Topic: 17 Month OPT Extension E-verify Side Work

I believe that with OPT you are only allowed to work up to 40 hours per week, no more than that. If you are already working 40 hours full time you can't work on the side. I am not sure if you can do contracting though check with international student advisor in school and/or lawyer.

Thanks. My sister is now studying in London, UK and it worked out great for her. At first she was very upset, she thought she lost 3 years of hard work and money, but she was able to go to London and get her degree. I guess USA did not want her money and a bright student like her (all A's and always in status).

I felt the same when I got my GC, I took advantage of the Law that president Clinton introduced and I got my GC through that route. I have less than a year to apply and I am not looking forward to the tension again, hopefully they will speed up the process by then. :) We only dare to dream....

hushley14: I think filing an I-130 as a spouse of a permanent resident with an F visa was a very bad idea. You won't be able to get any benefits until the spouse becomes a citizen or five years pass, AND you won't be able to get any new F visa cause you showed immigrant intent!




Being married to a permanent residence shows an immigration intent, but much weaker than having an immigrant petition pending. A pending immigrant petition shows the strongest possible immigrant intent, making it impossible to get a non immigrant visa. Just having a PR spouse isn't THAT bad.



I was actually responding to dreammercc. She already showed immigration intent since she married a LPR holder.


to who's post are you responding to? Coz I don't think anybody said you couldn't get LPR if married to one, or that life wouldn't be a lot easier. We're merely pointing out the differences in processing time. The whole process of petition and adjustment of status of the spouse of a LPR takes A WHOLE LOT longer than a spouse of a citizen.



I am aware of the processing time as the spouse of LPR and USC is different. On the other hand, look at your own experince, you married USC and still it took for you about 4.5 years to get your GC. For spouse of LPR is almost the same 4-5 years as of today's Visa Bulletin.

Moreover, when you say to someone they have done a huge mistake to file I-130, when in fact if she got married to someone who is in USA as either LPR or USC then She has diffently shown intent for immigration. Marriage to LPR does not look good especially for an F-1 student; even if she has not filed a I-130 petition. For example, if a student in F-1 status ended up out of status, USCIS would not reinstate that person in F-1 status, only based on the fact that she is married to LPR. The best thing to have done is to not get married at all, until her spouse is USC.


And why will it take you 10-12 years to become a citizen? Do you wanna wait that long? Coz generally, you can become a citizen after 5 years of LPR. Is certain conditions, you can become a citizen in 4 years, 3 years, or 1 year after LPR.



If you read my post carefully, you would see the point I was trying to make was:
I am on GC or LPR status in USA
My Sister was in F-1 visa (for 3 years), went to renew the visa in home country.
Her visa was refused only because she had her brother on GC (that is what the consul said to her - intention of immigration having parents, sibling, fiance or spouse in USA).
The point as I was saying in my post, I was her brother (GC holder) no connection with her (A GC holder CAN NOT SPONSOR SIBLINGS) I would have to be a USC and then sponsor her (This sponsorship would take 10-12 Years). I said nothing about my citizenship taking 10-12 years.

I am not sure how come it is not bad to have a spouse who is LPR. My sister got her F-1 visa refused (eventhough she was already studying in USA for about 3 years, excellent student all A's) and they refused the visa only because I was here in LPR status. As her brother I can't sponsor her yet (without getting my citizenship) and that sponsorship takes about 10-12 years, right? So imagine if she was married to LPR, just personal experience.

What you say may depend in which country you are from, too.

Anyhow, whoever gets to be da BOSS of USA, hopefully does something about this immigration mess.

Well it is not a bad idea either, since she is married if she went to embassy to renew her F-1 visa and she would still be in trouble. In the application there is a place where is says if you have anyone in USA parents, siblings, fiance, spouse and children. You never know how long it will take for her husband to become a citizen, as of now it takes about 5 years of residency and 18 months of processing time in some places to get the citizenship. (I even read somewhere that people are stuck in name check for about 2-3 years for USC) I think filing her I-130 is good, she is in the system and can update that anytime her hubby becomes USC.

As far as I am concerned If my spouse happen to kill someone , there is a chance I would forgive her, but cheat on me the relationship is dead and there is no point dragging a dead relationship and likewise for my wife .She probably would have her family beat me up on one of my trips back home to India as well. :) :)




I am glad that you would forgive your spouse if she killed someone, she would only be taking a human life.... hey what is the problem here..... there are plenty of others. How many Billions? LOL

Just for a fact, 9 out of 10 people will be cheated on during their lifetime, I think your chances here are way too small to not be cheated on.

I think Clinton should win, USA has never been better than with Clintons in the White House. They are both smart and this country is in need of a change after Bush's mess that he created inside and outside USA.

That's interesting, they might either reject it or maybe use the date of her citizenship as a reference. Normally they reject your application if you are not entitled to the sponsorship.
