Sorry for the duplicate post, but can somebody answer these questions:

1. If the dependent applies for I-485 many months after the primary (while primary's is still pending), and then primary gets approved, does the dependent have to write to the USCIS to inform them of the change in the primary's status? i.e, the primary's I-485 is no longer pending, but has been approved.

2. If the dependent is on an H-1B and has a steady job and income of their own, does the primary still have to show an affidavit of financial support for the dependent? (the primary's GC category is employment based).

3. This question could apply to primary or dependent. If the applicant gets a new passport (because old one had run out of pages) after applying for I-485 with the old passport and the I-485 is still pending, do we have to inform USCIS that the applicant now has a new passport?

Can somebody explain why uscis is pprocessing Nov and Dec cases when there are still a whole bunch of sep and Oct cases that are still in fingerprint fee accepted status? I mean, it's not just 1 or 2 of them, there's many from sep and Oct.

Did you have any case updates on your i485 before it got approved? My RD is 10/15/2014 and I am still waiting. I saw that with an RD of 10/31/14, your 485 was approved today. My 485 case status went from 'Case received' to 'Biometrics appt was scheduled'. That was 4 months ago, and it is still showing that, even though I took my biometrics appnt in Nov last year.

I think, clearly, the one question that everyone is asking over and over and about which we do not have clarity is- what happens when an H1B holder has their H1B extended past 6 years on an approved i140, and then changes jobs and starts perm and i140 process again. If the old company does not revoke the old i140, is the H4 holder still eligible for EAD?

Its the question of the day! Somebody, please ask them at the conference! :)

Hello Anirban, Pooja, Balasubramanian, Vigneshwaran and Vinod,

If any of you read this post, could you please include one more question to the USCIS officials if they are also present at your meeting with the OMB folks?

The rule states that you have to either show proof of a) H-1B principal's approved I-140, or b) proof of principal's H-1B extension based on AC21 106(a) and (b). My question is: can they please make sure to clarify that we can also submit proof of H-1B extension based on AC21 104(c)?

AC21 106(a) and (b) are 1 yr H-1B extensions. AC21 104(c) gives 3 yr H-1B extensions. This is usually given to an H-1B principal who has an approved I-140 but cannot apply for I-485 because PD is not yet current. These H-1B folks can change job and retain the same PD. They will have to start perm and I-140 application again though. What should the spouses of such individuals submit as proof if the old company has revoked the approved I-140?

So for example, my husband is in his 8'th yr of H-1B and has got 3 yr H-1B extension based on AC21 104(c). He had an approved I-140 at his old job, but PD was not current. He recently changed his job, and his new company is going to start perm and I-140 process again. I am not sure if the old company has revoked I-140, so I may or may not be able to submit it as proof. Clearly, he has an extended H-1B, but it is not based on AC21 106(a) or (b). It is based on AC21 104(c). I should be eligible for EAD under this rule, but they need to clarify in the list of acceptable proof documents, that you can also submit proof that principal H-1B has extended their visa based on AC21 104(c).

Sorry if my question is long and unclear. I know there are many folks in a similar situation such as mine...so if possible, please do ask them this. Thanks a ton!

Exactly! Just sheer indifference on their part. A "we'll get around to it when we have time" sort of attitude. The only way to push them to get this done is to shame them. We should ALL (and I mean ALL 10,000 people who wrote comments on the H4 EAD rule) tweet the President on one day and request him to send word to the USCIS to get this done. Lets set a date for this campaign, like say 2 weeks away and use the time to inform EVERYONE who commented to join in the action. This is ridiculous! They will happily push this to 2015 when all the other EO rules might get legalized. :(

hmm...I stayed till the end hoping they would call my name, but they didn't.

For the record, this was the question I was planning to ask so that I could relate it to DACA.

"I was just wondering how the timing of DACA work authorization permits would relate to some of the other executive actions that Pres. Obama announced on immigration: I know he has planned to give EADs to some other groups too, for example, the rule giving work permits to H4 visa holders. Does one have priority over the other or does it affect the timeline? and also, do you know when the final H4 EAD rule will be published?"

They have more calls for DACA planned in the future...so I'll try next time, but I sincerely hope the rule is published by that point.

No no...don't raise my hopes up if its not true!! but please please let it be true!! =P

Haha..if this is true, maybe they were spooked at the thought of hundreds of us calling in to the USCIS DACA teleconfernce today to ask about H4-EAD and they decided the headache just wan't worth it. ;)

Hahahahahahaha....irony of ironies. Mr. Vkz8981 complains about abuse by Indian IT outsourcing companies, and then advises people to abuse the system themselves by paying desi companies for an H1B or enrolling at a fake university for OPT. Please nobody listen to his/her horrid advice.

I am fully in kamakazee's camp of continuing to email, tweet, fax, call and bug the administration in every possible way to stop further delay and publish the final rule. Someone said last week they found out that the rule has been finalized and sent to Jeh Johnson for his final signature? Lets just keep contacting his office. Hopefully a show of strength on our part will convince them to not delay this any longer. If for no other reason, than to stop the flood of emails coming from our community!

I really hope they publish this in Dec to. :( The budget has passed house and senate...no govt. shutdown for now. Holidays are coming up. They might as well publish the rule and just finish with this!
