Thank you LRIndy.

It makes sense that it should not make any difference as I already have EAD & AP and my status changed to EAD from H1 since I have already updated my employer with my EAD details couple of weeks ago before the H1 withdrawl. But I am yet to talk to my employer to ask about reason they mentioned in the withdrawl request. But what ever it was I can not do any thing now. So I will wait and see how it goes and will update my case fi there is any progress.

Need expert advise or similar experiences on the subject mentioned in the title.

My AOS (EB2 India) is pending for more than 14 months and I responded to a RFE( On EVL) for AOS 40 days ago. 4 days ago my employer withdrew I-129 (H1 extension) petition after 8 months of its submission at Vermont and today online case status changed to Acknowledgement for Withdrawl petition sent.

My concern is that whether there will be any adverse effect on the processing of my pending AOS?

smkzan,

Per my understanding, you can not work after your EAD expire if you do not have valid work permit like H1 or something like that. If you continue to work after EAD expire, you will accumulate illigal work for that period until it is approved. You better call USCIS customer support and let them know the situation and figure out if there is any posibility of getting the interim EAD or expidited EAD from you local ASC(Application Support Center).

I would not work if I am in the above situation.
If you have an attorney consult immidiatly to find alternatives in getting the EAD.

Topic: I-485 RFE confused

I have received a similar with exactly worded RFE from NSC for my I-485/EB2 India. I requested my employer to send me a EVL letter covering all the points they raised in the RFE and I got the same last week and planning to send the response. Do I need to send any thing more than this letter? Do you guys think its better to send it thru an attorney instead of sending it by my self?

Thanks much for you immediate and assuring response. I have seen and read people posting these kind of RFE's and responses in this forum for longtime. But when it comes to ones personal, will start thinking differently. I am not worried, but somewhat skeptical since no one knows how USCIS responds to RFE's responses. Thats all.

Do you think I need to consult an attorney for respoding to this RFE? Or I can submit response by my self?

Can you please post if there are any updates on your case, after submitting the response to RFE?
I did get the same kind of RFE and I am in the preparation to send the response. When my I-485 filed, it was filed thru my employers/attorney and I am not sure whether they submitted this initial evidence (EVL) letter along with my AOS. After receiving the RFE, I requested my employer to provide me the EVL and they are sending it now. Once I get that I am planning to submit the same to USCIS by myself. Is it ok to send response by myself or do I need to consult an attorney and file the response thru them?

Is there any chance that after submitting the initial evidence with AOS, the USCIS still ask for the same for any different reason? Ant body have any experience on this? Please post..

I belive that by receipt number it is having Notice Date (ND) of October 13, 2007.
There are many people approved ever after this ND. Go check in trackit data by selecting approved by ND.

Topic: No updates after RFE reponses

There is no thing called Visa # allocation, but pre-adjudication of a case and that too when USCIS satisfy with the documentation submitted with application then they request DOS a visa number and approve the case. If there are any RFE's issued then they wait until they receive all the responses to the RFEs and again if they are satisfied with responses for the RFE, they would request for visa number and that too only if the PD is current at the time they decided that the case is approvable. But the actual approval intimation may come at later time like when PD is not current. This may or may not reflect on the case status online. Case status information on online is not always reliable and acurate.

Most of the times they update the case status when they receive the response to the RFEs. In some cases it take little more time and they may not see the case status changed immediatly. If you think you submitted your repsonse 3 or more weeks ago, then it is advised to call the CSR number to know that status.
