ac21 clearly talks about portability for similar job after 180 days. If USCIS has questions on the employer it would ask for a new evaluation letter. That should be sufficient to fulfill the AC21 requirements. Even after filing AC21 on time it is not guaranteed that USCIS will not ask for AC21 documents, however, I would go ahead and send AC21 documents, cuz there are no downsides to it.

I am using AC21. I have left my previous job. Planning to start my own business. Also have a job offer which will start after three months. I spoke to my lawyer and also got a second opinion. I was told that I should be fine. Also I was told that I could do part time jobs as a contractor using my own corporation. You are in trouble only if you receive an RFE when you are in between jobs and do not have an offer letter. Also if your I485 gets approved in ex-employer's name that's a problem. Consult your lawyer.




I485 belongs to the employee and not the employer. Hence it should not matter who you are employed with when you get approval, provided it's a similar job.

Chiller,

Did you change your work location such that you had to file an AR-11? Or did the earlier company cancel your H1B ?

I was just curious, what prompted an RFE for you considering the fact that your PD is not current.

It's definitely possible that your RFE was triggered due to EAD application.

Based on all the advice on this thread, it seems this is a common RFE, and since you have the right facts on your side ,you should/will be fine :).

When did you move to WA and then how much time later did you receive your RFE? I'm guessing that you made an address change through AR-11 once you moved to WA.

Gosh never thought EB1Bs have to wait this long. I would think you should be able to raise an SR to expedite your case.

As far as the 2 yr EAD thing is concerned, I don't think USCIS is following the logic it has put forward to approve 2 yr EAD at all. I think frankly, it's good for ppl who are waiting for their I-485 pending to have 2 yr EADs, no more worries if God forbid one gets laid off or tensions on new EAD not being renewed on time when one is working on EAD.

Once again based on the 2 yr EAD approvals that I have seen on this forum and elsewhere, there is nothing to suggest that USCIS is examining each case individually and approving a 1 yr or 2 yr EAD

Topic: Received 2 Years EAD card today. But...

same with me. USCIS swallowed 2 months from my current EAD. Current EAD expires Oct end 2008 while the new one starts on Sept 1,2008. Bunch of incompetent people working there!

You were under a valid F1 visa and were not paid during that one month. There is nothing to show that you got paid. I dont see any problem with your case.
