Hi all
Sorry about posting in this forum. But since this was the most active form and I needed some responses urgently, I am doing so
My wife is an Indian citizen living and working in the USA. She is on a H1b visa. The status is valid but visa expires in August.
We are planning on a Europe trip in September.
She will need to get her visa restamped in Europe. We are thinking of the US consulate in Stockholm.
Does anybody have any experience with this? Is it safe and straight forward? How long does the process take?
Would appreciate any information I can get in this regard | |  |  |

Hello Everyone,
A quick question:
I am on H1b and my 485 is pending since 2007. My company has 2 offices within a 2 mile radius. Due to strategic considerations, we are closing one of the offices and consolidating into 1. As a result, I am moving to the other office that is less than 2 miles from where I am right now. Even the ZIP code remains the same. NOTHING else changes. Do I need to do ANYTHING at all as far as H1b and/or I485 is concerned.
Please let me know your thoughts especially if you have had to do something similar.

Thank you Fourier and others for your inputs. It seems like I got real lucky here. Most of the testing is done. Tomorrow, on my way to the airport I'll stop by the Dr's office and get a couple of vaccines. They'll also see the result of the TB test at that time. AS far as the chickenpox vaccine, I mentioned to the dr that i do remember getting chicken pox when I was a kid and he entered as such on the form. Apparently thats the only vaccine USCIS will let the Dr go by the applicant's word. So, barring something unforeseen, I guess I'll be on my way to Europe tomorrow.

Thanks Janisri for your response. I am scheduled to fly out at 6 Pm tomorrow! Wednesday! I am going for blood work this morning. I really trust my attorney to take care of sending the response to USCIS. the dr. works with my attorney and they said they have no problems with sending it directly to her once everything is complete, as long as I hav etaken care of everything that I need to be here for-like taking vaccines!!
wel,, this is a long long planned vacation to attend a family gathering/religious function. I hate to cancel. Also, the financial ramification. I stand to lose more than a 1000 USD if I change plans-hotels, flights, etc.
At the end of the day, the GC process is most important. I am holding off changing travel plans for now. I'll have to decide in the next few hrs. | |  |  |

Thanks so much nanotechfor your thought. I have an exceptionally good attorney that will C of everything. In fact she recommended the dr to me. But, I guess I should have been a lil more specific. Lets say the dr determines that I need 4 vaccines. Do I need to take ALL of those before replying to RFE? | |  |  |

Hello friends,
I am a july 2007 filer- EB2 India. Thats immaterial anyway, for now.
I just got an RFE today for immunization records and I have NO records. I am left with 3 weeks to reply. I went to a civil sugeon today and have started the TB skin test which will be complete on Wednesday. Tomorrow I am getting blood work and physical done. So far, so good. The problem is I am scheduled to fly out of the country for 3 weeks on vacation. How long does it take to get all necessary vaccinations, is any? Do you think I should just postpone/cancel my travels due to this? Please let me know.
I really really would appreciate your reply based on your experiences.

Hello friends,
We sent an application for renewal of my H1b status in September to vermont center. I have no clue when to expect an approval. The USCIS website hasnt been updated since Aug 31st on the processing times for all centers. Is that correct? Isnt this very uncommon? I was under the impression that they update it every month. Please let me know.

Hello Friends,
One of my close friends recently was affected by the current economy. His labor has been recently approved. He is currently on H1b while his wife is on L2. Here are couple of questions if you could answer, I'll be very grateful.
Now, if he were to decide to move to L2 and NOT apply for EAD (I was told it would take perhaps 6 months for EAD to be processed), but just wait for a few weeks until he finds a new job:
1) Is he considered to be on L2 the day the application reaches USCIS or does he have to wait until they process his application?
2) Will it possible for him to move right back to H1b status (when he finds a new employer) even while his application to change status to L2 is pending or are there any statute and/or processing time bottlenecks for this?
3) Under the given circumstances, what do you suggest is the best course of action in terms of not going out of status and his GC process? H1b with a consultant or L2 for now until he finds an employer (non-consultant)?
I realize that this might not perhaps be the most appropriate forum for thsi question. However, I feel that the folks in this section hav emore often than not come a long long way with immigration process in this country and so will have a good insight on this type of a situation.

akrk I see what you are saying. But, its clearly mentioned on the PP form I downloaded on NYC embassy that said "there is no such thing as an additional booklet"! I HAD to apply for a new PP. They have just stamped the first 2 pages of my old PP with a RED seal to the effect that the PP is cancelled and all valid visas continue to remain valid.
Yes, I do plan on stapling my old one to the new one, so that tehy always remain at 1 place! The good thing is on my new PP, they have mentioned the number for my old PP. That might help clarify any confusions at POE too.
I am surprised that USCIS has noo process/procedure/requirement for updating them with new PP details!

Hello Friends!
I recently applied and got a new Indian PP from the NYC Embassy since there were no more empty sheets for visas on my old PP. So, the new PP number is different from the old one. The question is: What do we need to do in terms of notifying USCIS about this change? Is there a precedence/protocol? Please let me know from yoru experience.
Also, the embassy has made a couple of mistakes on the last page with regards to info about my father's full name (they have missed 1 of the 4 names in his full name) and a wrong zip code for my address in India. Has anyone of you had this issues and if yes, what do I do now?
PS: My I140 got approved last week. PD: 4/07. EB2 India, Nebraska center. I485 pending since July 07.

Yepp! You got points 1-4 right! Now, I used have a hard time understanding this. However, Indian companies do this all the time. She will get paid in USD terms ONLY for the periods she spends working here. The rest of the time she is in India or whichever country, she will continue to be paid in that country.
To answer your question, she continues to work in India for H1 sponsor. The fact that she entered US on H1 doesnt mean she HAS to be here for the next 6 years. She can come and go as she wants as long as they pay her the US salary when she's in this country.
Now, if she were to come here on h4 and if her compnay revokes her h1b, she isnt depended on them any more to b in this country. She then files for a new H1 (however not subject to cap) from some other co and she transfers from h4 to h1. Does that Kinda make sense? | |  |  |
