should collect etc.
Sorry for the long post. You asked for the denial reason but my initial question is not yet answered.

Our I -140 based on EB1C category got denied in the month of October. I-485 is still in pending status.
My husband who is primary applicant never used his ead but I am working on GC based EAD.
We got our L1A extension approved late because employer choose to respond lately to L1A RFE as GC was in process.
Immigration team respond to RFE on the last day of RFE submission date. I140 got denied and we asked to upgrade L1A extension in premium processing, and it got approved. But because of all these thing I couldn't submit my L2 EAD extension in time. My L2 EAD is expired. And I filed for L2 EAD renewal at the end of Oct which is in process.
I am currently working on GC based EAD which is going to expire in the month of December. We filed our EAD and AP renewals before I-140 denial. And Now after denial of I -140 still uscis approved our EAD and AP renewal.
Me and my hubby we both are IT professionals. In the above mentioned scenarios
Is it advisable/legal to use this renewed ead and continue working until I get my L2 EAD in hand? Note I am dependent not primary applicant and we didn't receive any I-485 denial notice. When GC based EAD becomes invalid to use?
*We didn't appeal for our I-140.

To qualify for EB1C One need to be worked as a manager outside USA(at least 1 year) and presently need to be working as a manager in USA also, with the same employer. One need to submit the organizational chart for all these years he worked as a manager( Upper management level and lower management level) One need to submit how many people are working under him/her, their qualification,yrs of experience and their salaries similarly past records of all these years) He/she need to show that he/she has a authority to hire or fire team members working under him/her etc

And regarding International manager don't know process and all thing which is mentioned in this thread
I want to explain something
My husband is a qualified person in this category. We did nothing. His company Immigration dept lawyer gathered most of the information for paperwork from HR. We just gave our personal documents like birth certificates,marriage certificate, passport,visa copy,I-94 etc and did medical exam and signed application forms rest all the things were taken care by lawyer's assistant. Even we don't know how company is paying for gc. Lawyer assistant keeping us updated. He emailed my husband don't leave USA until AP comes as ur visa is expired. I mean small,small things also we don't need to look at. We do not need to know what is I-140,I-485 etc. Believe me my husband didn't even bother that he want to have green card until I didn't ask him to talk with company to file for GC. So please don't abuse or make fun of anyone that he/she is so called manager etc and not knowing the process may be it is not so important for them.
And about English hmm It's sad even my language Arts is also low level. But Russian,Chinese,Japanese etc people are also working as a manager and gives presentations their English may be not good but their knowledge is commendable. Don't be obsessed with English even deaf and dumb people can communicate. Communication is important. I try not to be judgmental.

To avoid any RFE submit all following documents by mail to USCIS.

For E file make sure you send documents by mail to USCIS

1. I-765 Confirmation receipt/Receipt Notice
2. Applicant's(means Dependent L2 visa holder) Old EAD if applying for renewal
3. Applicant's previous I-94 records(Arrival/Departure)
4. Applicant's If u have I-94 extension I-797A, Notice of Action approval and latest I-94 received
5. Primary Applicant's (means L1 visa holder) previous I-94 records(Arrival/Departure)
6. Primary Applicant's (means L1 visa holder) if applied I-94 extension I-797A, Notice of Action approval and latest I-94 received
8. Primary Applicant's (means L1 visa holder) visa copy(even if visa is expired)
9. Primary Applicant's (means L1 visa holder) passport first and last page copy
10. Applicant's(means Dependent L2 visa holder) visa copy(even if visa is expired)
11. Applicant's(means Dependent L2 visa holder) passport first and last page copy
12. Marriage certificate
13. Applicant's passport size 2 photos

Write down Receipt No. and A# if u have on each document. On photos write it down on back side.

And send all these documents in envelop to USCIS. To be on safer side Its good to send with tracking ID.
Don't choose to avoid any document from above list.

My ead case was pending for more than 96 days. I raised 2 SR, expedite, ombusman,infopass I tried everything but nothing worked. For last hope I called senator's office the receptionist asked to fax privacy release form. I explained my problem on that form and she asked to write 'Emergency' on the fax cover sheet. I did this on 5th nov. called her and requested her to immediately forward it to case officer of senator office. By the time it was closing time of office. The very nxt morning on 6th nov I got a call from senator's office from that officer that he called uscis and placed inquiry about my case. In the afternoon at around 2:50pm I got a call again from him that he got rfe notice from uscis you need to submit few documents(online status changed to RFE). He immediately emailed me RFE notice. I told him I will fax him all the documents in half an hour. I faxed document at 3:30pm and called office again at 4pm. he kept me on hold and immediately sent the documents which I faxed him to uscis officer. And within 20 mins status changed to RFE Response review. And immediately today morning at 8:30 case status changed to Card Production.

He helped me because I sent him job offer letter whose start date was 4th Nov and it was mentioned on the letter within 3 business days submit employment work authorization otherwise ur employment will be terminated. I highlighted this part and requested him to help me.
So my suggestion is to call senator office and explain its an emergency as u already off pay roll. And if possible ask employer to send a letter that ur job will be terminated if u won't be able to produce ead within this much period and send it to senator's casework dept officer. Each time call when u fax documents write emergency on it. But to get help from senator your case need to be pending more than 90 days.
Now I am waiting to get my EAD in hand.

USCIS denies that there is any effect of govn. shutdown. I went to local office through infopass appointment. USCIS do not issue interim EAD. 96 days passed to file L2 based EAD, case status is still initial review. Is L2 based and I485 based EADs handled separately by USCIS or same queue. I filed at CSC.
I asked que. regerding delay when I attended infopass lady said they have heavy backlogs due to deferred childhood act.
I tried everything so far to get EAD earliest but nothing worked still waiting.....
