Topic: 2 cases pending; one approved, who withdraws the other one?

When I started this journey I filed as an EB3 but later because of a promotion and my Masters I refiled as an EB2. The EB2 was approved last month but the EB3 is still pending. Obviously I don't need 2 cards but I'm not entirely sure who withdraws the 2nd application - my lawyer or USCIS??

I have been working in the pharmaceutical industry as a scientist for the past few years. I am planning to go back to school to do an MBA to work in a more business orientated role in another pharmaceutical company. I don't plan on leaving my sponsoring company just yet but eventually it is going to happen. Am I going to have problems down the road???

Got my card last night - its finally over... Apart from updating the status of ur drivers license do u need to do anything with ur social security no or do u have to update USCIS everytime u change address? Someone posted a list of things to do once u get ur card but I can't find it... If anyone can remind me I'd really appreciate it. My card was approved last monday on the 10 august and 7 days later I received my card.

My PD is current and those processing dates are only a guide but never accurate!!! I know someone else from Ireland who had a processing date of Apr 08 also with a current PD who was approved last Sep, so those dates are nt a good indicator of whats going on...

If you get an RFE from Immigration is there a certain period of time that you get to respond to them and if you go beyond that time because you are waiting on someone else to provide you with the appropriate paperwork what happens??

I finally got my I-140 approved on Friday. The application has been pending since Aug 08. Such a relief to have finally taken a step forward. My only concern is that as my category is current immigration are going to focus on my 485 soon but I am waiting for I hope, approval of a Visa Screen Certificate from CGFNS and they are been even worse (who thought it was possible) than Immigration to come to a conclusion. Don't get me wrong I know that to be so close to hopefully the end of this is such good news and it has put me in a great mood. Its just something of concern that they are dragging their heels with this. Am I allowed a certain length of time to respond to immigration before something bad happens?? If anyone else has been in this situation I'd love to know....

I completed my Degree and masters in the UK. New York State approved my license 3 years ago and I have just renewed it again for another 3 years. I don't know all the details yet as they just updated my status online today. But what they have posted is that 'Transcript was determined to be Deficient in Meeting Requirements'. And based on their previous correspondence it will probably take them a couple of weeks to let me know exactly what the problem is.... Can you appeal decisions like this especially if New York State has granted me a license???? I realise that this is needed for approval of my 485 and my GC is as an advanced degree thats why I was so pissed off when I saw this today...

I am a licensed professional in New York so I have to get a Visa Screen Certificate before they will proceed with my GC. Just checked my status and with regard to my Education they have that my education requirements are deficient. Has anyone else ever been in this situation before and what happened??? Justy when I thought I was finally getting closer to the end this crap pops up.....

Topic: what is Ombudsman query ?

I think the liason request that you are refering to is when your atorney speaks to their ALIA representative. Not exactly sure who they are but they manage to get in touch with USCIS and find out exactly where your application is in the process. If you want to open a query with the Ombudsman there is an application on their website - if you google USCIS Ombudsman it will bring you to their page and I think the pdf for the application is about half way down. Fill in all the details that they ask of you. The only thing that you need to remember is that they won't entertain a request from you about your I-140; your lawyer needs to open the query on your behalf. They will for your 485 and they were pretty fast about getting back to me when I contacted them even though I thought at the time that they would look into my 140 for me. Definitely seems more productive than opeing a SR with the Customer Service people. Let me know how you get on...

The Ombudsman is different to opening a SR. When you open a SR you are still talking to USCIS. The Ombudsman is a seperate body and usually they are a lot more helpful in investigating any delays that you may have with the processing of your case. Unfortunately as with SR for I140, it is only your company's lawyer that can send them a query if you are outside their processing times. Definitely worth doing...

They already opened 2 SR and in both cases they were told that they needed more time. My question refers to contacting the Ombudsman not the Customer Service line - I know that your employer is the only one that can contact them. I sent a query to the ombudsman and they just refered to my 485. Is your employer the only one that can contact the Ombudsman???

I sent the Ombudsman a query regarding my I-140 because it has been pending since Mar 08 and the processing date for Texas is 4 months but my application has nt been touched since it was moved from Texas to Nebraska in Aug 08. They replied relatively quickly - maybe within 3 weeks; but their reply was with regard to my 485 not the 140. My question is, as with the Customer Service line, does the Ombudsman only take queries regarding pending 140's from the employer not the applicant??

Good to know, whats an EVL RFE? I am in both situations. If I had to leave my current job for another one can I carry the EB2 application with me to the next job even though the 140 has nt been approved? Its just that the EB2 has a better chance of getting approved sooner rather than later and I hate to loose it.
