Topic: H1B Transfer. When can it be done?

I just got the documents from my company yesterday. It states the effective date of the H1-B is from 1-Oct-2007 until 24-Sept-2010. But i've also heard people saying i need at least 3 pay stubs from my current company, while i'm under the H1-B, and that the pay stubs given to me during OPT cannot be used for the H1 transfer to a new company. Thing is, i seem to be hearing different things from different people, and as such, was hoping to get a little more understanding before contacting a lawyer.

Hi robin,

When you say Invalid, i don't really understand that part. As i was under the impression that although the H1 has been approved, but it also states that one can only start working after Oct 1. During the period, i would still be under the OPT status, that is one of the reason why some people have problem with the gap between the end of their OPT and the start of their H1. Least that's what i thought.

As such, based on the above assumption, i am not sure whether i can do a transfer of H1 now, as i read somewhere a transfer can only be done after Oct 1, otherwise it might result in the cancellation of my H1. Not too sure how much of this is true.

Hi,

I just got my H1B approved for this year under the Masters quota. I would just like to find out as to how soon or when can i do a H1B transfer? I am currently on OPT and as per my understanding, the H1B is only effective from Oct 1, 2007. Since my H1B is already approved, can i transfer my H1B to another company before the Oct 1 date?
